Dvorak TST, Inc.748 �'� c ✓ �s �� I���p�t V�/ For Collins Building D s,COO80525 Dear Richard: { The following are the revised Natural Resources' requirements necessary for obtaining the easement for construction of the Fort Collins -Loveland Sanitation District's sanitary sewer line on the Cathy Fromme Prairie Natural Area: Xrc u tr j� 1. Construction must take place outside of the normal period x(vhen birds of prey use the site for a winter feeding area (to avoid disturbing 4agles and hawks) and when prairie dog pups ar;Telow ground (prairie dogs cannot be relocated at that time). Thus, construction can only take place from July 15th through October 15th.4,� y,yv ccc s`irn ^ audi5) -- 2. The Developer must contact the Corps of Engineers to obtain a 404 permit and/or the project shall be cleared by the Corps of Engineers. Copies of the permit, or the letter of clearance from the Corps, shall be submitted to the Natural Resources Department and to the Utilities prior to any construction start. 3. The limits of development where all work will be conducted shall be shown clearly on a plan which includes existing -man made features and stream channels on the Cathy Fromme Prairie. This plan shall be submitted to the Natural Resources Department for approval prior to any construction start. Access points for vehicles shall be shown on the plan. Preferred access is through the Ridge Subdivision to avoid damage to pavers in the Shields Street parking lot and to the concrete trail. Temporary signs shall be posted informing the public that this is a Fort Collins -Loveland Sanitation District/Development project, and indicating the purpose of the project and the District's and Developer's phone number. Signs shall be posted at the Ridge Subdivision where construction will take place, the Shields parking lot, and on the trail where the line will cross. 4. Construction will be taking place through an area where the Natural Resources Department has an ongoing research project to study relocated prairie dogs. 1 �Sl V. College A%e. • PO. Box ;00 • Fort Collins, CO 50522-05F0 • (970) 221-6600 •FAX (970) 224-617 Once limits of disturbance have been determined, and at least 4 weeks prior to construction, the Developer must meet with Natural Resources staff to clearly mark in the field where this area is. Natural Resources staff will then move prairie dogs out of the construction area prior to the start of construction. 5. An erosion control plan to protect both Fossil Creek tributaries shall be developed. Along the southern tributary, this shall include a silt fence between the creek and the excavation. At the north tributary crossing, a sump shall be established upstream of the crossing, and the water in the creek pumped around the disturbance area through piping while construction is ongoing. Because of the steep slopes into the creek at this location, silt fencing, blankets, and/or other BMP's should be utilized -to minimize sediment transfer from the completed trench backfill into the creek until it has been stabilized with vegetation. The erosion control plan shall comply with the City Storm Drainage Design Criteria and Construction Standards, and shall be reviewed and approved by the City prior to construction. Wetland and upland soils shall be stockpiled separately and placed in an 8 inch layer on top of subsoil in the corresponding zone when construction is completed. 7. No more than 400 feet of trench shall be open at any given time, and all trenches shall be backfilled and compacted by the end of work each day. Soils in backfilled, compacted, topsoiled trenches shall match the grade of the surrounding, undisturbed prairie. 8. Backfill in trenches shall be compacted to 95% Standard Proctor Density. Testing of compacted soils shall be done by the Developer at regular intervals vertically and horizontally within the area of excavation to ensure that this requirement has been met. The City shall receive all lab Proctor density results, and a copy of all field compaction tests. Sufficiency of the number and location of Proctors and compaction tests shall be determined by the City. After compaction to final grade, the top 6 inches of the subsoil shall be ripped, and previously stripped and stockpiled topsoil materials spread evenly over the disturbance areas. 9. All existing manholes from the abandoned 8-inch line shall have the upper sections removed and then be filled with soil. This soil shall be compacted to 95% Standard Proctor Density to prevent settlement. All new manhole covers shall be set flush with the finished topsoil surface. 10. All settled areas along the existing pipeline to be abandoned shall be brought to grade (match surrounding topography) during construction of the new pipeline. 2 The Developer at no cost to the City shall repair any settlement that occurs over the existing or new pipelines after completion and acceptance of the project by the City to the satisfaction of the City. Any necessary repairs shall be conducted in a manner and at a time directed by the City. 11. All disturbed and topsoiled areas shall be seeded with a seed mix of native species specified by the City. The seed shall be drilled into the soil at an appropriate depth for the species in the mix using a range drill (not a Brillion). All seeded areas shall then be hydromulched per City Storm Drainage Design Criteria and Construction Standards. 12. The Developer shall be respocsible for all seeded areas for a minimum of two (2) growing seasons from the ciete of completion or until the following plant establishment criteria is meet. All seeded areas shall be inspected jointly by the Developer and the City at specified intervals. Areas seeded in the spring shall be inspected for required coverage the following fall not later than October 1 st. Areas seeded at any other time shall be inspected the following two summers not later than August 1. The required coverage for the first inspection shall be ten (10) viable live seedlings of the specified species per 1000 square centimeters (approximately one square foot), or fifty percent (50%) coverage of the specified foliage as measured from five feet (5) directly overhead, with no bare spots larger than 1000 square centimeters. At the time of the second growing season inspection, there shall be seventy-five percent (75%) foliage cover of the specified species planted as measured from five feet (5) directly overhead. No more than ten percent (10%) of the species noted on the site may be weedy species as defined by Article III, Section 20-41 of the Code of the City of Fort Collins. Determination of required coverage will be based on fixed transects each ten meters in length, randomly placed in representative portions of the seeded areas, with plant species or bare ground/rock/litter being noted every ten (10) centimeters along each transect. The Developer shall warrant all seeded areas for two growing seasons from the date of completion. The Developer shall rework and reseed per original specifications any areas that are dead, diseased, contain too many weedy species, or fail to meet the coverage requirement at no additional cost to the City. 13. Any damage to the concrete bike trail or pavers caused by the construction at any location shall be replaced immediately to current trail and paver standards on the Cathy Fromme Prairie, including matching the color of the concrete. 3 14. Any requirements listed above that are not meet by the Developer in a timely manner will be corrected by the City and the expense of the correction plus management costs will be billed to the Developer.
