VACATING THE RIGHT-OF-WAY FOR
DAEMIAN DRIVE AS DEDICATED WITH
THE PLAT OF INDIAN HILLS VILLAGE P.U.D.

w WHEREAS, on July 7, 1994 the Planning and Zoning Board approved the plat entitled

"Indian Hills Village P.U.D."(the P.U.D.); and
WHEREAS„ on May 22, 1995 the Planning and Zoning Board approved a replat of a portion
of said P.U.D. entitled "Replat of Lots 35 - 43 and Tract B of Indian Hills Village P.U.D."(the
Replat); and

WHEREAS, the Replat includes the area originally dedicated as public street right-of-way
for Daemian Drive; and

WHEREAS, Daemian Drive has never been constructed and the right-of-way for said street,
more particularly described below and dedicated with the plat of the P.U.D., is no longer necessary
nor desirable to retain for public street purposes; and
" WHEREAS, the Owner has requested the vacation of said right-of-way in order to record the
Replat and

WHEREAS, all public and private utility agencies and the Poudre Fire Authority have been
notified of the proposed vacation and report no objection; and

WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the ;right-of-way for Daemian Drive dedicated upon the plat entitled "Indian Hills
Village P.U.D." and more particularly described as follows, to wit:
A parcel of land situate in Indian Hills Village P.U.D., being in the Northwest quarter of
" Section 24, Township 7 North, Range 69 West, of the 6th P.M., City of Fort Collins, County
of Larimer, State of Colorado, being more particularly described as follows:
Considering the West line of said Indian Hills Village P.U.D., as bearing
North 00"0730" East and with all bearings contained herein relative thereto:
Commencing at the Northwest comer of Lot 40, of said Indian Hills Village
P.U.D.; thence along the North line of said Lot 40, South 89052'30" East 4.00
feet to the TRUE POINT OF BEGINNING of this description; thence
continuing along the North line of said Lot 40 and the North line of Lot 39

and Lot 38 of said Indian Hills Village P.U.D., South 89 °52'30" East 101.49
feet; thence continuing along the North line of said Lot 38, 27.05 feet along
the arc of a curve concave to the Southwest, having a radius of 15.00 feet; a
central angle of 103 ° 18'32", and the long chord which bears South 38' 13' 12"
East 23.53 feet to a point on the West right-of-way of Indian Hills Circle;
thence along said West right-of-way, 65.30 feet along the are of a non -tangent
curve concave to the East, having a radius of 874.50 feet, a central angle of
04' 16'41 ", and the long chord which bears North 15°34'22" East 65.28 feet
to a point on the South line of Lot 43 of said Indian Hills Village P.U.D.,
thence along said South line 18.96 feet along the arc of a non -tangent curve
concave to the Northwest, having a radius of 15.00 feet, a central angle of
72°24'44", and the long chord which bears South 53°55'08" West 17.72 feet
to a point of tangency; thence along the South line of said Lot 43 and Lot 42
and Lot 41 and its prolongation, North 89°52'30" West 119.18 feet to a point
on the East line of Tract B of said Indian Hills Village P.U.D., thence along
said East line South 00007'30" West 34.00 feet to the point of beginning
