North, Range 69 West, Larimer County, Fort Collins, Colorado
Dear Sir:
The intent of this letter is to verify that the City of Fort Collins is aware of the
building encroachment into the traffic easement as dedicated by the plat for the
Extension of K-Mart Plaza. In addition, it is our intent to process any request for
vacation of this easement at the time the required documentation as prepared by
a licensed Colorado professional engineer has been provided to the office of the
City Engineer.
Please find enclosed an information sheet which discusses the process and
submittal requirements.

Mr. Stringer,
Thanks so much for your cooperation Please send a letter to the bank
that provides for the following:
1. The City will vacate the traffic easement upon filing and
processing the appropriate documentation from the property owner.
2. The City has no intention of enforcing the easement or citing
the property owner with a violation due to the building's encroachment
upon the easement.
Please send the letter to my address and include the following somewhere
in the letter: " I am providing you with this letter for the benefit of
North American Savings Bank, F.S B. who may rely upon the statement made
herein."

American Savings Bank, F.S.B. the City has no intention of enforcing the City's
rights under the encroachment or citing the buildings owner with a violation due
to said encroachment. The City is willing to process arequest for vacation of this
easement at the time the required documentation as prepared by a licensed
Colorado professional engineer has been provided to the office of the City
Engineer.

Tract 1, of the Extension of K-Mart Plaza

Dear Mr. Stringer:
On behalf of our client, Steve Schroeder, we apply to the
City of Fort Collins to approve our client's request to vacate
the 30 foot Traffic Easement across Tract 1 dedicated on the
Plat for the Extension of K-Mart Plaza (the "Traffic Easement").
With this letter is a copy of an Improvement Location
Certificate ("ILC") that was prepared by Burdick Engineering
Consultants Incorporated on September 2, 2003. The Traffic
Easement has been highlighted on the ILC for your reference.
All existing facilities, structures and roads are shown on the
ILC.
Our client will proceed with getting a specific legal
description for the Traffic Easement prepared while you obtain
the annroval of the various Citv departments. In the interim,
please let me know if you need anything further to facilitate
the process.
