(Event ID 3220) Dear Dr. Flurkey: The Division of Oil and Public Safety (OPS) has reviewed the December 2006 Quarterly Groundwater Monitoring report for the above referenced site received June 4, 2007. Based solely upon the information submitted it appears you have removed the source of contamination and reduced the potential for endangerment to human health, safety, and the environment as a result of the contamination at this properly. Soil is present onsite with a concentration of benzene of 0.410 mg/Kg (measured on April 21, 2005). This concentration is in excess of the risk based screening level (RBSL) for benzene in soil of 0.26 mg/Kg. The results of a Tier 2 soil leaching to groundwater model, performed using site -specific data, is consistent with site observations indicating that contamination above the RBSL will not migrate beyond the property boundary in the future. In light of the remedial action taken at this site, and the confirmatory modeling results, OPS does not require any further investigation or remedial action at this time. OPS cannot release you from any liability that may be associated with any contamination at or from this site. If the function of the property is modified for a different use and the new business does not dispense petroleum products, the OPS must be contacted immediately. This no further action (NFA) letter is in reference to the conformed release reported at the site on November 30, 1989.
