WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
m A Planning and Zoning Board to accept dedication of certain easements by resolution or by
approval of replats containing notation of such dedication; and
rN WHEREAS, the Owner has requested that the City accept the
9 N dedication of three utility easements located on parcels 1 and 2 of Block 6, Fort Collins, also
4pbbs known as 223 Willow Street, more particularly described on Exhibit "A" and Exhibit "B"; and

N m WHEREAS, the dedication has been reviewed and approved by the pertinent City
° A 00O Departments, which departments report no objections to the dedication.

m NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort

n m Collins, that the dedication of three utility easements on parcels 1 and 2 of Block 6 Fort Collins,
x also known as 223 Willow Street, located at the southeast corner of Willow Street and College
Avenue, and more particularly described on Exhibit "A" and Exhibit "B", attached hereto and
incorporated herein by this reference, is hereby accepted.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the City
of Fort Collins held this 15th day of January A.D. 2004.

DEED OF DEDICATION FOR EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That the undersigned Wayne K. Schrader
and Schrader Oil Co., a Colorado Corporation, being the owner of that property described on Exhibit
"A", in consideration of Ten Dollars ($10.00) in hand paid, receipt of which is hereby acknowledged,
and other good and valuable consideration, does hereby dedicate, transfer and convey to the City of
Fort Collins, Colorado, a municipal corporation, for public use forever, a permanent easement for
installation of sewer and storm drainage improvements in the City of Fort Collins, County of
Larimer, State of Colorado, more particularly described on Exhibit "A" attached hereto and by this
reference made a part hereof.
It is understood by the undersigned that, by acceptance of this dedication, the City of Fort
Collins will accept the duty of maintenance of the underground pipe to be located in such easement
and shall repair any damage to the easement area caused by the City.

Colorado being located in the Northwest Quarter of Section 12, Township 7 North,
Range 69 West of the 6th Principal Meridian, City of Fort Collins, County of Larimer,
State of Colorado being more particularly described as follows:
Considering the west line of said Northwest Quarter as bearing North 000007 East and
with all bearings contained herein relative thereto:
Commencing at the West Quarter comer of said Section 12; thence, North 07°31'42"
