In the event someone from your church has not checked on sewer and water service to this property, kindly be advised that the following will be required. 1..2 inch water main at Springcreek is required to be extended to the east to the :gist line of this property. Upon completion of this installation, the City will reimburse For 40 percent of said construction cost upon receipt of the invoices. A 1 112 inch water tap is shown on 11.0 construction plans, which will require a Plant Investment Fee of $700, to be followed by a statement at a later date for the actual cost OF construction. SMITH, ) Defendants ) FINDINGS OF FACT, JUDGMENT AND DECREE This matter having come on for hearing on the 26th day of April, 1973; the Plaintiff, The Faith Evangelical Free Church of Fort Collins having been present by certain duly elected officials and by its attorney Timothy W. Hasler; and the Defendants Ladco, Inc. and Robert T. Smith having been present both in person and by their attorney, James D. Beatty; and the Court having examined the records, having heard the evidence and considered the stipulations and state - meats of counsel, and based thereon, does hereby ORDER, ADJUDGE and DECREE and follows: 1. That the Plaintiff shall have judgment against the Defendants jointly and severally for the sum of Five Thousand Dollars ($s,000.00). It is hereby ordered that said sum shall be due and payable in full on or before the 26th day of July, 1973 provided that the said Defendants are hereby ordered to deliver forthwith to the Plaintiff such sums of money, not to exceed Five Thousand Dollars ($5,000.00), as are now due and owing to the Defendants by the City of Fort Collins. r." ." The Defendants are hereby jointly and severally ordered to install paving, curb and gutter at and upon the certain parcel of real estate conveyed to the Plaintiff by the Defendant, Ladco, Inc. in February, 1972. Said curbing, paving and gutter shall be installed according and pursuant to specifications approved by the City of Fort Collins, and shall be completed on or before the 26th day of April, 1974, unless sooner required by the said City of Fort Collins. 3. That the Plaintiff shall. assign to the Defendants all its right, title and interest in and to any reimbursements or refunds resulting from the installation by the Plaintiff of that certain twelve inch (12") water line brought to the Fast boundary of the said above described real estate. 4. That each party is hereby ordered to pay his or its own costs incurred herein. 5. That the Clerk of the District Court shall forward copies of this Judgment to the attorneys of record and shall enter Judgment in accordance with the terms hereof.
