OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A DRAINAGE EASEMENT
ON THE FORT COLLINS SECOND AND HARMONY P.U.D.
AT THE VILLAGES AT HARMONY WEST
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of the Fort Collins Second and Harmony
P.U.D. at the Villages at Harmony West, City of Fort Collins,
Larimer Country, Colorado, has requested that the City vacate a
drainage easement located on said P.U.D.; and
WHEREAS, said portion of said drainage easement is no longer
necessary to retain and the vacation request has been reviewed and
approved by the pertinent City and private utilities, and they have
no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the drainage easement more
particularly described on Exhibit "A", attached hereto and
incorporated herewith, be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 22nd day of

LEGAL DESCRIPTION for existing easement to be vacated.
All of the westerly seventy foot drainage easement as shown on the plat of FORT COLLINS
SECOND AND HARMONY P.U.U. and recorded at reception no. 22332153, and no. 85018838,
a part of the SOUTHEAST 114, SECTION 34, TOWNSt111) 7 NORTH, RANGE 69 WEST OF
6th P.M., CITY 01; FORT COLLINS, STATE OF COLORADO, more particularly described as
follows:
Considering the south line of said southeast 1/4 as bearing SOUTH 89056'16" WEST and with
all bearings contained herein relative thereto.
Commencing at the southeast corner of said section 34; thence along said south line of the
southeast one -quarter of section 34, SOUTH 89°56'16" WEST, a distance of 1755.54 feet and
along the existing south right-of-way fine of harmony Road according to said plat ; Thence
leaving said south line of the southeast one -quarter of section 34 NORTH 00°03'44" WEST, a
distance of 60.00 feet to the TRUE POINT OF BEGINNING; Thence along the north right-of-
way line of said Harmony Road NORTH 89°56'16" EAST, a distance of 50.00 feet; Thence
leaving said north right-of-way line of Harmony Road NORTH 00°03'44" WEST, a distance of
630.00 feet; to the north line of LOT 3, FORT COLLINS SECOND AND HARMONY P.U.D.
Thence SOUTH 89°56' 16" WEST, a distance of 70.00 feet along the said north line of of LOT
3, Io a point on the east right-of-way line of Regency Drive, said point also being the northwest
corner of said LOT 3; 'thence SOUTH 00003'44" EAST, a distance of 610.00 feet along the
existing east right-of-way line of said Regency Drive; Thence along a tangent curve to the left
31.42 feet, said curve having a radius of 20.00 feet, a long chord which bears NORTH 45°03'44"
