WHEREAS, the plat of Rigden Farm, Filing One included dedication to the public of a

right-of-way which included dedication of certain rights -of -way for future street extensions; and

WHEREAS, the Administrative Hearing Officer is considering an application for
approval of a project development plan (PDP) for a project entitled "Rigden Farm, Filing Six",

which PDP plan plats property abutting said right-of-way; and

WHEREAS, the approval of the Rigden Farm, Filing Six necessitates the vacation of two
portions of the original right-of-way dedicated on the plat of Rigden Farm, Filing One which

portions are more particularly described on Exhibits "A" and `B", attached hereto and

incorporated herein by this reference; and

WHEREAS, said portions of right-of-way are no longer necessary or desirable to retain

for street purposes due to the approval of Rigden Farm, Filing Six which does not extend said

street stubs into the site; and

WHEREAS, pertinent City agencies and private utility companies have been contacted

and reported no objection to the proposed vacation, provided that utility and drainage easements
be reserved unto the City; and
WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that the portions of street right-of-way, more particularly described on Exhibits o 0
"A" and "B", arc hereby vacated, abated and abolished, reserving the same unto the City as
utility and drainage easements.
Introduced and considered favorably on first reading and ordered published this 18th day
of December, A.D. 2001, and to be presented for final passage on the 15th day of January, A.D.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF RIGHT-OF-WAY AS DEDICATED ON
THE PLAT OF RIGDEN FARM, FILING ONE
WHEREAS, the plat of Rigden Farm, Filing One included dedication to thepublic of certain
rights -of -way for future street extensions; and
WHEREAS, the Administrative Hearing Officer approved a project development plan (PDP)
for a project entitled "Rigden Farm, Ninth Filing Parkside Commons", which plan plats property
abutting said right-of-way; and
WHEREAS, the approval of the Rigden Farm, Ninth Filing Parkside Commons PDP
necessitates the vacation of a portion of the original right-of-way dedicated on the plat of Rigden
Farm, Filing One which portion is more particularly described on Exhibit "A", attached hereto and
incorporated herein by this reference; and
WHEREAS, said portion of right-of-way is no longer necessary or desirable to retain for
street purposes due to the approval ofthe Rigden Farm, Ninth Filing Parkside Commons PDP which
does not extend said street stub into the site; and
WHEREAS, pertinent City agencies and private utility companies have been contacted and
reported no objection to the proposed vacation, provided that utility easement be reserved unto the
City; and
WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT

Attached for your review and comment is an exhibit showing two portions of right-of-way
proposed for vacation within the plat of Rigden Farm Filing One, located at the southeast corner
of Timberline Road and Drake Road. As a part of Rigden Farm Filing One it was anticipated
that Custer Road would extend easterly beyond Chase Drive and that an unamed street would
extend easterly beyond Chase Drive between Custer Drive and Topeka Lane. Street stubs for
both of these anticipated streets were platted with Rigden Farm Filing One. With the submittal
of Rigden Farm Filing Six these streets are now not proposed to be extended. Therefore the
Developer has requested that the street stubs be vacated.
Both street stubs were built, but with the vacation of the row the street stubs would be removed,
and curb, gutter and sidewalk would be extended across where the street intersection had been.
The utility plans for this had been routed last month. If you need another set to review, please let
me know.
The area within the right-of-way proposed to be vacated will be retained as utility and drainage
easements to accommodate any and all utilities that may exist within these areas.
Please sign and return any comments to Sheri Wamhoff in the Development Review Center by
December 10, 2001. If we do not hear from you by this date, we will assume you have no

injured by the vacation of said street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portion of street right-of-way, more particularly described on Exhibit "A", is
hereby vacated, abated and abolished, reserving the same unto the City as a utility easement.
Introduced and considered favorably on first reading and ordered published this 16th day of
