','JMHEAS, the ovniers of Lots 2, 31 4, and 5, of Block 1, Kenwood
Heights Addition to the City of Fort Collins, Colorado, have petitioned the
Council of the City of Fort Collins to cause the vacation of the following
described alley described as follows, to•-w.it:
Commencing at the Southeast corner of Lot 2, Block 1, Kenwood
Heights Addition to the City of Fort Collins, Colorado; thence
westerly along the South lot lire of Lot 2 to the Southwest
corner of said Lot 2; thence South parallel with s1,ayne Street
to the North line of Lot 5 of said Block 1; thence East along
the North lot line of Lots 5, 4, and 3 of said Block 1 to the
Northeast corner of said Lot 3; thence North to point of
beginning;
AP1D, i;HEREAS, said alleyway sought to be vacated has never been used
as an alleywa; and, is not now and never has been a travelled portion of any
alley or street;
AND, '.1M REAS, the Council of the City of Fort Collins is of the opinion
that it would. be to the best interests of the City of Fort Collins to vacate the
alleyway as above described;
BE IT ORDA11LD BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the alleyway between Lot 2 on the North and Lots 3, 4,
and 5 on the SoutL, Block 1, Kenwood Heights Addition to the City of Fort Collins,
more particularly described as follows, to ".it:

Heights Addition to the City of Fort Collins, Colorado; thence

ORDINANCE N0. 11 , 1953
BEING AN EMERGENCY ORDINANCE VACATING A PORTION OF THE ALLEY IN BLOCK 3,
KENWOOD HEIGHTS ADDITION TO THE CITY OF FORT COLLINS, COLORADO.
WHEREAS, the plat of Block 3, Kenwood Heights Addition to the City
of Fort Collins, Colorado, shows an alley opening on Woodford Avenue, and
WHEREAS, a portion of said alley has never been opened to the public
and has never been used as an alley, and for many years last past has been
abandoned and has been closed to public travel, which said portion of said
alley is more particularly described as follows, to -.wit:
The alley lying between Lots 1 and 2 and Lots 10 and 11 in
Block 3 of the Kenwood Heights Addition to the City of Fort
Collins, Colorado, and more particularly described as being
contained within the following described boundary lines, to.,
wit: Beginning at the Northwest corner of Lot 1 and running
thence South 101.8 feet to the Southwest corner of Lot 2,
thence West 20 feet to the Southeast corner of Lot 10, thence
North 101.8 feet to the Northeast corner of Lot 11, and thence
East 20 feet to the point of beginning;
AND, WHEREAS, the owners of the lots abutting on said portion of
said alley have petitioned the City Council to cause the same to be vacated,
and
WHEREAS, the City Council is of the opinion that it will be to the
best interests of the City to vacate said portion of said alley,
COLLINS:
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
Section 1. That that portion of the alley in Block 3, Kenwood Heights
Addition to the City of Fort Collins, Colorado, more particularly described
as follows, to —wit:

The alley lying between Lots 1 and 2 and Lots 10 and 11 in
Block 3 of the Kenwood Heights Addition to the City of Fott
Collins, Colorado, and more particularly described as being
contained within the following described boundary lines, to..
wit: Beginning at the Northwest corner of Lot 1 and running
thence South 101.8 feet to the Southwest corner of Lot 21
thence West 20 feet to the Southeast corner of Lot 10, thence
North 101.8 feet to the Northeast corner of Lot 11, and thence
East 20 feet to the point of beginning;
be and the same is hereby vacated, abolished and abandoned.
Section 2. That rights of way or easements are hereby reserved for
the continued use of existing sewer, gas, water or similar pipelines and
appurtenances, and for electric, telephone and similar lines and appurtenances.
Section 3. In the opinion of the City Council an emergency exists
for the preservation of the public health, peace and safety, and this ordinance
shall take effect upon its passage under and by virtue of the authority
contained in Sections 6 and 7 of Article IV of the City Charter.
Introduced, read at length, and adopted by the unanimous vote of all
members of the City Council, at a regular meeting held this 24th day of July,
A. D. 1953.
