HomeMy WebLinkAboutSPRING COURT - Filed OA-OTHER AGREEMENTS - 2004-02-23ADDENDUM THIS ADDENDUM to that Development Agreement dated the off.%fh day of ApnI , 1984 ("Development Agreement") by and between THE CITY OF FORT COLLINS, COLORADO, a municipal corporation ("City"), and JAMES JOHNS014 and JAMES JOHNSON & SON, INC., a joint venture ("Devel_oper"), is hereby entered into by the same parties as of the date of the execution hereof. WITNESSETH: WHEREAS,, the parties hereto have entered into a standard development agreement which agreement does not address the peculiarities of certain streets within the property subject to that development agreement, and; WHEREAS, the parties desire to fully set forth and clarify their intentions, agreements and responsibilities with respect to the development of the subject property. NOW, THEREFORE, in consideration of the premises and the terms and conditions acknowledged by the parties hereto, the following agreements are hereby added to and shall become a part of the Development Agreement: The existing condition of the subject property and the streets within such property, specifically Johnson Drive and portions of Spring Court -Arthur Drive, is such that it is not reasonable to require the developer to install, con- struct and complete such streets in accordance with the standard specifications of the City. These streets shall be constructed in complete accordance with the utility drawings and plans that heretofore have been submitted to and approved by the parties, notwithstanding any portion of the Development Agreement to the contrary.
