Dear Sheri:
Plcasc see the attached Exhibits depicting easemcnts on Lot 6 of Block 14 in Fossil Lakc
Filing. We would like to vacate both the Utility and Drainage Easemcnt as well as the
Pedestrian Eascmcnt; both of which were granted on the recorded Plat. The following
describes the status:
I ) t 1& D Eascmcnt There are no utilities located along the cast side of this lot. We
arc not vacating the north 9' and the south 6' as to utility and drainage since there arc
Awl active casements here running cast and west. (See Exhibit)
3) Pedestrian Easemcnt This 12' casement has been moved onto Outlot H ol'the
Swift Addition to Fossil Lake PUD, according to Plat Notc #5, so it is no longer needed
on this residential lot. (Sec Exhibit)
Would you please begin the City vacation process for both of these easements? I f at all
possible, we would like to be on the 2/19/04 Planning K Zoning agenda, assuming that is
Who rcvicws it. I will submit the filing fees as soon as you advise me of the amount
required.

the City of Fort Collins has requested that the City vacate the access easement across the
eastern portion of said lots, which vacation is more particularly described in Exhibit "A"; and

Re: Fossil Lake P.U.D. First and Second Filings
Here's a copy of the Development Agreements for Fossil Lake P.U.D. First and
Second Filings -for your Department's records.
As you all know, Fossil Lake P.U.D. First and Second Filings are developments
that were approved in the County in the Fossil Creek Reservoir Area, and
subsequently annexed into the City of Fort Collins. The First Filing has had
many building permits and certificates of occupancy issued by the County
already. The Second Filing has been annexed prior to the issuance of any
building permits. Because the site specific development plan approvals were
obtained in the County, these developments are treated somewhat differently
than plans whose approvals were obtained under the City's development review
process. Based on the Intergovernmental Acireement between the City of Fort
Collins and Larimer County, t e Ity is bound to the terms of the Development �C
Agreement that was approved in the County upon annexation. This makes it very
important that any City employee who would potentially need to know what the
agreement specifically says has access to the language of the agreement itself.
To that end, here are copies of the Fossil Lake P.U.D. First and Second Filing
Development Agreements for your department's files. Please let those in your
department know how to find them if they would ever be involved in the review of
subsequent approvals within the area of Fossil Lake P.U.D. First and Second
Filings.

Filing, located east of Ziegler Road and South of Kechter Road. The Developer of this
subdivision wishes to vacate the 12 foot side lot pedestrian, utility and drainage easement, as
shown on the attached drawing. The Developer feels that this easement is no longer needed and
would like to vacate it.
Please sign and return any comments to Sheri L. Wamhoff in the Development Review Center by
February 9, 2004. If we do not hear from you by this date, we will assume you have no
objections to the proposed vacation. Please call Sheri at 221-6750 if you have any questions.
