RE: Fox Meadows II/Timberline Road Improvement

Dear Steve:
Per our telephone conversation, I enclose the agreement
which you sent me regarding acquisition and installation of
Timberline Road west of the Fox Meadows property. In accordance
with our previous discussions, you are to make the change
indicated on page 1 in subparagraph (vi) so that Timberline Road
is described as a major arterial street. You will also make the
change on page 2 to that same subparagraph which changes the sum
of $21,070.00 to $21,700.00. In subparagraph (viii) on page 2,
you will change $11,210.00 to $11,300.00. I believe these
changes have been accepted by the City. Assuming you agree with
the changes, please substitute revised pages 1 and 2, obtain
signatures on behalf of the City on page 3, and return a
photocopy to me. You should retain the original for the City's
records.
With regard to the sidewalk, I understand that Phil Robinson
has redesigned the sidewalk in order to place it in its final
contemplated location. The sidewalk is being drained east I_o Lhe
parking lot which will be on the Fox Meadows property. I
understand that this redesign has been accepted by Engineering.
With regard to dedication of the roadway, I am advised by
Phil Robinson that the final subdivision plat for the property
which includes the total road dedication has been completed,
executed and left with the City. Apparently, final approval of
that plat by the City is still required.

Dear Mr. Phillips:
In a November 20, 1979 letter to you Medema Homes reiterated its request
for a decision regarding the purchase by Fort Collins of Tract B for patk
purposes.
Over a year has passed since Tract B was designated for park purposes; long
enough, we feel, for a reservation of this highly developable parcel.
Therefore, we again offer to the City Tract B at our original purchase
price of $12,750/ac x 1.203 ac = $15,338.15. If we have not received by 6/9/80
written intenttopurchase Tract B this will signify that Fort Collins
does not wish to purchase the parcel and that Medema may proceed to sub—
divide the Tract into single family lots.

With receipt of a copy of your letter addressed to the City of Ft. Collins
Planning Department and relative to the replatting of Fox Meadows 3, I had
the matter further investigated as it falls within my area of responsibility.
upon review, I find that what rearrangements of telephone plant were proposed
to you were in pursuit of an ideal solution and would minimize future
property owner's inconvenience by having all pedestals located in lot
corners. This is a preference; not a requirement for the provision of
service.
With concurrence of the Planning Department, minimal rearrangements can
be made to accomodate your request by the utilization of existing plant
with the placement of four additional cable pedestals. Associated costs
would be considerably less than what was previously quoted to you. It
must be recognized that, should existing pedestals be required to be
relocated at a future date, the costs of relocation would be borne by the
property owners. Should you care to reconsider the matter, we will be
happy to work with you to arrive at a mutually acceptable solution.
I regret your perception of this incident and the obvious consternation
it has caused. I assure you that Mountain Bell management is concerned
and willing to cooperate in order to serve your interests.
If you wish to pursue the matter further, I have directed Mr. Irvin Troudt
to assume personal responsibility for future negotiations. Mr. Troudt

Re: Final Acceptance of Fox Meadows Subdivision

Dear Mr. Rupel:
Per your discussions with Duane Bowman of this office, we hereby request
the final acceptance of the above -referenced subdivisions. All of the
improvements, as set forth in the Subdivision Agreement, dated April 19,
1981, have been completed. These improvements include, but are not
limited to, water and sewer lines, drainage facilities and streets.
The only items which are not complete at this time, are those set forth
in the attached "cost estimate." Due to grade differentials at the sub-
division boundaries, these improvements cannot be installed at this
time. Therefore, per your agreement with Duane Bowman, we are including
herewith, a check in the amount of $11,378.56 constituting 115% of the
present cost to complete the improvements.
To complete this matter, please sign the enclosed copy of this letter,
in the space provided, and return same to me. The countersignature of
this letter and acceptance of the check shall constitute full acceptance
of these subdivisions and Medema Homes, Inc., shall be relieved of all
liability for same.
