DEDICATION OF EASEMENT
FOR GOOD AND VALUABLE CONSIDERATION, the receipt and adequacy
of which are hereby confessed and acknowledged, the undersigned,
WINDTRAIL PARK CONDOMINIUM ASSOCIATION, a Colorado nonprofit
corporation ("the Grantor"), for itself and its successors and
assigns, hereby dedicates, grants, bargains, sells, conveys, and
confirms unto THE CITY OF FORT COLLINS, COLORADO, a municipal
corporation ("the City"), its successors and assigns, forever, an
exclusive, perpetual access and utility easement over, across, and
upon that portion of Open Space A, Windtrail Park P.U.D. which is
described on Exhibit "A" incorporated herein by reference ("the
Easement").
The City shall have the right, but not the obligation, to
construct, install, maintain, repair, replace, and improve curbs,
gutters, sidewalks, and a paved street within the Easement. The
City shall also have the right, but not the obligation, to
construct, install, maintain, repair, replace, and improve pipes,
conduits, wires, lines, and other utility systems and facilities
within the Easement.
IN WITNESS WHEREOF, the Grantor has executed this Dedication
of Easement this 22 _ day of February, 1999.
