RE: Fossil Creek Commercial P.U.D.
We have made a preliminary review of the Fossil Creek Commercial P.U.D.
located south of Fort Collins in the SEk, Sec. 35, T7N, R69W• The
plan incorporates approximately 43.5 acres for two major shopping com-
plexes initially planned. Under the P.U.D. concept, 6.5 acres will be
allocated to open and green space.
The New Mercer Canal traverses through the center of the property and flows
in a southerly direction. It hE; been proposed to abandon the existing
open channel ditch structure and to construct a reinforced concrete box
culvert (RCB) to accommodate the New Mercer Ditch flows as well as to
intercept the storm runoff generated from the accompanying commercial
development. A 4-foot by 7-foot RCB, nearly 2,300 feet long has been
proposed under McClelland Drive, the main thoroughfare of the development.
Because of the size and the depth of the proposed conduit, the following
items present major consideration:
• capacity
• maintenance and access
• ditch rerouting and easement
• water quality
Capacity
The capacity is adequate for the 80 cfs irrigation requirements of the
ditch company. Under the average daily operating conditions of 40 cfs,
the velocity in the culvert is estimated to prevent siltation and
sedimentation.
Provisions should be made for overflow such that it can be directed
in the same area of the ditch.

Dear Lloyd:
This ]Letter concerns the alignment of McClelland Drive
in the area from Harmony Road extending north for. approx-
imate]'_y 600 feet. As you know a partnership of which :f.
am the managing partner owns the property immediately
north of Harmony. From indications I have seen on the
preliminary plat of the land adjoining us to the north,
it appears that the alignment of McClelland is such
that i_t does not coinside with the most desirable align-
ment from our point of view. The most desirable situa-
tion I -or us would be to have the west :Line of McClelland
Drive line up with our west property line. It appears
that the present alignment of McClelland as it shows on
the Troutman plan brings the .road onto our property =,ome-
what east of what we would consider the most desirable
alignment. Obviously if this forced us to leave a small
strip of land useless on the west side of McClelland
Drive we would not be willing to oblige in the contribu-
tion of the right-of-way. I am sending copies of this
letter to Morrie Rupel, Paul. Deibol.d and Milo Bunker in
order to see if you can not get this corrected before it
is too late. I would appreciate hearing back from you
on this matter.

We are not in a position to accept any more runoff water at

Store in Fort Collins
Dear Dennis:
This letter will confirm our telephone conversation of November 9,
1978, in which I stated the City's position with regard to the
issuance of a Footings and Foundations Permit for the Target Store
soon to be under construction in the City of Fort Collins.
As I indicated in that conversation, the City will be able to issue
an "at risk" Footings and Foundations Permit for the Target Store,
notwithstanding the fact that the improvements relating to water,
sanitary sewer, and roads as well as the ditch relocation, all pro-
vided for in the Subdivision Improvement Agreement have not been
accomplished.
As we discussed, an "at risk" Footings and Foundations Permit means
that the City, in issuing the permit, is not giving its approval of
the work being done under the permit, nor is it waiving any of the
conditions required in the Subdivision Improvement Agreement. Rather
Target Stores would assume any risk involved with installing the
footings and foundation before the other improvements are finally in
place and accepted by the City.
If you are willing to accept the terms of this permit, then the City
will be willing to issue such a permit to you.

Re: New Mercer Ditch Relocation

We have reviewed the most recently revised plans for the ditch relocation as
prepared by M and I Engineers, dated November 16, 1978. The ditch has been
proposed to be realigned in an open channel adjacent to the west side of the
C and S Railroad tracks. The ditch is bordered to the west by the Larkborough
residential subdivision and by the Fossil Creek Commercial Plaza to the east.
Present construction plans call for modifying the existing structure at Mail
Creek, boring under the C and S tracks south of Harmony Road, open trench
construction of a 54-inch RCP crossing Harmony Road, replacement of the
existing Parshalll flume, and construction of a diversion structure with
headgate and cheek structure. Water will be deliverd to the existing 18-inch
irrigation laterals at the present point of diversion on the existing ditch.
Construction of the lateral through the Fossil Creek development necessitates a
second bore under the railroad tracks.
A 12-inch dewatering line will be laid parallel to the open ditch for most of
its length.
A cutoff trench !is proposed to reduce seepage to the existing ditch route at
the upstream end of this project. The existing ditch is proposed to be abandoned
and filled.
Ditch Capacity
The ditch has been designed for a capacity of 80 cfs. Plans indicate a depth of
2.9 feet for this flow with resulting velocities ranging from 2.4 to 2.8 feet
per second. Several test holes, drilled in November by Empire Laboratory, show
non -irrigation season water levels at or near the proposed channel invert. In
addition to the '12-inch dewatering line, the ditch will be overexcavated and
lined with clay where required in order to reduce groundwater inflow to the

ditch and to facilitate construction. Water levels in the area will gradually
be drawn down as a result of the installation of the dewatering line and the
dewatering system proposed in the Larkborough Subdivision. We recommend that
a gravel filter be installed around the•12-inch perforated pipe to prevent
clogging of the line. t
Mail Creek Outlet
Due to the velocity generated in the 54-inch RCP, it will be necessary to construct
an energy dissipating structitrP at its outlet. The ditch should be riprapped
downstream of this structure to prevent erosion.
The proposed ditch will be constructed to tie into the existing cobblestone drop
structure upstream of Mail Creek. We understand the area below the drop is
eroded and in poor condition. A defined channel to Mail Creek should be con-
structed. Riprap should be added at the existing structure to prevent further
channel deterioration. An additional drop structure may be necessary below the
existing drop, depending on the actual field condition. Two laterals take off
from the existing cobblestone drop structure. These diversions are to be
maintained in their current operating condition.
Harmony Road Inlet
Regular maintenance of the proposed trash rack at the inlet of the 54-inch pipe
will be necessary to assure safe and proper function of the ditch system. Large
debris such as shopping carts and tree branches can be expected due to the
adjacent land use.
Trash racks are an absolute necessity at both ends of the 54-inch pipe. This
would help protect the ditch company from liability since the pipe would be
an attractive nuisance to children playing in the area. If the ditch company
does not want to maintain the proposed trash racks, we feel that it would be
appropriate to have the developer set aside a perpetual fund for these cleaning
operations.
A 15-foot long riprap transition should be added at the inlet to protect the
invert and ditch slopes.
Check Structure
We feel that the proposed check structure is not stable and offers inadequate
protection from overturning due to debris buildup or piping. It is recommended
that this structure be modified to include a spread footing and perhaps be
widened to stick further into the banks. Since we are not structural engineers,
we can not evaluate in detail the structural integrity or confirm the reinforce-
ment design of the structures involved on this project.

Larkborou h Subdivision
A 2 -inch RCP detention pond outlet is proposed to discharge to the New Mercer
Ditch. The tributary area to the west historically drained to a 20-inch pipe
located under the railroad tracks approximately 150 feet north of the proposed
outlet and discharged west of the existing ditch.
The detention pond for the subdivision is located on the eastern property
boundary adjacent to the proposed ditch. A detailed site drainage analysis
of the subdivision was not undertaken as part of the ditch relocation study.
However, rules of thumb developed from previous area site drainage studies were
applied. The pond volume of 15 acre-feet seems adequate for 100-year detention
storage. The pond is proposed to have a permanent water surface; thus, the
15 acre-feet would be considered live storage available above the normal
operating levels of the pond.
it is recommended that the pond outlet be staged such that the full storage
capacity can be utilized for all storm frequencies. Thl' will allow a storm
less than the 100-year to discharge at slower rates.
An extensive groundwater dewatering and French drain system is proposed for the
Larkborough Subdivision. Apparently, intercepted groundwater flow will also be
directed to the pond and eventually to the ditch. It should, be a decision of
the Board of Directors of the ditch company whether to accept this groundwater
or not.
Ditch Inlet
Due to the angle ofthe existing ditch to the proposed alignment it is necessary
to riprap the ditch and its banks both upstream and downstream of the junction.
A cutoff trench will be constructed to prevent seepage to the ancestral ditch.
The cutoff should be tied well back into the existing ditch banks to contain any
end run around the trench.
Maintenance
In order to facilitate ditch maintenance and to provide sufficient area for
ditch clean -out, a maintenance access road should be constructed on the east
ditch bank at the same elevation as the road shown on the west side.
A 6-foot chain link fence will be constructed on the west bank. Access to the
ditch is proposed at Harmony Road. An area for vehicle turn around at the north
end of the project should be provided.
Construction
Construction of the ditch should proceed from the downstream end. It is necessary
that construction be completed during the non -irrigation season because of reliance
on the ditch by farms during the season.

At your request I will try to clarify the sewer service situation
in regard to the above development.
We presently have a contractor under contract to build a segment
of the Warren Lake Trunk Sewer across the property between
College Avenue and the C & S railroad tracks. We estimate that
this should be completed within the next 45 days.
There is another segment of the sewer to be built east of College
Avenue. We expect to open bids on this segment on February 9th
and award bids on February 20th. The construction on this re-
quest should be complete by the end of April. If properties
in the Fossil Creek PUD require service prior to this date, we
will plug the trunk sewer west of College and pump from a man-
hole.
We hope this clarifies our schedule for you. If you have further

Pursuant to our meeting with the City Attorney and representatives of Target Stores on
Thursday, January 25, 1.979, and your telephone request of Friday, January 26, 1979, we
wish to express the City's position as follows:
1. The City would prefer that storm drainage being released from Fossil Creek Commercial
Plaza be directed into the proposed "McClelland Drive Interceptor Storm Sewer". This
drainage plan is shown on the site plans for Target P.U.D. and LaBelles P.U.D. and
the utility drawings for Fossill Creek Commercial Plaza which were approved by the
City Engineer in November, 1978.
2. In the event an agreement is not reached between the various landowners for the
construction of the McClelland Interceptor Sewer and construction has not begun
on the sewer by March 1, 1979, the City will review revised storm drainage cal-
culations and plans for the Target and LaBelles P.U.D.s and the Fossil Creek
Comrercial Plaza„
3. The City will consider the following items in its review of the revised calculations
and plans:
a) The capability of the existing 24-inch diameter R.C.P. under College Avenue
(to the East) to handle the revised discharge of Targets and LaBelles.
b) The Developer's satisfactory solution of the disposition of the drainage
West of McClelland Drive and East of the railway.
c) The effect of drainage directed through the 24-inch diameter R.C.P. on the
subdivisions presently being considered East of College Avenue.
d) The effect, if any, on any drainage which might be directed to the 24-inch
diameter R.C.P. from the Larkborough Subdivision West of the railroad.
4. An agreement will be required of the Developer to participate in the cost of
constructing the McClelland Storm Sewer when it is required.
We trust this answers your request and reiterates the City's opinion that the McClelland
Storm Sewer appears to be the most satisfactory solution to the storm drainage for that
portion of Section 35 east of the railroad.

Maintenance and Access
It is recommended that a minimum of five clean -out manholes be installed at
intervals of not less than 500-feet and at any change of direction. Large
debris, such as tree limbs, which accummulate in the culvert will be diffi-
cult to remove and may necessitate cutting before passage through the man-
holes. A further concern of large debris removal is the proposed location
at the street. The culvert easement should be made available to provide
access for repairs and maintenance without hindrance to traffic.
It is our understanding that the ditch in this reach has high accummulations
of debris and silt. The grate at the culvert entrance should be installed
at a slope of no less than 3 to 1, preferably at 4 to 1 to facilitate
debris "riding -up" the grate to keep the culvert free flowing. A safety
lock should also be added for protection.
Agreements for maintenance of the culvert, the inlet and the outlet should
be made with the appropriate entity for cleanup and debris removal on a
weekly basis (luring the irrigation season and after every storm to assure
proper function of the trash rack and prevention of blockage at the
entrance.
Sharp angular bends proposed for the culvert should be replaced with smooth
curves with a minturn radius of 150-feet to prevent sediment deposits and
debris blockage. Clean outs should be provided particularly at these
points.
To provide a continual flow line of the existing open channel canal, to the
box culvert, it is recommended that the invert of the box culvert be set
at the normal bottom of the ditch to assure future opportunity for sedimen-
tation cleaning.
Riprap should be placed at the culvert entrance and exit to provide pro-
tection to the existing ditch from undue scorn and erosion.
Ditch Rerouting
Because of the heavy reliance by farms for irrigation water during the
season, it is necessary to require that construction be completed during
the non -irrigation season from October to May,
Side slopes for the construction route should be set at a 3 to 1 minimum.

Dear Milo:
This letter is being written in regard to the drainage conditions on
the above referenced project.
As you are aware, only two portions of the proposed McClelland Drive
interceptor storm sewer have been installed to date. Those sections
being approximately 340 lineal feet on the Target site and that sec-
tion across Troutman Parkway. Therefore, the storm sewer is not
functional in its present condition.
As it is undesireable to have a crosspan across Troutman Parkway at
College Avenue, it was necessary to intercept the existing drainage
flow from College Avenue at the inlets on Troutman Parkway. Once
the existing curb at this location is removed all of the drainage on
the west side of College Avenue from the high point near the Prime
Minister Restaurant to Troutman Parkway will pond in the intersection
at Troutman Parkway. This water will build up to a depth of 82 in-
ches before it would flow to the south on College Avenue.
Because it appears that the McClelland Drive interceptor storm sewer
will not be installed prior to Target's or LaBelle's opening, a
temporary drainage system will be necessary.
One alternative is to pump the stormwater from the manhole located
on the south side of Troutman Parkway. The most cost effective
method would be to pump directly into the curb and gutter on College
Avenue. The water would then gravity flow south to the inlet which
presently accommodates this drainage. The concern with a pump system
is the constant maintenance, particularly in the winter season.

Another alternative would be to connect the two sections of the
storm sewer presently installed and drain into the southerly man-
hole on the Target site. The Target Store has installed a tempo-
rary pump i_n that manhole which pumps into the existing 24 inch
drain across College Avenue. Of course, this would require an
arrangement: with Target for pumping expenses and maintenance.
However, the advantages of this alternative are that the pump is
already installed and Target will have employees onsite daily who
can check and maintain the system. The disadvantage being the
additional cost to connect the two sections of storm sewer.

Dear Maurice:
This letter is being written per your request from our meeting with
Don Deagle., Assistant City Attorney, Milo Bunker, Leonard LaBelle,
Art March, Jr., and representatives of Kealy Construction Company.
As we discussed at the meeting, the acceptable solution for tempo-
rary storm drainage from the intersection of Troutman Parkway and
South College Avenue would be the installation of a sump pump in
the McClelland Interceptor Storm Sewer manhole located directly
south of Troutman Parkway. The stormwater would then be discharged
into the curb on College Avenue and gravity flow south to the exist-
ing 24" drainage pipe across College Avenue.
I have investigated pump specifications which would be acceptable for
the temporary situation and provide safe conditions for traffic. It
is recommended that a Peabody -Barnes Model 4SE201 or acceptable equiva-
lent be used. This is a 2 horsepower, 4" pump which will pass solids
up to 3" size. It will require a 230 volt single phase electrical
connection and 2 mercury float switches for automatic control. The
pump has a capacity of 375 gallons per minute under a 15' head. I have
contacted Jim McLemore of McLemore Pump and Equipment Company, Denver,
Colorado, Phone: 371-5730, for pump curves and manufacture's data. I
will forward that information to you upon my receiving. Should you de-
sire to talk to him personally, please do so.

In the event of a high intensity storm or malfunction of the pump
system, stormwater could stand in the intersection as indicated on
the attached sketch. The maximum depth of water would be 0.5' at

Dear Mauri:
This letter is submitted, per Milo Bunker's request, as an
explanation of criteria and specifications for installation
of a vehicular crossing on the relocated portion of the New
Mercer Ditch in Section 35-7-69.
It is proposed to install a corrugated steel pipe -arch with
an 81" span and a 59" rise at station 36+00. This is di-
rectly south of the rip rap as shown on Sheet 5 of the draw-
ings for the project approved by the City Engineer February
20, 1979.
The culvert is 14 gauge steel with 3" x 1" corrugations. It
is designed to withstand an H2O loading. Installation in the
location specified will provide approximately 12" of cover.
The length of culvert to be installed is 30 lineal feet.
It is recommended that the pipe be backfilled with on -site
clay soils and compacted to 90% of Standard Proctor Density
ASTM D698-70.

I have on occasion represented the owners of the Fossil Creek
Commercial Plaza. They have contacted me with reference to a
matter concerning this subdivision. Their property adjoins pro-
perty which belongs to George Holter and Ezera Betz. The Holter-
Betz property has been subdivided and the City has approved the
plat of the subdivision. I also understand that utility lines
have been extended from McClelland Drive across the Fossil Creek
Commercial Plaza Subdivision into the Holter-Betz property.
Milo Bunker who has been the agent for the owners of Fossil
Creek Commercial Plaza tells me that at the time the plat of
Fossil Creel, Commercial Plaza was approved by the City there was
an agreement to withhold dedication of one foot on the north end
of McClelland Drive. I have reviewed the plat of Fossil Creek
Commercial Plaza and find that there is an express statement indi-
cating that that one foot is not dedicated by the plat but is sub-
ject to a separate instrument. As far as I have been able to
determine there is no general dedication of McClelland Drive
across the north one foot Fossil Creek Commercial Plaza. Assuming
that this is correct, it would appear that the City does not have
any authority for extending utility lines or the street across
this property.
The reason for withholding this one foot was the refusal of
Mr. Holter and Mr. Betz to participate in the cost of relocating
the New Mercer Canal as it crossed both properties. Since they
did refuse to participate in the cost the owners of Fossil Creek
Commercial Plaza bore the entire expense and the relocated canal
was placed entirely on property provided by them. The one foot
was held back in order to insure that the Holter-Betz property
would not unreasonably gain from the development of the Fossil
Creels Commercial. Plaza without paying its fair share of the relo-
cation costs.

In view of the above I have been asked to notify the City
that the owners of Fossil Creek Commercial Plaza do not consent to
the installation of utility lines or the extension of McClelland
Drive across the north one foot of Fossil Creek Commercial Plaza.
Any lines so installed shall be removed unless adequate arrange-
ments are made to reimburse the owners of Fossil Creek Commerical
Plaza [or the expense they incurred in relocating the ditch.
After you have had a chance to investigate this matter I would

Two things are provided by this certification. First it com-
pletes the projoct with the engineer who desig:eJ the drainage
facilities and keeps him the responsible p*rtv for the desicn.
After certification the engineer cannot say that the improvements
were not ccnstructed according to his plans. Secondly the certi-
fication provides the assurance to the City that everything will
work. The qity does not have the staff do the certifications
itself. %
The certification involves more than the information that
Earl presented from the contractor. Those were only as -built eLe-
/ations not accurately located (dimensioned) on the sketch. The
encineer �an use the informacicn, but will need more. to dc his
calcuiations to varifv the oesign works as constructeo.
Bob and Susan said that they already received a complaint
from the new occupant, tennant or owner that the detention pond
was not working properly. There may be an issue between Earl and
the* that convinces Bob and Susan that a certification is neces-
sary.

This letter is submitted to summarize the changes which you have
requested on the sanitary sewer design for the Fossil Creek
Commercial Plaza.
You requested that the manhole located at McClelland Drive where
the proposed trunk line crosses be set with the following invert
elevations: east 5020.31; west 5020.51; and the proposed 8" north
at 5021.59. You also requested that the 8" main to the north on
McClelland be laid at a slope of 0.40% with no drop through the
manholes. By projecting this to the property line, an elevation
of 5028.17 at manhole #4 is obtained.
We have made these revisions on the construction drawings. Should
you have any disagreement in the above figures, please contact me
immediately.

Thank you for your attendance and interest in our information gathering
and dissemination session of September 28, Z978. Several decisions were
made at this meeting regarding the construction to provide water and
sewer service to the developing area.
The City is prepared to let a bid for construction of the necessary portion
of 24-inch water transmission main in Horsetooth Road (2030 lineal feet)
with tentative com&etion in March Z979. The City is also designing the
remainder of this transmission main to the tie into existing construction
on Shields Street north of Horsetooth and to a point ,just east of College
Avenue on Horsetooth (5440 lineal feet) with plans ready for bid spring
1979.
Fossil Creek is developing ahead of most of these properties and conse-
quentZy needs service first. The property owners of Fossil Creek and
Lark Borough w&Z cooperate to construct the 12-inch D.I.P. main from
College Avenue through Lark Borough to its northern boundary. The owner
of the unpZatted portions of Park South will provide an easement through
this parcel as well as through the platted portion of this property.
Because of the pressing need for service in Fossil Creek and Lark Borough
and the slower timetable envisioned for deveZopment of Park South, the
City will cause to be designed and constructed the 0-inch main through
the Park South property on a cost reimbursement basis. The City will obtain
the crossing permit from the C & S Railroad.
The alignment and timetable for future extension of this water service line
east of College to an eventual tie within the Landings subdivision is largely
dependent upon the rate of development of the South College Properties.
Sewer service for these areas will be supplied from two different locations.
A Z2-inch trunk is ready for bid which will extend service to the west bank
of the New Mercer Canal, with capacity to serve the Warren property and
Park South.

The City is a'esign.ing the 2Z-inch extension of the warren Trunk through the
FossiZ Creek subdivision to the west side of the C & S right-of-way (through
Cary Cooper at Hogan & OZhausen). This sewer should be ready for bid
witYiin 6 to 8 weeks. The Tark Borough deveZopment wiZZ design and construct
this tr<<nk through their property with oversizina paid by the City.
After suitable aZignment has been determined the remaining portion of this
trunk east of CoZZege Avenue through the ;Vest property the City will cause

o have designed (Hogan & OZhausan) and constructed this remaining Zink to
minimise any delay of service to Fossil Creek and Lark Borough.
The Creager FZaza property wiZZ be serviced by a north fZowing sewer into
the Horse tooth Trunk. The Hotter and other properties between FossiZ Creek
and Creager Plaza can be serviced bu either, with further investigation of
the most pref'erraN e route Beira assessed the next few days.
