Dear Mr Barnes:
I am writing on behalf of the First Free Will Baptist church at 320 West
Trilby Road. We are proposing a 6,663 square foot addition to the
existing 3,226 square foot building on their five acre site.
Per 3.8.20(B) of the city land use code, we are complying with the
requirements contained in section 1.6.5 and the applicable general
development standards in Article 3 and the applicable district standards
contained in Article 4 to the extent reasonably feasible. We contend
however that it is not reasonably feasible to comply with section 3.4.1(E)
as this would preclude any expansion of any kind on the site. We are
however sensitive to the ferruginous and red tailed hawks in the area, and
have left the area between our proposed expansion and the hawks
(-510') in natural grasses, and are not proposing any disturbances in this
area We feel that since this only reduces the current buffer by 82' that
the new construction will have minimal impact on the hawks roosting site.
In addition, it would appear that the hawks are not particularly bothered by
human interaction since there are homes within only 100' of their roosting
site, and they chose to locate on a major state highway (287) with all of
the associated noise and activity.

05/21/03 Sheri W. from the City called 11:13am. Ron Gonzales was in her office and asked her to
call and let us know that he informed her that PFA would not need to use the access road and
that the 8% grade is not an issue. He also asked that we make the emergency access 20' wide
where possible. csp
