BEING AN ORDINANCE VACATING A PEDESTRIAN
WALKWAY IN THE MILLER BROTHERS SOUTH
FOOTHILLS SUBDIVISION, FOURTH FILING
WHEREAS, the plat of the Miller Brothers South Foothills
Subdivision, Fourth Filing, dedicated for public use a walkway
easement ten foot in width connecting West Lake Street and
Springfield Drive between Lots 44 and 45 and between Lots 59
and 60 in said subdivision; and
WHEREAS, the owners of the property adjoining such walkway
have requested that the City Council vacate the same; and
WHEREAS, such walkway has never been open to the public,
no public improvements are installed therein, and in the opinion
of the City Council no walkway is needed or will be needed in
the future and the vacation of such easement would therefore
not prejudice the interests or rights of the citizens of the
City of Fort: Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF FORT COLLINS that that certain walkway easement shown on the
plat of Miller Brothers South Foothills Subdivision, Fourth
Filing, connecting Springfield Drive and West Lake Street between
Lots 44 and 45 and Lots 59 and 60 in said subdivision be, and
the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading and
ordered published this 20th day of April, A.D. 1976, and to
be presented for final passage on the 4th day of May, A.D. 1976.

WHEREAS, the plat of biller Brothers' South Foothills Subdivision,
Fourth Filing, describes and dedicates a certain easement twelve (12) feet in
total width lying and being an area in Lots 106 and 107 of said subdivision,
six (6) feet either side of a center line which is the common bounder.,
between said Lots 106 and 107, extended; and
WHEREAS, the owner of said Lots 106 and 107 in the aoove mentioned
subdivision has petitioned the Council of the City of Fort Collins to cause
the same to be vacated; and
WHE MS, said easement has never been used and the City of Fort
Collins Has never expended any public funds upon said easement and said
easement is not needed for any public purpose; and
WHEREAS, the owner of said lots has agreed to convey and dedicate
a substitute easement, which said substitute easement has been approved by
the City Engineer; and
WHEREAS, it further appears that the rights of the residents of
the City of Fort Collins will in no way be prejudiced or injured by the
vacation of such easement.

NOW, T}IE3E O K , BE IT OIDAIN-ED BY THE COUNCIL OF TAE CITY OF FORT
Section 1. That a certain easement, more particularly described
as follows, to -wit:
That certain easement twelve (12) feet in total width
lying and being an area in Lots 106 and 107 of Willer
Brothers' South Foothills Subdivision, Fourth Filing,
as filed August 19, 1960, and being six Q%6) feet either
side of a center line which is Lite common boundary
between said Lots 106 and 107, extended;
be and the same is hereby vacated, abolished and abated.

Introduced, considered favorably on first reading and ordered published
this 15th1 day of Parch, 1962, and to be presented for final passage on the
5th day of April, 1962.
