FFr'- ;.C)r) ORDINANCE NO. 149, 1985 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING THE ROAD RIGHT-OF-WAY OF COUNTY ROAD 13 THROUGH A PORTION OF THE SOUTHEAST QUARTER OF SECTION 36, RANGE 69 WEST OF THE 6TH P.M., CITY OF FORT COLLINS, COLORADO WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate the road right-of-way of County Road 13 north of the Lemay Avenue Extension around the east side of Warren Lake, set forth in more particular below; and WHEREAS, the subject property has been platted as Harbor Walk Estates, which plat has been approved by the Planning & Zoning Board on March 25, 1985: and WHEREAS, there is no future need for County Road 13 in this parcel; and WHEREAS, all utilities have been contacted and have indicated no problems with this vacation; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the road right-of-way of County Road 13 (also known as County Road 45) located north of the Lemay Avenue Extension around the east side of Warren Lake, set out more particularly as follows, to wit: A strip of land in the Southwest Quarter of Section 31, Township 7 North, Range 68 West of the Sixth Principal Meridian, Larimer County, Colorado, being described as follows: Beginning at the Southwest corner of said Section 31 and considering the West line of the Southwest Quarter of said Section 31 to bear North 00003'00" East, with all bearings contained herein, relative thereto; thence Northerly along said East line, North 00°03'00" East, 1804.82 feet to the Northerly right-of-way line of Breakwater Drive as dedicated in Book 2026, Page 806 of the Larimer County records, and the True Point of Beginning of this description; thence continuing along said West line North 000 03'00" East, 296.32 feet; thence departing said West line North 58°40'15" East, 502.88 feet; thence North 45°31'11" East, 262.96 feet; thence North 35°34'17" East, 120.94 feet to the South line and its Westerly extension of that parcel described in Book 1314, Page 524 of the Larimer County records; thence Easterly along said South line and its extension South 89°40'46" East, 73.47 feet to the Southeasterly line of Harbor Walk Annexation to the City of Fort Collins, according to the recorded plat thereof; thence Southwesterly along said Southeasterly line South 35°34'17" West, 168.57 feet; thence South 45°31'17" West, 275.10 feet; thence South 58°40'15" West, 511.25 feet; thence South 00°03'UO" West, 246.85 feet to the Northerly right-of-way line of S6.00 said Breakwater Drive; thence along said Northerly right-of-way line alonyi a non -tangent curve to the left having a delta of 09°32'56", a radius of 180.86 feet, an arc of 30.14 feet and a long chord which bears North 85°10'35" West, 30.11 feet to the true point of beginning of this description. The above described right-of-way vacation contains 1.56 acres, more or less, excepting therefrom any portion lying within the right-of-way of Lemay Avenue as platted in Golden Meadows Second Filing according to the recorded plat thereof, and also excepting the easements and rights -of -way as recorded on the plat of Harbor Walk Estates, a P.U.D., as recorded with the Larimer County Clerk and Recorder on October 25, 1985. be, and the same hereby is, vacated, abated and abolished. Introduced, considered favorably on first reading, and ordered published this 3rd day of December, A.D. 1985, and to be presented for final passage on the 17th day of December, A.D. 1985.
