RE: Administrative Fees in the "Choice Streets" Ordinances
This is intended to modify and replace the memo dated November 23, 1998, of the same subject.
Incorporated within the "Choice Streets" program, Ordinances No. 177, 1998, through 183, 1998,
are a number of administrative fees which are set by the City Manager pursuant to the provisions of
Chapter 7.5, Article I of the City Code. The purpose of this memo is to gain the City Manager's
explicit approval for these fees, which took effect on January 1, 1999.
In future years, these fees will be included as part of the budget approval process. The City Council
recognized and approved these fee schedules on October 20, 1998, at the second reading of the
Choice Streets ordinances.
The administrative fees requiring City Manager approval are as follows:
1. Development Construction Permit
a. Permit Fee for most new projects = $300.00.
b. Permit Fee for small projects (public improvements of $20,000 or less) = $150.00.
c. Permit Extension = $100.00.
2. Construction Inspection Fees
a. Trench Excavations = $60.00 for the first 100 linear feet or portion thereof, plus $0.60 per
linear foot over 100.
b. Pipeline Installations = $60.00 for the first 100 linear feet or portion thereof, plus $0.60
per linear foot over 100.

Katie,
I have attached a picture of the existing box culvert and headwall that the
irrigation headgate has been installed into. As you can see, it is quite an
asthetic box culvert and extensive in design, we don't want modify it if at
all possible.
Please call me if our previous discussions regarding connecting to the
existing headgate pipe, and shifting the piped flows directly into the new
channel location would be acceptable.

I am attaching a Adobe file of the proposed parks trail extending through
the project irrigation ditch right-of-way. I hope that this file works for
you I tried it and it seemed really clear and I thought this might be the
easiest way to convey the information to each of you. It should plot out on
24x36 paper as well.
Please feel free to conference me in to discuss the layout. And feel free
to share the picture with others around you.
For those of you who are unfamilar with this project, it is a low income
elderly (HUD sponsored) affordable living community located south of Seneca
and W Horsetooth. Due a multitude of site restrictions such as oversized
detention facilities, design for a 8-foot wide trail has become very
difficult. The ditch company representative has stated that there is
possibility in sharing the ditch right-of-way, so the idea of a "Pedestrian
bicycle Public Trail Easement" within the ditch company right of way may be
a solution that would make everyone involved happy.

JVA has completed the design of the above referenced project and has located fire
hydrants with maximum spacing of 600 feet along the Kunz Court, the proposed street
within this project. A variance request for a cul-de-sac exceeding 660 feet in length
has been requested. Per PEA requirements, all buildings located beyond the 660 feet
will be fiilly sprinklered. It is our understanding that buildings located within the first
660 feet are not required to be sprinkled since they have been placed such that aces
to the middle rear of the building is located within 150 feet of the adjacent street. It is
our understanding that information provided herein meets all requirements for
approval by Poudre Fire Authority.

TSP Five Architects has some different ideas on the law and obligations to The Pleasant
Valley and Lake Canal Company than I do.
If this project is still being pursued, I need to have The Pleasant Valley and Lake Canal
Company brought up to date.
Perhaps I've overlooked some contact, but it looks like three months have gone by from our
comments and even a call from TSP, so we don't know the status. We do expect there will not be
any interference with the ditch, headgates, weir, and laterals without The Pleasant Valley and Lake
Canal Company's approval. (Any approval must be in writing.) Please call Susan Dinkel for any
scheduling, or if she's out of the office, ask for me.

Dear Katie:
On behalf of the VOA, JVA requests the following variances from the City of Fort Collins
Engineering standards:
JVA requests that the required water quality capture volume of 3484 cubic feet (08 acre-
feet) be included in the required 100-year detention volume provided. A water quality outlet
will be installed at this pond and connected to the storm sewer crossing the site.
The Brook Drive Right -of -Way was identified as an emergency drainage overflow
conveyance path for the Westfield Park detention pond located west of the proposed project.
The Stonnwater Utilities Department required that the drive cut at the intersection of Brook
Drive be designed such that the overflow would not create a ponding in the parking area.
JVA requests a variance for the modified driveway cut as shown on the plans.
A parking setback of 20-feet instead of the standard 40-feet is requested. In discussions
with Traffic Engineering department regarding this request, it was agreed that, due to low
traffic volumes, this would be an acceptable proposal.
Kunz Court has been designed with a total length of 843-feet. A variance is requested for a
street ending in a cul-de-sac over 660-feet in length. All buildings beyond the 660-feet have
been fire sprinklered. Pool Fire Authority has reviewed the plans and a copy of the
approval letter is attached.

c. Note that there is also a Pavement Impact Fee, which is a third component of the Street

published in Chapter 7.5, Article IV, of the City Code. The Pavement Impact Fee is not an
administrative fee set by the City Manager.
5. Affordable Housing Exemption. Affordable housing projects shall be totally or partially exempt
from the fees authorized in this memorandum according to the following criteria:
a. The fees shall be entirely waived for development projects in which at least fifty-one (51)
percent of the dwelling units are available for rent or purchase on terms which would be
affordable to individuals earning eighty (80) percent or less of the median income of city

Dear Mr. Tone,
In response to your variance requests for the VOA project, the requests for parking setbacks and the
driveway cut are denied until further information is provided as required in the Larimer County Urban Area
Street Standards under Section 1.92. For the cul-de-sac length request, the copy of the Poudre Fire
Authority letter is all that is required (please send this to me, it was not attached to the variance request
letter sent July 25, 2001), since the longer length does not require a variance if the residences are fire
sprinklered and PFA approves. The stormwater variance request should not be submitted through me, but
rather should be included in the drainage report sent to Stormwater.
If you wish to appeal this denial, please note that you have 10 days to do so as outlined in 1.9.2.E of the
Latimer County Urban Area Street Standards.

I have gotten some answers that you requested at our meeting on August 16th.
Regarding Horsetooth:
1 The curb and gutter should tie in as a straight line between the existing curb and gutter to the west and
the existing curb and gutter to the east at the church at the corner of Horsetooth and Shields.
2 For the offsite design to the east, both flowlines will need to be shown. These will probably be the
same and can be shown as such on one profile if they are.
3. Both for Horsetooth and for Kunz and Brook Drive: The signing and striping plans can be at a scale
other than 1:30, provided they are clear and easy to read.
4 Along your frontage, curb and gutter can be built now to assist with drainage.
I am waiting to receive details for the Transfort pad and the design of the bike/ped trail in the ditch. I will
forward these to you as soon as I receive them.
The pedestrian and bicycle trail within Brook Drive ROW is being required by Transportation Planning.
This trail should be 8' wide and connect the Brook Drive stub to Richmond Drive. The 500' offsite design
of Brook Drive will not be required, but design for the stub must still be provided. (The design of Brook
should take into account the future crossing of the irrigation ditch, that will need to be piped underneath,
just offsite.)
I wanted to bring up the issue of 50' vff. 100' cross -sections on Horsetooth. Looking back at my phone
log, I can see two conversations in mid -June where Curtis and I discussed this issue. The first time, I
stated that 50' cross -sections were needed on arterials. The second time, we were discussing the off -site
design, and although my notes do not state exactly what was said, I believe I told him that 100'
cross -sections would be acceptable only for the off -site sections. I apologize for any confusion resulting
from that conversation.
To clarify: I am asking for 50' cross -sections on your on -site frontage, and 100' cross -sections for your
off -sites.
If there is any information that you requested at the meeting that I have not mentioned above, please
remind me and I will work to get it for you.

RE: VOA pedestrian connection comments

As part of my comments for Project #14-01 Fort Collins Volunteers of America (VOA)
Elderly Housing, I requested if ROW along the proposed alignment of the future
connection of Brook Drive could be used to provide at minimum a pedestrian/bicycle
connection to Richmond Drive in the Skyline Acres subdivision. I based this request on
the following criteria:
No sidewalk connection currently exists along Horsetooth from the site's frontage to
Shields (the nearest north/south arterial street). As a result, no complete pedestrian
connection to Shields exists along the southern portion of Horsetooth. Note: this site
has agreed to provide sidewalk connection to the existing sidewalk to the west and in
their frontage.
No roadway connection along the Brook Drive ROW was being required by the City
at this time. In lieu of a roadway connection (for topographical or other extenuating
circumstances), the City may ask for a pedestrian connection to satisfy Pedestrian
Level Of Service (LOS) requirements for continuity of the existing sidewalk system,
and connectivity to proximate areas of activity. These are explained in the Multi -
modal LOS Manual, pages 8-9. Adherence to multi -modal LOS standards are
required as part of the Transportation Impact Study guidelines.
This development is planned to serve as an affordable housing project for senior
citizens. It is designed with pedestrian circulation in mind (internal to the site).
Making this connection to Richmond via the Brook Drive ROW would allow
pedestrians a safer route to the commercial activity centers at Horsetooth and Shields.
Not making this connection would make pedestrians from this site either walk along
the southern portion of Horsetooth with no sidewalk facility or cross a busy 4L
Arterial at mid -block to access the sidewalk on the north side.

Based.on my meeting yesterday with the designers and others concerning the VOA project, the
designers indicated a need for 3 variances for the project, as follows:
1. LUC 3.6.3 (C) requires 1320-ft spacing for potentially signalized collector or local street access to
arterials. I do not think this applies to Kunz Court, since it must be aligned with the existing Seneca
Street intersection with Horsetooth Road. No variance or modification should be necessary in order to
approve the Kunz/Horsetooth intersection location as designed.
2. LCUASS 19.3.1 and Standard Drawing 19-03 --- I feel that the 20-ft parking space setbacks shown
on the plans will not present a hazard to public safety, so I agree to grant a variance to the apparent 40-ft
requirement in our standards, in this case.
3. LCUASS Standard Drawings 7-29 A & B --- The SW parking area will also serve as an overflow
conduit for the stormwater detention pond to the west. Therefore, it makes sense to allow the drive
approach design shown in 7-29 B in order that the potential storm flows remain within the paved area.
Using 7-29 A would create in effect a dam at the sidewalk crossing. If a variance is necessary to use the
7-29 B design for that one parking lot, then I will authorize it.
Let me know if you have any questions on these. In the interest of time, it will not be necessary for the
designer to submit variance requests for these items. If other design details come into question over
conflicts with our standards, please let me know immediately. As usual, granting of these variances will
not be used to set a precedent for other similar variances on other projects. The standards remain as
written until changed.

RE: VOA Update
1. Variances. I have instructed staff by e-mail memo to authorize the variances discussed in
Wednesday's meeting. A copy of that message is attached.
2. Brook Drive Bike/Ped Connection to Richmond Drive. Various Land Use Code (LUC)
references, as well as the Level of Service (LOS) Manual, provide the basis for this
requirement. The following LUC sections apply:
• 3.2.2 (A) & (B)
• 3.2.2 (C) (1) (b)
• 3.2.2 (C) (7)
• 3.6.3 (B)
• 3.6.4 (refers to the LOS Manual)
• LOS Manual pages 8-10 are attached for reference
The requirement will be for an 8-ft wide, asphalt paved bike/ped trail between Brook Drive
and Richmond Drive, within existing City right-of-way. In order to help with the design of
this trail, we have provided plans of this area that were created with the storm drainage pipe
that was installed there a few years ago. That should help the designer complete the
drawings of the off -site bike/ped trail from Brook Drive to Richmond Drive.
3. Street Oversizing Fees. Revised as follows:
• City Street Oversizing fees S 35,530.03
• County Regional Road Impact Fees $ 6,780.00
TOTAL S 42,310.03
4. Horsetooth Road Improvements. Design and Construction Required. We were able to locate
design information for Horsetooth Road that had been done in the past with an earlier
development. We provided copies of that to the designer, to be incorporated into the VOA
designs and plans without further surveying and with minimal design efforts.

The Developer 'will be required to construct curb -and -gutter and sidewalks along the
Horsetooth Road frontage, at the appropriate location to accommodate the future ultimate
arterial street width of Horsetooth Road. Cost of paving will be estimated by the developer,
validated by the City, and that amount contributed as payment in lieu of installing the
pavement. Road base will be placed between the new gutter and the existing edge of
pavement.
5. Planning Staff Comments. VOA requested relief from two comments issued by CPES staff.
(I) a suggestion for an eight foot fence and plantings to mitigate a "tunnel" effect between
building fronts and a side yard; and (2) concrete stoops at unit entries to provide a minimal
hard surface outdoor space for residents. While both of these suggestions would enhance the
livability of the project, neither is a Land Use Code requirement. Greg Byrne has advised the
architect (Jennifer Thong) that they need not comply with them.
6. Other Requirements (prior to construction).
• Final Utility Plans. After project approval by Current Planning, the final design details
will need to be completed and entered on the utility plans. Mylars will be provided for
signature by Utilities, Engineering, Traffic, Parks and Natural Resources Departments.
• Development Agreement. Our development review civil engineer for this project, Katie
Moore, has begun drafting the development agreement. We will provide the Developer a
draft within the next 2 weeks.
• Plat. The Developer should have all the information necessary to complete the plat.
• Coordination Meeting. To be scheduled when contractor has been selected, final utility
plans have been approved, development agreement is finalized, and plat is being
recorded.
• Development Construction Permit. Fees will be waived for construction inspection and
the permit administration fee, based on the fact that this is an affordable housing project.
However, the developer will need to post a bond, letter of credit or other suitable security
to guarantee the installation and maintenance of the public improvements being
constructed.
7. Projected Schedule, The Developer plans to resubmit plans to the City on September 19,
2001, assuming all comments have been addressed. They also plan to simultaneously submit
all plans to FIUD. Then the processing at the City and at HUD can proceed in tandem:

b. The fees shall be reduced by one-half ('/z) if at least fifty-one (51) percent of the dwelling
units within the project are available for rent or purchase on terms which would be affordable
to individuals earning more than eighty (80) percent but less than ninety-five (95) percent of
the median income of city residents, as adjusted for family size, and paying less than thirty
(30) percent of their gross income for housing, including utilities.
c. In order to determine whether a development project is eligible for a total or partial waiver
of fees under these criteria, any applicant seeking such total or partial waiver must submit
documentation evidencing the eligibility of the development project to the City Engineer, who
may, upon review of such documentation, defer the payment of said fees to such time, if at
all, that a certificate of completion is sought for the development project. At that time, prior
to the issuance of any certificate of completion for the development project, a final
determination shall be made by the City Engineer as to whether the development project
qualifies for a total or partial waiver of the fees. In the event that the City Engineer
determines that the development project does not so qualify, all such fees shall be due and
payable prior to the issuance of the certificate of completion and acceptance for the
development.

You are correct. If the project is 100% affordable housing, then they are exempt from the fees you
mentioned, as well as the bonding requirements associated with the construction and maintenance/repair
guarantees. LUC 3.3.2(C)(4) covers the affordable housing security exemptions. The fee exemptions are
covered in the March 1999 memo to/from the City Manager. If you have documentation from Maurice that
verifies that this is an affordable housing project, just make sure that is included in the official project file
Without the financial security, it makes it very important that the inspector does a good job of insuring that
all construction meets our standards. Also, the maintenance and repair guarantees must still be signed by
the developer/owner on the plat and the DA. It is important that the project be treated like any other in
terms of legal agreements, design and inspection. It's just that the developer's guarantees will not be
backed up by bonds or letters of credit.
Also, the developer has the option of deferring payment of the Street Oversizing fees until CO time (rather
than building permit). You may want to talk to Matt about that - I don't see that option being used very
often.

This morning, I met on the VOA Elderly Housing project site with Rhonda
Henson, City Engineering Inspector, Kevin Tone, JVA Engineering (VOA's consultant),
Don Watkins of Eidos Architects (a second VOA consultant), and several neighbors who
live to the cast. One item we discussed was a problem with the neighbors' irrigation
laterals in relation to the concrete pipe that runs north -south under the Brook Drive
ROW. As constructed, the property owners on each end of this pipe both lose irrigation
water down the pipe, since it is placed in a low spot. Kevin Tone, a representative of the
Developer's engineering consultant, JVA, only realized today that the pipe is not needed;
that while originally the lateral ran north -south connecting all properties east of the VOA
project, this section in the ROW is the low spot and the lateral could have been removed
From the ROW and dammed at each end with no ill effects. The pipe is not needed to
transfer water from the property to the north to the property to the south or vice versa.
Unfortunately, this was not discovered prior to construction of the pipe. Now there is a
large concrete pipe for a private utility in the public ROW that has no use and therefore
needs to be removed.
Leaving the pipe in the ROW and flow -filling it or damming either end would
only leave the cost of removal of the pipe to another party, either the future developer
who extends Brook Drive, or the City, neither of whom should be made to bear this cost.
It has been suggested to the City that the City should pay for the removal of the pipe
since it appears on plans approved by the City. Please note the standard disclaimer on the
front of the plan set: "These plans have been reviewed by the local entity for concept
only. The review does not imply responsibility by the reviewing department, the local
entity engineer, or the local entity for the accuracy and correctness of calculations.
Furthermore, the review does not imply that quantities of items on the plans are the final
quantities required. The review shall not he construed in any reason as acceptance of the
financial responsibility by the local entity for additional quantities of items shown that
may be required during the construction phase." It is the Professional Engineer who
stamps the plans, in this case Kevin Tone. who is responsible for the designs shown on
the plans.

It is unfortunate that this mistake was not caught until now, but now is the time
for the mistake to be corrected. Please have your contractor remove the concrete pipe
from the Brook Drive ROW, and have JVA submit record drawings to the Engineering
Department showing what was done. Until the pipe is removed, the trail repaired, and the
record drawings completed, Engineering will not release Certificates of Occupancy for
the project.

As we have previously discussed on the phone, the Owner of the irrigation lateral which is
south most on the site adjacent to the West IIorsetooth Road right-of-way wishes to revise
the irrigation lateral from a steel plate covered concrete channel to a piped System with
manhole type sumps.
He has requested this revision since he feels it will be easier for him to clean and maintain
," ti ,<<"Y• this piped system rather that the concrete channeled system since the channel would achieve
depths of 4 to 4 '/z' at certain locations and would be difficult to clean with a shovel. The
currently proposed system would provide invert elevations of the pipe above the bottom of
the manholes so that sediments and trash would drop out and could be cleaned out at those
locations. In order to accommodate this revised system, the current 3' wide irrigation lateral
easement would need to be increased to 6' in order to accommodate the diameter of the
manholes and not impinge upon the West Horsetooth right-of-way or the adjacent utility
easement. We would therefore propose revising the irrigation lateral easement to 6' wide and
to realign the fifteen foot utility easement that runs parallel and south of the irrigation lateral
easement 3' further to the south. Attached is an Exhibit showing the proposed change to the
easements and also civil drawings showing the changes to the irrigation lateral system.

The purpose of this meeting was to discuss with the representatives from various
departments in City of Fort Collins, the issues that had come up recently while the Project
Development Plan submittals were being developed. The following are items discussed and
noted in this meeting:
1. The City would like the south portion of W. Horsetooth Road, located north of this
property and from the east to the west boundaries of this property, be widened from
having a 30ft. R.O.W. to having a 50ft. R.O.W. as part of the development of this
project. The north boundary of this property is located in the center of W. Horsetooth
Road. The north portion of this road had already been widened previously. The work
would include additional asphalt paving, new concrete curbs, gutters and sidewalks,
relocating and/or replacing some existing trees located along the existing R.O.W.
and relocating an existing irrigation line and headgate. The City would be
subsidizing half of the cost of the development, but VOANS would be responsible for
funding the full amount initially. TSP and JVA would provide Matt Baker from the
Street Oversizing Department, with a cost estimate for this work as part of the PDP
submittal and also show that the work had been done through a competitive bid
process.
2. Ward Stanford from Traffic Operations said that an acceleration or deceleration lane
would not be necessary on W. Horsetooth Road. The traffic study required for the
PDP submittal would determine whether a right -in and right -out would be necessary
for the single point of access into the property.
3. Tom Reiff from Transportation Planning suggested that TSP contact the transit
company to add service to this property.
4. We are to show a proposed future 8' wide concrete pedestrian/bike path along the
west side of the property on our development plans. We are also to include a couple

Dear Ms. Henson,
On July 31, 2003, I meet with Bob Davidson and hen Orgoglioso regarding the
Options I hade sent to them and yourself regarding the asphalt trail alignment at
Brock Drive_ They both indicated that Option B be would be acceptable with one
revision. Mr. Davidson asked that the fence at the south side of the trail extend to
Richmond Drive and that a 16' gate (or two 8' gates) be installed at this point. He
also asked that a volunteer cottonwood tree be relocated. A revised Option B is
attached.
This has been reviewed by Brown Construction and they have indicated that they can
provide this revised scope of work as Under their original bid amount. Please let me
know if this is acceptable to the City of Fort Collins and if any further documentation
is rC(Iuired.

Dear Rhonda,
I did share with Katie Moore my correspondence to you regarding the resolution of
the asphalt path at Brook Drive and the acceptance of the land owners to either side
of the right-of-way of Option B. In reviewing this with Katie however, she indicated
that the City will not allow for two fence lines to be installed at the right-of-way.
Therefore Option B would not be viable unless the southern property owner were to
move the new fence line entirely on to his property, thus negating the availability the
southern portion of the right-of-way for his use as pasture. Based upon this I am
assuming he would not be in favor of that solution. Therefore, unless there is another
option you wish us to pursue, we will proceed with the Scope of Work previously
approved by the City which will entail moving the fence line to the north, relocating
or replacing existing trccs and installing the path at the center line of the right -of -
Way.
If you could please let me know by August 201h if you would like to pursue other
�utions.

Dear Mr.Tone,
This letter is in response to your request for a variance to the Larimer County Urban Area Street
Standards. The variance requested was a reduction of required cover over a pipe to the bottom of
subgrade from 2 feet to 16 inches, mitigated by overexcavating all areas of the ROW by a minimum of a
foot and bringing in imported structural fill to reach the final design grade. This variance has been
approved by the City E=ngineer only at the location of the northern irrigation lateral where it crosses Kunz
Court.
As with all variances to the street standards, this variance granted for this project is based on the particular
situation under design and the judgment that we (the designer and the City) apply to determine whether
there is a public safety concern. This variance for this project in no way sets any precedence for relaxing
these standards on other projects without complete analysis and justification.

This morning, I met on the VOA Elderly Housing project site with Rhonda
Henson, City Engineering Inspector, Kevin Tone, JVA Engineering (VOA's consultant),
Don Watkins of Eidos Architects (a second VOA consultant), and several neighbors who
live to the east. One item we discussed was a problem with the neighbors' irrigation
laterals in relation to the concrete pipe that runs north -south under the Brook Drive
ROW. As constructed, the property owners on each end of this pipe both lose irrigation
water down the pipe, since it is placed in a low spot. Kevin Tone, a representative of the
Developer's engineering consultant, JVA, only realized today that the pipe is not needed;
that while originally the lateral ran north -south connecting all properties east of the VOA
project, this section in the ROW is the low spot and the lateral could have been removed
from the ROW and dammed at each end with no ill effects. The pipe is not needed to
transfer water from the property to the north to the property to the south or vice versa.
Unfortunately, this was not discovered prior to construction of the pipe. Now there is a
large concrete pipe for a private utility in the public ROW that has no use and therefore
needs to be removed.
Leaving the pipe in the ROW and flow -filling it or damming either end would
only leave the cost of removal of the pipe to another party, either the future developer
who extends Brook Drive, or the City, neither of whom should be made to bear this cost.
It has been suggested to the City that the City should pay for the removal of the pipe
since it appears on plans approved by the City. Please note the standard disclaimer on the
front of the plan set: "These plans have been reviewed by the local entity for concept
only. The review does not imply responsibility by the reviewing department, the local
entity engineer, or the local entity for the accuracy and correctness of calculations.
Furthermore, the review does not imply that quantities of items on the plans are the final
quantities required. The review shall not be construed in any reason as acceptance of the
financial responsibility by the local entity for additional quantities of items shown that
maybe required during the construction phase." It is the Professional Engineer who
stamps the plans, in this case Kevin Tone, who is responsible for the designs shown on
the plans.

It is unfortunate that this mistake was not caught until now, but now is the time
for the mistake to be corrected. Please have your contractor remove the concrete pipe
from the Brook Drive ROW, and have JVA submit record drawings to the Engineering
Department showing what was done. Until the pipe is removed, the trail repaired, and the
record drawings completed, Engineering will not release Certificates of Occupancy for
the project.

I am writing this letter as a statement of planning objectives as required by the Project Development Plan
submittal requirements.
We are proposing a 60 unit elderly housing multi -family residential development on an 8.69 acre property on
the south side of West Horsetooth Road approximately 1500' west of South Shields Street. The site, zoned
LMN, Low Density Mixed -Use Neighborhood, includes a portion of the Pleasant Lake & Valley Irrigation
Canal, which also forms the westernmost boundary of the site. Adjacent to the site to the east lies the existing
Skyline Acres estate lot single family residential neighborhood, while the still developing Westfield Park
PUD single family residential neighborhood lies to the west. To the south, across the protected Apache
Forest, is the existing Mountain Ridge Farm PUD single family residential neighborhood.
This proposed development will be constructing an access drive into the site, according to the City of Fort
Collins street standards for a residential local street, with the exception of widening the access lane from the
city standard from 16' to 20'. The 20' access lane will comply to the Poudre Fire Authority requirement for
an unobstructed 20' fire lane_ A letter is included with this Project Development Plan application to the
Engineering Department explaining the alternative compliance to the city street standards. This access drive
will be platted and dedicated as a public street, with 9' utility easements on both sides of the street as
required. This public street will also include detached sidewalks with complete handicap accessibility and
striping to delineate pedestrian paths that cross parking pods or the public access drive.
This proposed development is providing a 50' buffer zone against the east side of the Pleasant Lake & Valley
Irrigation Canal with occasional encroachment to 40'. This area will incorporate native grasses and will not
be in igated. Transition zones will occur to blend the irrigated landscaped area of the development to this
buffer zone_ The protected Apache Forest at the south portion of the site will be preserved and the proposed
development will be approximately 235' from the 100' Apache Forest easement, thus allowing a 335' buffer
zone to the south property line. The proposed future phase will still allow an approximate 160' buffer to the

The puq;tose of this meeting was to discuss the culvert beneath the Brook Drive right-
of-way, water intrusion problems along the bike path and grading issues along the east
property line.
The following items are of note:
1. The culvert installed across the Brook Drive right-of-way is intercepting irrigation
wate rs for the property of Ken Orgoglioso and conveying these waters to the
property at the south side of the Brook Drive right-of-way which prevents proper
irrigation of Ken's pasture. At this time the culvert end has been dammed to
prevent this flow. After review by Katie Moore, it was noted that since the property
owner to the south receives his irrigation waters from a different source, the culvert
is not needed for irrigation purposes and is superfluous. Based upon this is was
suggested that the culvert be capped at either end to prevent animals from using the
culvcTt. Rhonda indicated that a section of the culvert should be removed up to the
new bike path and the remaining section filled with flowable fill. Don asked if the
culvert could simply be capped at each end and left in place so VOA does not incur
demolition costs. Katie noted that this is a private improvement in a public right-of-
way, that the city would not want to be responsible for the cost of removing the
culvert at some future date if Brook Drive road improvements were pursued and
that possibly the entire culvert should be rcmoved. Don asked if this could be
reviewed and Katie noted she would review this situation with others at the City
and get back with him.
It was noted that irrigation waters from Ken's property are running along the edge
of the bike path and ponding onto sections of the path. Ken indicated that he would
improve his ditch system at the SW corner of the site to prevent water from
overflowing to the bike path at that point. This may not solve the problem with
water flowing onto the path at some other location. Rhonda is concerned that the
cond aual surcharge of water onto the path could eventually undermine the pathway.
Ken noted that he would contact the ditch company to ascertain if a test can be
made after he improves the ditch to see if this solves the problem. Other solutions

might require a berm be placed along Ken's south property line to prevent flows
onto the bike path,
3. The grading issues along the east property line were reviewed. Ken noted that he
wWA under the understanding that when the Grading Easement was signed, that
there would be permanent grading revisions made on his property at his west
property line but rather the easement was only to allow temporary access for
conGtruetion activities. This issue aside, he was concerned that the new
embankment at his west Property liRe would result in erosion onto his property that
woWd result in depositing soil in his irrigation ditch. He would like to see a
retaining wall installed to take up the grade differential. Katie noted that since this
condition is on private property, the city would have no requirements for the
mammun slope of the embankment.

Pursuant to our phone conversation on July 2, 2004 we discussed installing a metal
plate or grate cover over the top of the mid -irrigation channel that runs east -west across
the site. The purpose of the installation is to address a perceived safety issue. This
installation would be similar to the installation for the north irrigation channel that was
originally proposed prior to that lateral being changed to a. piped condition. You
indicated that this would be acceptable to the city if it were acceptable to the neighbors
that have rights to the irrigation channel. We have additionally checked with these
neighbors and they are okay with the proposed installation.

This letter is to update you on the completion of an irrigation ditch to the satisfaction of the
neighbors. It is our request that you release the contractor, Brown Construction, from its
bond with the City of Fort Collins.
We installed 160 feet of plastic irrigation piping and covered it with soil. At the upper head, there
is a bend in the irrigation ditch. At that bend we installed a concrete transition to prevent erosion.
That concrete transition was covered with a removable gate, allowing access. The upper head,
which is controlled by the water coop, was raised five inches in order to ensure a good flow of
water through our site.
The neighboring property owner, Lewis Bollman, is pleased with this overall improvement as you
can see from the enclosed letter. As you found in speaking with your colleagues, Mr. Bollman
was the only neighbor to express concern over the previous plans for an irrigation ditch, so I
request that you release the contractor from its bond with the City of Fort Collins. The work is
complete and can be inspected, if you need to see it.

Apache Forest easement, still allowing a 260' buffer. This buffer zone, beyond the required trees and
landscaping as outlined in the Land Use Code, will likewise be incorporated as native grasses which will also
not be irrigated.
Landscape plantings proposed for this development have been designed to the best extent possible to comply
with the City of Fort Collins Land Use Code landscaping requirements. Deciduous street trees have been
incorporated at the spacing required and additional deciduous trees have been added to south and west sides
of buildings where allowed to provide summer shade and winter sun. In addition, more dense shrubs have
been planned to be installed at the ends of parking pods to filter vehicular headlights from spilling onto
adjacent properties. Low plantings have also been included along a minimum of 50% of the length of
building facades facing the public residential local street.
Vehicular circulation will be provided by an internal access drive and parking pods between the dwelling unit
buildings.
Currently, three open irrigation ditch laterals pass across the site, historically allowed by a previous property
owner. The lateral residing closest to West I lorsetooth Road is being routed into an underground 12" PVC
line and a 10' casement will be provided, concurrent with the 15' utility easement provided adjacent to the
widened West I Iorsetooth Road right-of-way. The existing middle irrigation lateral is proposed to be
abandoned, while the southernmost existing irrigation lateral will be relocated, remaining an open ditch and
provide water for all customers previously serviced by the middle and southern irrigation lateral.
A couple of alternative compliances are being proposed as outlined and explained in a letter to the
Engineering Department included in this Project Development Plan application.
A neighborhood meeting will be held at Johnson Elementary at 4104 Seneca Street on March 12 at 7:00 P.M.
This development is being funded and will be managed by Fort Collins Volunteers of America Elderly
Ilousing, Incorporated. There are to be two employees working on site, one manager, living in one of the
units, and one maintenance/groundskeeper, living off -site.
This proposed development will provide affordable housing for elderly citizens and will be federally
subsidized by the Housing & Urban Development (IiUD) to allow residents to afford rent according to a
percentage of their income.

As you know, we served for this meeting as representatives of Skyline Acres which is the
area immediately to the East of the planned development.
As we explained to you this morning, we are concerned about the proposed changes in the
location of the three laterals which serve our properties from the Pleasant Valley and Lake canal.
According to plans submitted by the developer and from our discussions with them, it
appears that it is their intention to close and abandon the middle lateral which serves six of the
lots from headgate number 121. In their plans, they indicate that the water for these lots will be
taken from headgate no. 122 near the south end of their property and then routed north along the
west end of our properties between the proposed development and the lots to the east.
This plan is not acceptable to the Skyline Acres lot owners. First, in order to bring the
water back north from the 122 lateral, a ditch would have to be constructed well above the
present elevation of the area along the lot lines. Second, during much of the season, water is
taken from all three laterals at the same time. It would simply not be possible to supply all the
water needed for more than one lot simultaneously from one lateral in an equitable manner.
Third, In this area, there is a heavy clay layer at approximately 10 feet below the surface. We
must be very careful in how much and for how long the irrigation water can be applied to the
pastures in order that the basements of our houses do not get flooded. Even if it were possible to
combine the water from headgate 121 and 122 into a single lateral, having this much water in an
enlarged lateral would make even worse the problem of water in basements. Fourth, we are
concerned about any modification of the currently adequate flow of water all the way from the
headgates to the east end (Shield Street) of the properties on the east side of Richmond Drive.

According to the project drawings, the location of the community building as planned is
directly over the lateral from headgate 12l .It may be possible to change the location of this lateral
a small amount to go around this building. However, we feel certain that this lateral must be kept
in the same general vicinity as it now exists and for which we have a right-of-way.
A second problem concerns the project plans to bury the laterals in pipe. The use of
underground pipe laterals is unacceptable. Over time, pipes carrying irrigation water from P.V. &
L. Canal will fill with soil and sand, plugging the pipes. An acceptable alternative will be to use
concrete lined, rectangular box laterals with metal grate covers which can be removed for
cleaning.
As we told you this morning, we have attempted to meet with Curtis Kosticki of the
group preparing the housing development plans. To date, however, no meeting has be held, with
Mr. Kostecki saying that they have other problems with higher priorities that must be handled
before they can turn their attention to the irrigation laterals.
We trust that this letter correctly summarizes our meeting of this date.
