OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A UTILITY EASEMENT ON LOT 1, BLOCK 2
OF HILL POND ON SPRING CREEK P.U.D. 2ND FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
easements and. rights -of -way, by resolution or by approval of
replats containing notation of such vacation; and
WHEREAS, the owner of Lot 1, Block 2 of Hill Pond on Spring
Creek P.U.D. 2nd Filing, in the City of Fort Collins, Larimer
County, Colorado, has requested a vacation of a utility easement
on said Lot 1; and
WHEREAS, the vacation request has been reviewed and approved
by the pertinent utility agencies and departments.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the utility easement more
particularly described as:
A ten foot wide utility easement located along the west
property line of Lot 1, Block 2 of Hill Pond on Spring
Creek P.U.D. 2nd Filing, a replat of Hill Pond on Spring
Creek 2nd Filing Subdivision, in the City of Fort
Collins, Larimer County, Colorado shown and dimensioned
as 'Existing 10' Utility Easement'
is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 21st day of May,
A.D. 1990.

RE: Request for Utility Easement Vacation
Dear Mike:
As the owner of Lot 1, in Block 2 of Hillpond on Spring Creek 2nd Filing
(1821 Wallenberg, Drive) in Fort Collins, I am requesting the City of
Fort Collins to vacate a portion of an unused utility easement along the
west property line as shown on the enclosed plat.
'The P.U.D. is about 75 percent built out and it appears that all utility
construction is complete. To the best of my knowledge there are no
utilities in this portion of the easement and it would appear that there
would not be a need for the easement in the future. The telephone and
cable TV that typically run along the rear easement end at riser boxes
located on Lot 2 and are fed from the south. The easement vacation is
being requested to allow for a planned addition to the garage.
