Attached for your review and comments are a vacation request and a sketch by the
Applicant showing a traffic easement in Tract 1 of the Extension of K-Mart Plaza
Subdivision more specifically located at 2413 South College. A thirty (30) foot traffic
easement runs along the west property line of the lot described above, and as shown on
the attached Exhibit 'B', is being proposed for vacation. The Applicant is requesting the
easement vacation because the existing building encroaches into the easement. Also
included with this memorandum is a copy of the request.

f.a Planning and Zoning Board to vacate certain easements by resolution or by approval of replats

m W WHEREAS the Owner has requested that the City vacate a traffic easement located on
m Tract 1, Extension of K-Mart Plaza, more particularly described on Exhibit "A" and Exhibit "B°;

p K NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort
x Collins, that the traffic easement on Tract 1, Extension of K-Mart Plaza, located at the northwest
corner of Drake Road and College Avenue, and more particularly described on Exhibit "A" and
Exhibit "B", attached hereto and incorporated herein by this reference, is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the City
of Fort Collins held this 15th day of January A.D. 2004.

DESCRIPTION OF EASEMENT TO BE VACATED:
A 30 foot wide Traffic Easement as shown on the Plat of EXTENSION OF K-MART
PLAZA, located[ in the Southeast'/4 of Section 23, Township 7 North, Range 69 West of
the 61h Principal Meridian, in the City of Fort Collins, County ofLarimer, State of
Colorado, said plat being recorded in Book 1462, at Paee 890 of the Larimer County
Records, the centerline of which is more particularly described as follows:
Commencing at the Southeast corner of Tract One of saiu EXTENSION OF K-MART
PLAZA; thence S 89°48'43" W along the South line of said Tract One 155.00 feet to the
TRUE POINT OF BEGINNING; thence N 00°11'l7" W 47.90 feet; thence 199.14 feet
along the arc of a curve to the left having a radius of 877.52 feet, a central angle of
13°00'09", and a long -chord which bears N 06041' 19" W 198.69 feet; thence 42.98 feet
along the are of a reverse curve to the right having a radius of 877.52 feet, a central angle
of 02°48'22", and a long -chord which bears N 11'47'09" W 42.97 feet, more or less, to a
point on the North line of said Tract One, said point being the POINT OF TERMINUS, and
which bears S 89°48'43" W 185.57 feet from the Northeast comer of said Tract One. The
sidelines of said easement are to be prolonged or foreshortened to intersect at the North and
South lines of said Tract One.
