RESOLUTION
OF THE: CITY COUNCIL OF THE CITY OF FORT COLLINS IN THE
MATTER OF THIS PETITION OF ROY WILLIAMS AND VIRA 1.1.
WILLIAIM , FOR THE RFLEASE AND DISCHARGE OF ALL CLAIMS
OF THE CITY OF FORT COLLINS I.14 AND TO A STRIP OF LAND
BO x 1.90 FEET OFF THE: WEST SIDE OF LOT 8, IN BLOCK 2,
IN THE; CITY OF FORT COLLINS, COLORADO.
WHEREAS, It appears from an original and a
suppleinental petition of Roy Williams and Vira 1. Williams,
filed, respectively, February 4th and February llth, lzi22,
that heretofore ai-d on towit: June lo, 1892, one J. E. Cowan
conveyed to Charles B. Andrews the northeast half of Lots
6 and 8, Block 2, in the City of Fort Collins, and in and
by uhe same conveyance excepted a strip of land 20 x 190
feet off the west side of Lot 8, which was attempted to be
conveyed to the City of Fort Collins, to be held as a public
alley, and thereafter said reservation was reserved in a
deed of conveyance, bearing date December 22, 1892, execu-
ted by Charles B. Andrews; and
WHEREAS, On the 6th day of August, 1921,
upon the complaint of the owner of the north hall' of Lots
2, 4, 6, and 8, Block 2, that said strip of land had been
opened and used as an alley and that at said time was being
obstructed so as to prevent its use by the general public,
and in recognition of said complaint The City Council duly
passed and adopted a resolution, authorizing and directing
the Counnissioner of Works to open said alley for public use
and remove the obstructions therein; and

WHEREAS, Since the adoption of said resolu-
tion and on, towit: the 4th day of February and the llth
day of February, 1922, original and supplemental petitions
were filed with the City Council by Roy Williams and Vira il.
Williams as the owners of the southwest half of Lot 3, Bloom
2, which seriously question the legality of the action of
the City Council ordering said strip of land opened as an
alley;, and tending to show that the City of Fort Collins has
no right, title and interest in said strip of land as a pub-
lic alley, and said petitions were duly referred to the Com-
missioner of Works and the City Attorney for investigation
and report; and
WHEREAS, The Cormaissioner of Works and City
Attorney have this day reported, recommending that the City
Council adopt a resolution rescinding the said resolution
of August 6, 1921, ordering said alley opened, and disclaim-
ing any right, title and interest in said strip of ground on
the pert of the City of Fo,.t Collins, for the purpose of
quieting the title of the owners of said southwest half of
Lot 6, Block 2, in the City of Fort Collins; therefore
BE IT RESOLVED By the City Council of the
City of Fort Collins that the City of Fort Collins hereby
renounces and disclaims any right, title or interest in and
to said strip of land 20 x 180 feet off the west side of
said Lot d, Block 2, in the City of Fort Collins, hereto-
fore attempted to be dedicated and opened as a public alley,
and this resolution shall be taken as a complete release,
discharge and disclaimer of any and all right, title or in-
terest arising out of said deed or deeds of conveyance of
J. E. Cowan and Charles B. Andrews, respecting said strip
of land 20 x 1J0 feet off the west side of Lot 8, Block 2,
in the City of Fort Collins.
Passed and adopted at a regular meeting of
the City Council this 18th day of February, A.D. 1822.
