OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE ACCESS, UTILITY AND DRAINAGE
EASEMENT DEDICATED ON TRACT B OF THE HAMLET AT MIRAMONT PUD
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of Tract B of the Hamlet at Miramont PUD has requested
that the City vacate a portion of the access, utility and drainage easement dedicated on
- Tract B of the Hamlet at Miramont PUD and more particularly described below; and

WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that a portion of the access, utility and drainage easement dedicated on
Tract B of the Hamlet at Miramont PUD more particularly described as follows to wit:

Larimer County, Colorado being more particularly described as follows:

Considering the Southerly line of said Tract B as bearing South 44°48'32"
r East and with all bearings contained herein relative thereto:

Y Commencing at the South corner of said Tract B; thence along the East line
of said Tract B, North 25032'03" East, 52.23 feet; thence departing said East
r line, North 45056'50" West, 29.71 feet to a point on said access, utility and
z drainage easement, said point also being the POINT OF BEGINNING;
s thence along said access, utility and drainage easement line, North

T z 45056'50" West, 10.43 feet; thence continuing along said easement line,
North 44003'10" East, 12.00 feet; thence departing said easement line,
South 45°56'50" East, 10.67 feet; thence South 45'11'28" West, 12.00 feet
to the Point of Beginning.

The above described vacation of a portion of said easement contains 127
square feet and is subject to all easements and rights -of -ways now on record
or existing.

by 10.43 foot piece) of the access, utility and drainage easement, as shown on the attached
drawing, is being proposed for vacation. The owner is requesting this vacation since the
proposed community building encroaches on to the platted easement.

The final design of the Community Building for the Hamlet at Miramont, PUD, requires that
a portion of the building and envelope be sited within a portion of the originally platted
easement.
have instructed RBD, Inc., to prepare the necessary legal description and diagrams for
the vacation being requested, and to forward them to you for the processing of the
required administrative change.
