Gentlemen:
This letter is to advise you that as much as 7.6 cubic feet per
second of storm drainage from Phases L, II, and III will be dis-
charged onto property presently owned by you. This volume of
water includes 5.2 cubic feet per second originating from the
northeast corner of College Avenue and Boardwalk Drive.

Gentlemen:
A substantial drainage problem has been occurring at 4040 S. College Avenue
since the development and construction of Fountainhead P.U.D. Phase III.
Fountainhead Phase III was built at an elevation several feet higher than
the adjoining property to the south and its roof drainage is not being
channeled away properly, instead causing a flooding problem for the
dwellers next door. The drainage system in place now is in substantial
disrepair and simply does not work, nor did it ever really work very well.
I am writing on behalf of the residents of 4040 S. College to inform you
of this problem and to offer a suggestion about how it might be resolved
quite easily and inexpensively. My recommendation is that a 6-inch
perforated PVC (plastic) pipe be connected to the roof drains and laid
horizontally with sufficient slope to drain it west to College Avenue.
Some berming along the south property line and 3/4" rock bedding and cover
for the PVC pipe would provide a relatively maintenance free and effective
drainage system, I believe.
I'd be happy to meet with someone on -site to review this problem and
to discuss possible solutions. Please feel free to call me any time
to arrange a meeting.

Dear Mr. Pennock:
Approximately five weeks ago, I sent a letter to your firm soliciting your
cooperation in resolving a drainage problem caused by the development of
Fountainhead PUD, Phase III. (See attached letter dated August 12, 1986.)
Since I've not yet been contacted by anyone from your firm, I feel
compelled to repeat my request, and to make it known to you that you may be
at substantial risk legally. Colorado drainage law basically holds that an
upstream landowner cannot discharge water upon his downstream neighbor "in
a manner or quantity to do more harm than formerly" (Docheff vs.
Broomfield, 623 P2d 69, 1980).
In my opinion, there is no question that the runoff has been increased
substantially and is now causing more harm to the downstream property at
4040 South College Avenue. Now that you have been "put on notice" that
this problem exists, prudency would seem to dictate that you attempt to
resolve the problem before serious flood damage occurs and a lawsuit is
filed.
As I suggested in my August 12 letter, I believe a relatively simple and
inexpensive plastic pipe installation and some minor berming would solve
this problem. Again, I'll offer to meet on -site if it will help expedite a
solution. Please call me if you think my presence is needed.

Re: Sports Caster's Vacation
JUSTIFICATION STATEMENT
Sports Caster Bar and Grill, formerly Cables End Restaurant, is located in the
Fountainhead P.U.D., Phase Three. When the P.U.D, was processed, a blanket easement
was placed on all common areas outside the building envelopes. When Cables End
Restaurant was permitted, a vacation was granted for the building envelope. However,
this vacation did not include the outside dining area (courtyard). Sports Caster is
proposing to cover this courtyard with a metal roof. This requires a building permit, and
in order to obtain a permit, this area must also be vacated from the blanket easement.
Because this courtyard is existing, with an existing courtyard wall around it, we hope that
a vacation will be granted for the roof structure.

NOTICE
Please take notice that on February 28, 1983 , the Planning and
Zoning Board of the City of Fort Collins, Colorado, approved the
Final _ Plan of the planned unit development known as
Fountainhead PUD Phase 3 (subject property), which development was
submitted and processed in accordance with Section 118-83 of the Code of
the City of Fort Collins. The final Plan of the
subject property together with the development agreement dated February 17, 1983
between the City of Fort Collins and the developer, out of
which documents accrue certain rights and obligations of the developer
and/or subsequent owners of the subject property, are on file in the
office of the Clerk of the City of Fort Collins.
The subject property is more particularly described as follows:
The subdivision plat of the Fountainhead PUD Phase Three
being a portion of Section 36, Township 7 North, Range 69 West of
the 6th Principal Meridian to the City of Fort Collins, County of
Larimer, State of Colorado.
Offsite easements required for utilities to serve this planned unit
development are recorded with the Larimer County Clerk and Recorder.
