ORDINANCE NO. 201, 1998
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF THE RIGHTS -OF -WAY
FOR PLUM STREET AND ORCHARD PLACE AS DEDICATED ON
THE PONDEROSA PARK P.U.D., MILLER LAYLAND SUBDIVISION,
AND SKYLINE MOBILE HOME PARK PLATS
WHEREAS, the plats for the Ponderosa Park P.U.D., Miller-Layland Subdivision, and
Skyline Mobile Home Park dedicated to the public certain rights -of -way for Orchard Place, and
Miller-Layland Subdivision dedicated to the public certain rights -of -way for Plum Street; and
WHEREAS, the Planning and Zoning Board has approved a final plan for a project entitled
"Jefferson Commons P.U.D. 2nd Filing", which prevents the extension of said rights -of -way to the
east; and
WHEREAS, the approval of the Jefferson Commons P.U.D., 2nd Filing, requires the
vacation of the rights -of -way dedicated for Plum Street and Orchard Place more particularly
described on Exhibits "A", "B", "C", and "D" attached hereto and incorporated herein by this
reference; and
WHEREAS, said portions of Plum Street and Orchard Place rights -of -way are no longer
necessary or desirable to retain for street purposes; and
WHEREAS, pertinent City agencies and private utility companies have been contacted and
reported no objection to the proposed vacation, provided that an easement for utility and drainage
be reserved unto the City; and
WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said street rights -of -way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portions of street rights -of -way, more particularly described on Exhibits "A", `B",
"C" and "D", are hereby vacated, abated and abolished, reserving the same unto the City as an
easement for utility and drainage purposes.

A parcel of land situate in the Northeast quarter of Section 16, Township 7 North, Range 69
West, of the 6th P.M., City of Fort Collins, County of Larimer, State of Colorado, being in the
Miller - Layland, a subdivision on record in the office of the Clerk and Recorder of said County,
and being more particularly described as follows:
Considering the East line of said Miller - Layland Subdivision as bearing North 00032'00" West,
and with all bearings contained herein relative thereto:
Commencing at the Southeast corner of Lot 27, of the said Miller - Layland Subdivision, said
point also being the TRUE POINT OF BEGINNING of this description; thence along the South
line of said Lot 27, North 89043'30" West 120.22 feet; thence 23.35 feet along the arc of a curve
concave to the Northeast, having a radius of 15.00 feet, a central angle of 89011'30", and the
