RESOLUTION NO. PZ95-8
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A WATER LINE EASEMENT
LOCATED IN THE SOLAR RIDGE SUBDIVISION,
FIRST FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate
certain easements and rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of the Solar Ridge Subdivision has
requested the vacation of a City of Fort Collins water line
easement shown and more particularly described on the plat of
said Subdivision as "EXISTING 20' WATER LINE EASEMENT; and
WHEREAS, said easement is no longer necessary to retain
since the water line has been removed and relocated; and
WHEREAS, new easements and rights -of -way have been dedicated
to accommodate the new location of the water line; and
WHEREAS, the City Water and Wastewater Utility has reviewed
the request and reports no objection to the easement vacation as
requested; and
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that all of the 20 foot wide
water line easement in the Solar Ridge First Filing, located in
the East one-half of Section 4, Township 7 North, Range 69 West
of the 6th P.M., County of Larimer, State of Colorado, a plat
recorded in Larimer County records at Reception # 88039238, more
particularly described on said plat as "EXISTING 20' WATER LINE
EASEMENT" be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 24th day of
April, A.D. 1995.
