WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate certain utility, drainage and access easements and portions of Southridge Greens Boulevard in Fairway II at Southridge Greens, P.U.D. set forth in more particular below; and WHEREAS, the amendment of Fairway II and the platting of "The Front Nine" and Mail Creek Village have caused Southridge Greens Boulevard alignment to be moved slightly; and WHEREAS, no utilities nor other construction of a permanent nature has been established in any of the areas to be vacated; and WHEREAS, the required easements and right-of-way are dedicated by the recording of the amended plat for Fairway II, the Front Nine plat and Mail Creek Village plat; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that those certain utility, drainage and access easements and portions of Southridge Greens Boulevard in Fairway II at Southridge Greens, P.U.D., set forth in more particular by Exhibit A attached hereto and in- corporated herein by this reference, be, and the same hereby are, vacated, abated and abolished. ENDATION: Staff recommends adoption of this Ordinance on Second Reading. KGROUND SUMMARY' This Ordinance was adopted unanimously on December 20. The developer of Southridge Greens P.U.D. has amended "Fairway II" and has also platted "The Front Nine" and Mail Creek Village, which caused the Southridge Greens Boulevard alignment to be moved slightly. This, in turn requires portions of Southridge Greens Boulevard as well as portions of drainage, access and utility easements to be vacated. MMENDATION: Staff recommends adoption of this Ordinance on First Reading. BACKGROUND SUMMARY' The developer of Southridge Greens P.U.D. has ammended "Fairway II" and has also platted "The Front Nine" and Mail Creek Village of which have caused Southridge Greens Boulevard alignment to be moved slightly. This, in turn requires portions of Southridge Greens Boulevard as well as portions of Drainage, Access and Utility Easements to be vacated. The required Easements and Right of Way are dedicated by the Recording of the amended plat for Fairway II (approved by Planning and Zoning November 21, 1983) and the Front Nine Plat (approved by Planning and Zoning July 25, 1983) and Mail Creek Village (approved by Planning and Zoning November 21, 1983). The attached Legal Descriptions vacate the unneeded and unused portions of the Right of Way for Southridge Greens Boulevard and Utility, Access and Drainage Easements. No Utilities nor other construction of a permanent nature had been per- formed in any of the areas to be vacated. Staff has reviewed these vacations against the replatted areas and the new plats and finds no problems. Therefore, Staff recommends adoption of this Ordinance on First Reading.
