AMENDMENT AGREEMENT NO. I
THIS AMENDMENT AGREEMENT, made and entered into this � Zday of of
2001, by and between the CITY OF FORT COLLINS. COLORADO, a municipal corporation, ("Qity"),
U-S. Home Corporation, a Delaware Corporation, hereinafter referred to as the "Developer"; and Dalco,
LI.C, a Colorado limited liability company, hereinafter referred to as the "Owner", is an amendment to that
certain Development Agreement dated September 24, 1999 by and between the City, the Developer and the
Owner, hereinafter referred to as the "Development Agreement."
WHEREAS, the City and the Developer previously executed the Development Agreement; and
WHEREAS, the parties presently desire to modify the Development Agreement;
NOW, THEREFORE, in consideration of the promises of the parties hereto and other good and
valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties hereto
agree to amend theterms and conditions of the Development Agreement as follows:
A. Subheading 11 (Special Conditions) Paragraph C.7 shall be replaced with the following:
The on -site and off -site improvements to Trilby Road and the on -site improvements to Shields
Street, including related utility and storm drainage improvements, as shown on the final
approved documents, shall be completed prior to the issuance of more than 31 building
permits. The off -site improvements to Shields Street, including related utility and storm
drainage improvements, as shown on the final approved documents, shall be completed prior
to the issuance of more than 100 building permits.
B. All other terms and conditions of the Development Agreement shall remain unchanged and in full
force and effect, except as expressly amended in this Amendment Agreement No. 1.
