ORDINANCE NO. 92, 1996
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING THE RIGHT-OF-WAY FOR SHARP POINT DRIVE
NORTH OF PROSPECT ROAD AS DEDICATED WITH
THE SEVEN LAKES BUSINESS PARK PUD
P AND RETAINING THE SAME FOR UTILITY,
PUBLIC ACCESS, AND DRAINAGE EASEMENT PURPOSES
WHEREAS, the Owner and Developer of the Neenan Office Building H Minor Subdivision
has requested the vacation of the right-of-way for Sharp Point Drive north of Prospect Road as
s dedicated with the plat entitled "Seven Lakes Business Park PUD" and more particularly described
below; and

WHEREAS, at the time said plat was recorded, Sharp Point Drive was planned to be

extended to the north of Prospect Road as a local public street to serve the adjacent properties; and

WHEREAS, all adjacent property owners which were to be served by Sharp Point Drive
north of Prospect Road have agreed that they can be adequately served and accessed by a privately
" owned driveway at the same location rather than the public street heretofore dedicated to the City
so long as public access is allowed to adjacent properties; and
WHEREAS, all adjacent property owners have executed a private access, utility, and
maintenance agreement for said driveway; and
WHEREAS, the driveway will serve the same purpose that the local public street extension
of Sharp Point Drive north of Prospect Road would have served as originally planned with the Seven
Lakes Business Park PUD; and
z WHEREAS, the Sharp Point Drive right-of-way proposed for vacation will be retained for

utility, public access, and drainage easement purposes; and
WHEREAS, all public and private utility agencies and the Poudre Fire Authority have been
�r r notified of the proposed vacation and report no objection; and

WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
r injured by the vacation of said right-of-way.

,Y NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
F COLLINS that the right-of-way for Sharp Point Drive north of Prospect Road dedicated upon the
plat entitled "Seven Lakes Business Park PUD" and more particularly described as follows, to wit:
That portion of land located in the Southwest Quarter of Section 17, Township 7 North,
Range 68 West of the 6th P.M., City of Fort Collins, County of Larimer, State of Colorado
described as follows:
Commencing at the South 1/4 Corner of said Section 17; thence N 00'01' 10" E along the
�- East line of said Southwest 1 /4, a distance of 55.00 feet to a point on the North right-of-way
line of Prospect Road, the POINT OF BEGINNING; thence continuing along said East line
N 00°0 VI 0" E, a distance of 492.23 feet; thence N 84°49'00" W, a distance of 27.11 feet to
the Northeast corner of the Seven Lakes PUD Phase II Subdivision; thence along said
Subdivision's East line the following six courses: S 00°01'10" W, a distance of 175.41 feet;
thence along the arc of a 210.00 foot radius curve to the right, the long chord of which bears
S 0601601 W 45.71 feet, a distance of 45.80 feet; thence S 12°30'51" W a distance of
100.00 feet; thence along the arc of a 270.00 foot radius curve to the left, the long chord of
which bears S 06° 16'01" W 58.76 feet, a distance of 58.88 feet; thence S 00'01'10" W, a
distance of 100.00 feet; thence along the arc of a 15.00 foot radius curve to the right, the long
chord of which bears S 475142" W 22.24 feet, a distance of 25.05 feet to a point on the
north right-of-way line of Prospect Road; thence S 84' 17'45" E along said right-of-way, a
distance of 21.21 feet; thence continuing along said right-of-way S 89' 12'31" E a distance
of 55.39 feet to the POINT OF BEGINNING.
be, and the same hereby is, vacated, abated, and abolished; reserving, however, an easement in favor
of the City of Fort Collins over, under, across and through said property for utility and drainage
purposes and for public ingress and egress.
