AMENDMENT AGREEMENT NO.2
THIS AMENDMENT AGREEMENT, made and entered into this 11
day of ,, <'; �. of 199 '-S, by and between the CITY OF FORT COLLINS,
COLORADO; a municipal corporation, hereinafter referred to as the
"City" and MOUNTAIN RANGE BAPTIST CHURCH, hereinafter referred to
as the "Developer," is an amendment to that certain Development
Agreement dated the 16th of April, A.D. 1992, by and between the
City and the Developer "Development Agreement."
WHEREAS, the parties hereto previously executed the
Development Agreement; and,
WHEREAS, the parties subsequently on September 8, 1992,
executed an amendment to the Development Agreement (Amendment
No.l), not affected by this Amendment Agreement; and
WHEREAS, the parties are presently desirous of modifying the
Development Agreement;
NOW, THEREFORE, in consideration of the promises of the
parties hereto and other good and valuable consideration, the
receipt and adequacy of which is hereby acknowledged, the parties
agree as follows:
Subheading II. (Special Conditions), subparagraph D of the
Development Agreement shall be modified by adding the following:
3. The Developer shall complete the design and
construction of street and related improvements to widen Horsetooth
Road to arterial standards adjacent to this development prior to
the issuance of the first certificate of occupancy for Phase 2 of
this development. Completion of said design shall include the
review and approval by the City prior to the Developer beginning
construction of said improvements. Completion of the construction
of said improvements shall include the City's inspection and
acceptance of said improvements.
Except as herein modified, the Development Agreement shall
continue in full force and effect. This Agreement and the
Development Agreement constitute the entire understanding of the
parties.
IN WITNESS WHEREOF, the parties hereto have set their hands

THIS AMENDMENT AGREEMENT, made and entered into this

"City" and MOUNTAIN RANGE BAPTIST CHURCH, hereinafter referred to
as the "Developer," is an amendment to that certain Development

Development Agreement; and,
WHEREAS, the parties are presently desirous of modifying the
Development Agreement;

agree as follows:
Exhibit "B" is hereby replaced with the attached new Exhibit
"B."
Except as herein modified, the Development Agreement shall
continue in full force and effect. This Agreement and the
Development Agreement constitute the entire understanding of the
parties.
