ORDINANCE NO. 13 , 1965,
ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE
MILLER LAYLAND FIRST ANNEXATION TO THE CITY OF FORT
COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURISDIC-
TION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN
ARTICLE 11 CHAPTER 139 COLORADO REVISED STATUTES, 1953
WHEREAS, heretofore a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 139, Colorado Revised Statutes, by the owners of more than:
fifty per cent (507.) of the area and who comprise the majority of landowners
residing in the area of land embraced in what is known as the Miller Layland
First Annexation to the City of Fort Collins, wherein and whereby said
petitioners petitioned the City of Fort Collins for annexation of all the
territory embraced in what is known as the Miller Layland First Annexation to
the City of Fort Collins, Colorado, comprising the lands shown in the plat
thereof attached to said petition and more particularly described as herein-
after set forth, and
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on January 14, 1965, and
WHEREAS, notice for hearing on the 25th day of February, 1965, on
an ordinance approving the annexation of said territory and including the same
within the limits and jurisdiction of the City of Fort Collins was duly
published as provided by law, and
WHEREAS, the Council of the City of Fort Collins has found that the
petition and the documents thereto attached meet the requirements of Article
11, Chapter 139, Colorado Revised Statutes, 1953, and
WHEREAS. no proceedings for an election to determine the question „i
annexation have been initiated by written counter-patitiou as provided by la:.
and no objection to annexation having been made;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS.
Section 1. That after due consideration of the petition for
annexation, the petition for the annexation of all the territory in what is
known and described as the Miller Layland First Annexation to the City of rot
Collins, Colorado, as shown by the plat thereof annexed to said petition: Kai
which is more particularly described as follows, to -wit:
A tract of land located in the Northeast quarter (NEk) of
Section 16, Township 7 North, Range 69 West of the 6th
Principal Meridian in the County of Larimer, State of
Colorado, contained within the boundaries as shown, and
considering the East line of said Northeast Quarter (NEk)
to bear South 00'32'00" East and with all bearings
contained herein relative thereto: Commencing at the
Northeast corner of said Section 16; thence South 00*32100"
East along the East line of said Section 16, 2,600.00 feet;
thence N. 89°43'30" West 1,320.00 feet to the True Point
of Beginning; thence North 89°43'30" West 330.00 feet;
thence North 00°32'00" West 660.00 feet; thence South
89'43'30" East 330.00 feet; thence South 00`32'00" East'
660.00 feet to the True Point of Beginning;
be accepted and approved and that said territory be annexed and made a part
of the City of Fort Collins and be included within the limits and jurisdiction
of the City of Fort Collins as an "A" Residential District, and that the City
Clark be and he is hereby authorized and directed to prepare certified copier:
of this ordinance, to each of which shall be attached a plat of said Miller
Leyland First Annexation to the City of Fort Collins, Colorado, and shall file:
a copy thereof in the office of the Clark and Recorder of the County of
Larimer, and another copy thereof in the office of the Clark of the City of
Fort Collins, together with a certified copy of said petition, and another
copy of said petition and approving ordinance with the Secretary of State of
the State of Colorado,
Section 2. That in accepting and approving the plat of the Miller
Layland First Annexation to the City of Fort Collins, the City of Fort Collins
does not assume obligations respecting the construction of water mains, sewer
lines, gas mains, electric light lines or other services or utilities with
respect to service of said addition, except as may be required and provided
by the owners of the prpporty within the limits of said addition in compliance
with the terms and provisions of Chapter 15, Code of Ordinances of the City
of Fort Collins, Colorado, 1958, as amended, relating to local and public
improvements.
Introduced, considered favorably on first reading and ordered
published this 25th day of February, A. D. 1965, and to be presented ios
final passage on the 18th day of March, A. D. 1965.
