ORDINANCE NO.115 , 1992
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF MITCHELL DRIVE
RIGHT-OF-WAY
WHEREAS, the Planning and Zoning Board of the City of Fort Collins approved
the P.U.D. and plat entitled "Toys 'R' Us/ Western Auto P.U.D."; and
WHEREAS, the approval of said P.U.D. has made it necessary and desirable
to vacate a portion of Mitchell Drive right-of-way more particularly described
on Exhibit "A", attached hereto and incorporated herewith; and
WHEREAS, City agencies and private utilities have been notified of the
recording of the "Toys 'R' Us/ Western Auto P.U.D." site plan and plat and report
no objections to the proposed vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the portion of Mitchell Drive street right-of-way more particularly
described on Exhibit "A," attached hereto and incorporated herewith, be, and the
same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered published
this 3rd day of November, A.D. 1992, and to be presented for final passage on the
17th day of November, A.D. 1992.

distance of 25.56 feet; thence along the arc of a curve to the left
having a radius of 267.00 feet, a central angle of 230 38' 00" and
whose long chord bears NORTH 100 41' 00" EAST a distance of 109.35__
