ORDINANCE NO. I , 1987
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING AN OFF -SITE SEWER EASEMENT
LOCATED EAST OF 800 LEMAY AVENUE
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate an off -site sewer easement located east of 800 Lemay, set forth
in more particular below; and
WHEREAS, the owners of the property have determined that an off -site
sanitary sewer easement is tied to this property; and
WHEREAS, said sanitary sewer has been abandoned and the easement is no
longer needed; and
WHEREAS, all utility companies have been contacted and indicate no
problems with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the off -site sewer easement located at 800 Lemay Avenue, set
out more particularly as follows, to wit:
Easement for a 24" sewer line granted to the City of Fort Collins
by E. R. Betz in the Memorandum of Agreement dated May 14, 1959,
as recorded in Book 1438, Page 943 of the records of the Larimer
County Clerk and Recorder. Said easement runs northwesterly from
a point about 60' west of the southeast corner of the southwest
1/4 of the NW 1/4 of Section 18 to the North line of the Betz
land, which is described more particularly as situated in the
Southwest quarter of the Northwest quarter of Section 18,
Township 7 North, Range 68 West of the 6th P.M.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading and ordered
published this 6th day of January, A.D. 1987, and to be presented for final
passage on the 20th day of January, A.D. 1987.
