ORDINANCE NO. 34, 1994
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING CERTAIN STREETS AND EASEMENTS
AS DEDICATED ON THE ORIGINAL PLAT OF
HUNTINGTON HILLS, FIRST PHASE (FILING ONE), P.U.D.
WHEREAS, the Huntington Hills, First Phase, P.U.D. was originally platted
and approved by the Planning and Zoning Board on April 30, 1981; and
WHEREAS, subsequent to said approval, a portion of Huntington Hills, First
Phase, P.U.D. was replatted in part as the "Huntington Hills, Filing Two, P.U.D."
(hereafter "the Replat"), which Replat was approved by the Planning and Zoning
Board on May 30, 1984; and
WHEREAS, the streets and easements that were dedicated on the plat of the
original Huntington Hills, First Phase, P.U.D., and which also lie within the
boundaries of the Replat, have never been vacated, even though streets and
easements that were and are intended to supersede those original streets and
easements were laid out and dedicated on the Replat; and
WHEREAS, the Developer has requested that the streets and easements as
dedicated on the portion of the original plat of Huntington Hills, First Phase,
P.U.D., which is included in the Replat, be vacated except to the extent that
such streets and easements bisect or overlap the street and easements that were
dedicated on the Replat; and
WHEREAS, pertinent City agencies and private utility companies have been
contacted and report no objection to the proposed vacations; and
WHEREAS, there will be no cost to the City in making the proposed
vacations; and
WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said streets and easements.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the streets and easements as dedicated and described on the plat entitled
"Huntington Hills, First Phase, P.U.D." approved by the Planning and Zoning Board
on April 30, 1981, be, and the same hereby are, vacated, abated, and abolished;
EXCEPTING AND RESERVING, however, those streets and easements:
(1) which lie outside the boundaries of the Replat, and
(2) which bisect or overlap any such streets, easements, rights -
of -way, or other interests in real property that have been
dedicated to the City pursuant to the Replat.
