0 = ON PROPERTY LOCATED ON HORSETOOTH ROAD
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins authorizes the
' Director of Community Planning and Environmental Services to vacate certain easements by
0 resolution or by approval of replats containing notation of such dedication; and
0 WHEREAS, the Owner has requested that the City vacate a portion of a utility easement
0 located along Horsetooth Road on the Volunteers of America PDP, more particularly described
on Exhibits "A" and "B"; and
N w WHEREAS, the vacation has been reviewed and approved by the pertinent City
A o Departments, which departments report no objections to the vacation.

N N p o NOW, THEREFORE, be it resolved by the Director of Community Planning and
a rEnvironmental Services of the City of Fort Collins, that a portion of a utility easement on the
Volunteers of America PDP, located on Horsetooth Road, which portion is more particularly
` described on Exhibits "A" and "B," attached hereto and incorporated herein by this reference, is
x hereby vacated.
Passed and adopted at an administrative hearing held by the Director of Current
Planning as the delegee of the Director of Community Planning and Environmental Services of
the City of Fort Collins this 3-µl day of January A.D. 2004.

Larimer County, Colorado, being more particularly described by the following boundary

Attached for your review and comments are a vacation request and sketch by the Applicant
showing the Volunteers of America Elderly Housing project located south of Horsetooth
Road, east of Taft Hill Road and west of Shields Street. A three foot wide portion of the
standard utility easement along Horsetooth is being proposed for vacation as shown in
attached Exhibit 'B'. The Applicant is requesting the easement vacation because they are
proposing a change in the irrigation lateral currently located in an easement between the
Horsetooth ROW and the utility easement and an additional 3' is needed for the
improvements. The; applicant is also proposing to dedicate another 3' of utility easement
south of the current utility easement, resulting in the standard 15' utility easement along
Horsetooth, but separated from the ROW by a 6' irrigation lateral easement as opposed to a
3' irrigation lateral easement as is currently approved.

Dear Ms. Moore,
As we have previously discussed on the phone, the Owner of the irrigation lateral which is
south most on the site adjacent to the West Horsetooth Road right-of-way wishes to revise
the irrigation lateral from a steel plate covered concrete channel to a piped system with
manhole type sumps.
He has requested this revision since he feels it will be easier for him to clean and maintain
this piped system rather that the concrete channeled system since the channel would achieve
depths of 4 to 4 /y' at certain locations and would be difficult to clean with a shovel. The
currently proposed system would provide invert elevations of the pipe above the bottom of
the manholes so that sediments and trash would drop out and could be cleaned out at those
locations. In order to accommodate this revised system, the current 3' wide irrigation lateral
easement would need to be increased to 6' in order to accommodate the diameter of the
manholes and not impinge upon the West iiorsetooth right-of-way or the adjacent utility
easement. We would therefore propose revising the irrigation lateral easement to 6' wide and
to realign the fifteen foot utility easement that runs parallel and south of the irrigation lateral
easement 3' further to the south. Attached is an Exhibit showing the proposed change to the
easements and also civil drawings showing the changes to the irrigation lateral system.
