OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF A STORM DRAINAGE EASEMENT,
PORTIONS OF A CONSTRUCTION EASEMENT,
AND PORTIONS OF A TEMPORARY ACCESS EASEMENT
DEDICATED TO THE CITY BY DEED AND
LOCATED ON THE PINECONE APARTMENTS P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of the Pinecone Apartments P.U.D. has
requested that the City vacate certain portions of a storm drainage
easement, portions of a construction easement, and portions of a
temporary access easement dedicated to the City by deed and more
particularly described on Exhibit"A" attached hereto and
incorporated herewith; and
WHEREAS, the easements are no longer necessary to retain and
the vacation request has been reviewed and approved by the
pertinent City and private utilities, and they have no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the portions of the storm
drainage easement, the portions of the construction easement, and
the portions of the temporary access easement on the Pinecone
Apartments, P.U.D. more particularly described on Exhibit "A",
attached hereto and incorporated herewith, be and are hereby
vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 15th day of
