Dear Ron:
Attached is a PDP application for a 21 unit designated affordable
condominium project we propose at 105 south Taft Hill Road. The
property is owned by Jensen Investment Group LLC, which is entirely
owned by Michael Jensen.
Statement of Planning Objectives:
(i) The project as proposed furthers the following goals and policies of
City Plan. Section 1.2.2 C states that one purpose of the code is to
"foster safe, efficient and economic use of the land, the city's
transportation infrastructure, and other public facilities and
services". The project as proposed is clearly an efficient use of the
land, and because it is a relatively dense affordable housing project
on a major bus route, it will also promote the efficient use of the
cities transportation infrastructure.
Section 1.2.2 F "encouraging patterns of land use which decrease
trip length of automobile travel and encourage trip consolidation" is
furthered by this project again because the development has a high
density, and is an infill project near the cities core, it will likely
decrease VMT.
Section 1.2.2 G "increasing public access to mass transit,
sidewalks, trails, bicycle routes and other alternative modes of
transportation." This project furthers this goal by providing
affordable housing on a major bus route, therefore increasing
public access to mass transit.
Section 1.2.2 (H) "reducing energy consumption and demand."
Attached multi -family construction is an inherently energy efficient
housing type, and therefore furthers this goal.
Section 1.2.2 (L) "encouraging the development of vacant
properties within established areas." As this project is an infill type
development, it clearly furthers this goal.
Section 1.2.2 (M) "ensuring that development proposals are
sensitive to the character of existing neighborhoods". The
architecture we are proposing is "neo traditional", and is designed

RC: Cherokee Flying Heights City Final Approvals
Dear Dimitri:
This letter serves as written documentation regarding the development of the site along Taft Hill
Road, south of Laporte Avenue (commonly known within the City as "Cherokee Flying
Heights'). This project has still not completed all items related to the City's Final Compliance
review. Namely, a final plat for the project has never been recorded due to an incomplete plat
submittal. There have been attempts to contact you in order to have this item remedied, but have
gone unsuccessful.
It has recently come to the City's attention that ownership of the development has since changed
hands and that Apa Co Industries and Importers, Inc. is no longer the entity of record having
ownership. Thus, if correct, it would appear that the City cannot record such a final plat and enter
into a development agreement with Apa Co Industries and Importers, Inc. as the owner to
complete the Final Compliance review.
We have been in contact with representatives of Flying Heights, LLC, who will apparently
provide documentation that they are the legal owners of record. As a result, provided FIN' .
Heights, LLC is able to provide this information, the City will revise the development agreement
and plat to reflect this new ownership.

• Comments: Dmitri, per our phone conversation this morning, the project has not been completed
formally As was noted in the letter originally dated December 12, 2003, a final plat for this project has
never been recorded because the plat was an incomplete submittal. In order to complete the final plat
(which would therefore complete the final compliance review for the project), the following needs to
occur.
A complete mylar plat must be submitted to the City. More specifically, an original plat, consisting of all
sheets in the two sheet set, must be submitted Sheet 1 of the plat must have all original signatures
related to the owner present (including but not limited to, owner, lienholder(s), notary, and attorney
certification) with all signatures dated no earlier than today (January 13, 2004).
In addition, two rnylar copies must also be made from the original complete mylar plan set, for a total
number of copies submitted to the City of three (3).

Initiate Development Escrow Account for Construction of (Future)
Pennsylvania Street at Cherokee Flying Heights Subdivision
This memo is to acknowledge the receipt of escrow funds in the amount of $7 480.00
for the following:
Guarantee of the completion of all future public improvements to be constructed as
detailed in the Development Agreement section II.D.4 including: the construction of
Pennsylvania Street within the development and to close off the driveway access from
Taft Hill Road.
When improvements to the Right -of -Way are completed, please call our
inspection recorder at 221-6609 to request an inspection (please allow 24 hours
for the inspection to take place). Once the improvements have passed inspection,
the funds in escrow will be released to you.

to break up the large multi -family buildings into more traditional "old
town" residential facades in order to be compatible with the
character of the existing neighborhood.
(ii) There are three main open space areas in the proposed
development. The first is a combination open space/ water quality
pond at the entry of the development. The other two are between
parking areas, and the adjacent land owners. This is intended to
diminish the effect of the parking lots on the existing neighbors.
The Circulation is essentially a deep cul-de-sac with a 100'
diameter turn radius as requested by the Poudre Fire Authority. It
is a private drive 24' wide with parking on both sides. Both the
open areas, and the drive will be maintained by the home owners
association.
(iii) The project is intended to have both for sale, and for rent units in it.
All open space, sidewalks, parking and drives will be maintained by
the home owners association.
(v) The project is a relatively dense multi -family project clustered
around a private drive. This layout was chosen for the efficiency it
offered as well as the interior focus it offers. It is hoped that by
facing the units toward one another, we will create a sense of
community as residents use their front porches. It is even possible
given the fact that the speeds on the drive will be quite slow with no
thru traffic that the drive may take on a dual use as a bicycling and
roller blading area for children in the project.
(vii) There are no known wetlands or natural areas either on or adjacent
to the site. Landscaping is provided between the proposed project,
and the adjacent neighbors in an effort to provide a transition
between land uses.
(ix) The project is being call Cherokee Flying Heights. It is my
understanding that the project has been to conceptual review many
times under many names, mostly by applicants who attempted to
reuse the Existing foundations on the property.
(1) The developer wishes to commence development as soon as
possible following approval of the project. All open space and
amenities will be developed in one phase.

Flying Heights Affordable Housing Project
Date: May 9, 2000
The Cherokee Flying Heights project is a 21 unit; one hundred percent designated
affordable housing project at 105 South Taft Hill Road. All of the units will be affordable
to households earning 80% or less of the Area Median Income ($45,050 for a family of
4). Therefore, it qualifies for Priority Processing and a 100% waiver of its Development
Review Fees as an affordable housing project. The waiver only applies to fees charged by
the Current Planning Department.
Please implement Priority Processing procedures for this project's development review
process. The developer submitted an application for review to the Current Planning
Department on May 9, 2000.

Here's a summary on the status of the Cherokee Flying Heights project:
The utility plan mylars were fully signed off today 4/21/03. There are sticky -note corrections that were
noted by water & storrnwater which are required to be made. Please ensure that these corrections are
made on the mylar copy and the six signed & stamped bluelines which we require. The signed mylar can
be picked up by Shear Engineering at Current Planning's front counter.
The Development Agreement has been signed off by everyone except the City Manager. Engineering
cannot release the DA for final signature and full execution by the City Manager until the plat is submitted
(with all signatures except the City's) to Planning. In speaking with the Developer yesterday, the plat
needed an additional signature by a lienholder before the owner's attorney would certify. Because the plat
and DA are executed at the same time and there is no guarantee that the plat will be returned soon, the
Development Agreement is on hold in the interim.
Permission for construction to begin (via issuance of the DCP) still cannot begin for a number of reasons
(including the plat mentioned above:)
1) Evidence of the erosion control deposit being made (needing to be posted at Stormwater) per the
Development Agreement in the amount of $1,710.00 is required to be presented to Engineering (as
standard) prior to DCP issuance.
2) Maurice Head in Advance Planning, has not received the affordable housing documents back from the
Developer. Engineering cannot release the DCP reflecting that bonds and fees are not required to be
posted until Engineering receives documentation that affordable housing status is granted. I saw these
signed documents frcm the Developer yesterday, for whatever reason they were not delivered to Maurice.
Please note that if affordable housing status is not granted, the project will require the posting of a
development bond and inspection fees, which will further delay permit issuance.
3) Cameron Gloss in Planning, needs all the finalized PDP documents (aforementioned plat, site plan,
building elevations) as standard. The only mylar document in his possession is the landscape plan, which
I removed from the utility plan mylar set. Engineering will not release the DCP until these documents are
received and are viewed as ready for City signature.
