OF THE CITY COUNCIL OF THE CITY OF FORT COLLINS, AU'IIIOIiIG-
ING THE ADOPTION OF AN OE,DINA SCE VACATING A PORTION OF
MAGNOLIA STREET IN THE CITY OF 1ORT COLLINS.
WHEREAS, On the 12th day of May, 1944, a
Resolution was duly adopted by the City Council of the City
�of Fort Collins annexing to the City all the territory
embraced in what is known and described as the East half of
Block 9, Scott Sherwood Addition, as shown by the plat there-
of submitted with the petition for the annexation of said
territory; and
IIHT2'EAS, The South 30 feet of said territory
formed a portion of Magnolia Street; and
WHEREAS, Since the annexation, said South 30
feet is no longer required for street purposes and has been
abandoned; and
WHEREAS, The title to the lots adjoining; said
South 30 feet stands of record in the name of home Owners'
Loan Corporation, but the said lots, being described as
Lots 1 and 2 in Block 9, Scott -Sherwood Addition to the City
of Fort Collins, are being purchased under contract from -Hume
Owners' Loan Corporation by Jesse J. Benton and ithel M.
Benton; and
1,6'IIEREAS, The said Jesse J. wenton and Ethel K.
Benton have petitioned the City Council to vacate by ordinance
said abandoned portion of Magnolia Street, which is more par-
ticularly described as follows, to -wit:
reginning at the Southeast corner of the East half of
Block 9 of Scott -Sherwood Addition to the City of 'Fort
Collins, according to the plat filed in the office of
the County Clerk on Lay 129 1944, and recorded in Book
5 on page 39A; thence Forth 30 feet; thence ';lest 190
feet; thence South 30 feet; thence Vast 190 feet to
the point of beginning, containing 0.13 acres, more
or less.

IHiAEAS, The said petitioners have offered
to pay to the City of Port Collins the sum of w150.u0 as
consideration for the vacation of said portion of the street
and the City Council is of the opinion that it would be to
the best interests of the City that said offer be accepted
and that an ordinance be adopted vacating said portion of
Magnolia Street.

accepted and that an ordinance be adopted vacating the follos-
ing described portion of L.'agnolia Street in the City of b'ort
Collins, Colorado, to -wit:
Beginning at the Southeast corner of the East Half
of Block 9 of Scott -Sherwood Addition to the City
of Fort Collins, according to the plat filed in the
office of the County Clerk on hay 12, 1944, and
recorded in Book 5 on page 39A; thence North 30 feeC;
thence West 190 feet; thence South 30 feet; thence
East 190 feet to the point of beginning, containing
0.13 acres, more or less.
Passed and adopted at a regular meeting of the
City Council held this 16th day of Yebruary, A. D. 1945.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLL112:
Section 1. That the following described per-
tion of Magnolia Street in the City of Fort Collins, Colorado,
to -wit:
Beginning at the Southeast corner of the East Half
of Block 9 of Scott -Sherwood Addition to the City
of Fort Collins, according to the plat filed in the
office of the County Clerk on Yay 12, 1944, and
recorded in Book 5 on page 39A; thence North 30 feet;
thence West 190 feet; thence South 30 feet; thence
East 190 feet to the point of beginning;, containing;
0.13 acres, more or less;
be and the same is hereby abandoned and vacated, and hence-
forth the same shall be treated as a part of the lot abutting
the same on the North, and all right, title and interest of
the City of Fort Collins therein shall be and hereby becomes
vested in the owners of the lot abutting the same on the
North, as provided by law.
Section 2. In the opinion of the City Council
an emergency exists forthe preservation of the public health,
peace and safety and this Ordinance shall take effect upon
its passage under and by virtue of the authority contained
in Sections 6 and % of Article IV of the City Charter.
Introduced, read at length and adopted by the
unanimous vote of all members of the City Council, at a re„ular
meeting of the City Council, held this 16th day of February,
A. D. 1945.

I, MILES F. HOUSE, City Clerk of the City of
Fort Collins, do hereby certify and declare that the afore-
said Ordinance, consisting, of two Sections, was duly
proposed and read at length at a regular meeting of the
City Council, held on the 16th day of February, A. D. i945,
and was duly adopted and ordered published in the fort
Collins I'sxpress-Courier, a daily newspaper and official
newspaper of the City of Fort Collins, by the unanimous vote
of all members of the City Council, as an Emergency Ordinance,
in accordance with the provisions of Sections 6 and 7 of
Article IV of the City Charter; and thereafter and on, to -gait:
the 20th day of February, A. D. 1945, said Ordinance La. 2
was duly published in the Fort Collins Lxpress-Courier, a
daily newspaper published in the City of r'ort Collins, Colo-
rado.
