RE: REQUEST TO VACATE PORTIONS OF A UTILITY EASEMENT
Attached for your review and comments are a vacation request and sketch by the Applicant
showing Brittany Knolls 2"d Filing, Tract A, the proposed Respite Care Center located north
of Trilby Road and south of Fossil Creek Parkway on the west side of Lemay Avenue. Two
portions of a large utility easement are being proposed for vacation: a 7.5' strip along the
existing ROW for Lemay Avenue which would be vacated as easement and immediately
rededicated as additional ROW, and a large L-shaped portion of the easement along the
north and east sides of the Tract as shown in attached Exhibit 'B'. The Applicant is
requesting the easement vacation because they are dedicating additional ROW, because
one of the two sanitary sewer lines has been abandoned and the full area is no longer
needed, and because, for the existing sanitary sewer line, they would like to rededicate
easement for that line, but only as an easement for the South Fort Collins Sanitation District,
as opposed to having a general utility easement for that line. This vacation would leave the
standard 15' utility easement along the Lemay ROW.

September 2, 2003. If no correspondence has been returned by this date, it will be

This letter is to detail the reason that we are requesting the vacation of the utility
easement that was dedicated on the Brittany Knolls P.U.D. Filing No. 2 Plat. At the time
of the creation of this Plat, there were two Sanitary Sewer lines running through Tract A
that necessitated such a large easement. However, now the Northerly Sanitary Sewer
line has been abandoned. Also, there are no other Utilities inside of this easement. We
feel that vacating the aforementioned easement and creating an exclusive Sanitary
Sewer easement holds the most benefit.
The South Fort Collins Sanitation District has asked us to create an easement that lies
15 feet on each side of the existing sanitary sewer line now in use. Enclosed please find
an exhibit detailing the proposed exclusive Sanitary Sewer easement. We are also
enclosing an Exhibit showing the easement vacation.

Comcast Cable has no problems with the Vacation along Lemay Ave.
I Iowever the easement along the North Property Line we would like to see located so that we are sure that
there is not any existing coax cable in the area to be vacated.
