OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A SIX (6) FOOT DRAINAGE
AND UTILITY EASEMENT IN LOTS 19 AND 20
FOX HILLS, SECOND FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements, by resolution or by approval of
replats containing notation of such vacation; and
WHEREAS, the Owner of Lots 19 and 20, Fox Hills, Second Filing, City of Fort
Collins has requested that the City vacate a portion of a six (6) foot drainage and utility
easement, which runs along the common property line of Lots 19 and 20 Fox Hills Second
Filing, more particularly described on Exhibit'A'; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins that a portion of a six (6) foot drainage and utility easement, which runs
along the common property line of Lots 19 and 20 Fox Hills Second Filing, more
particularly described on Exhibit 'A', attached hereto and incorporated herein by this
reference, be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins held this 21" day of January A.D. 1999.

UTILITY EASEMENT
Attached for your review and comments are a vacation request and a sketch by the
applicant showing Lot 20 in Fox Hills Second Filing, more specifically, on Kit Fox Court.
A portion of a six (6) foot drainage and utility easement on the northeast side of the Lot
described above, and as shown on the attached Exhibit'B', is being proposed for
vacation. The applicant is requesting the easement vacation because the building
footprint of the home will not fit on the above -mentioned Lot and encroaches into the
easement. They will be deeding a portion of Lot 19 to Lot 20 to meet the minimum
setback requirements, At this time, they do not plan on dedicating any additional
easements for the portion they are requesting to vacate, but would be willing to do so if
it is deemed necessary. Also included in this submittal is a copy of their request
(Exhibit 'A').
Please sign and return any comments to Tim Blandford in the Development Review
Center by December 14, 1998. If I do not hear from you by this date, I will presume

Dear Steve,
This letter is in response to your request to vacate a portion of a six (6) foot drainage
and utility easement on the northeast side of Lot 20 in Fox Hills, 2nd Filing, more
specifically on Kit 'Fox Court. At the time I received your request, I routed a letter to the
various departments that this vacation would directly affect, stating your concerns and
your reason for proceeding through the vacation process. Please find enclosed copies
of the comments and concerns we received from these various departments. After
reviewing the comments, I have concluded that we deny the request to vacate a portion
of a six (6) foot drainage and utility easement on Kit Fox Court. I would, however,
recommend that you contact each of the various departments, address their concerns,
and resubmit your request for further consideration.
If you should have any questions or concerns, please do not hesitate to contact this
