Dear Bob,
After reviewing staff's comments on Five Oaks Village, Phase II, we offer
the following responses to each concern:
1. Cunningham and Richmond Drive will have a minimum 10 foot easement
along R.O.W.. Both Public Service and City Light and Power have indi-
cated that an 8.5 foot easement along all private drives is adequate
for the installation and maintenance of the service lines. A utility
coordination meeting is arranged for next week with all affected uti-
lities to examine this project in greater detail.

3&4. A Home Owner's Association will be responsible for maintaining the
drainage and detention system.

6. Summary detention information is indicated in Note #14 on the Site
Plan.
7. Warren Jones of the Poudre Fire Authority has agreed that the
emergency access requirement for Buildings R, S and X is within accep-
tible limits.
8. "No Parking" signs on all private drives less than 28 feet is
currently being discussed with the Poudre Fire Authority and Traffic
Engineering Department. You will be kept informed.
9. Changes to easement and property line boundaries will be executed as a
replat.

11. The two major drive cuts for Phase Two are separated by 160 feet.
Given the low volume of traffic generated by this development and the
nature of the surrounding street system, we feel this distance is ade-
quate. This matter is being reviewed by the City Traffic Enqineer.

substantially increased from the preliminary site plan. Three
Austrian Pines have been added to the revised landscape plan.

forwarded to you by December 9. Rendered elevations are on file with the
Planning Department.

Dear Frank:
The staff has reviewed the application for final approval of the Five Oaks
PUD, Phase II, and offers the following comments:
1. The project must have 8' minimum easements on all streets (whether
dedicated or not) with no sidewalk or pavement in easement (excluding
driveways). The 8.5' front lot utility easements proposed on the site plan
do not provide adequate space to allow for installation of both gas and
electric lines. Installation of both gas and electric lines needs to be
coordinated with Public Service and City Light and Power respectively.
2. The Department of Natural Resources would like to offer assistance in
designing the wet pond and detention area.
3. The Home Owner's Association should be responsible for the maintenance
of the drainage channel through the site. This should be stated in the
development agreement.
4. Staff questions who is ultimately responsible for maintenance of the
on -site detention pond, since it serves the entire Cunningham Corners
development.
5. Please make reference to the Phase I plans for detention pond and
drainage channel plans and details. In particular, address landscape plans,
as per Phase I and Chestnut Village.
6. Provide summary detention pond information on the appropriate grading
plan (i.e. 100 year high water elevation and boundary, capacity, release
rate, spillway elevation).
7. Buildings R, S, and X exceed the 150 ft. fire access requirement.
8. All private drives less than 28' must be posted no parking both sides.

10. Vacation of Windmill Dr. must be processed before the project is
approved by the Planning and Zoning Board -- it will go before City Council
on December 3rd.
11. Curb cuts are to be seperated by 200'.
12. All driveway cuts are to be concrete to the property line.
13. Easements must be clearly noted on the site plan (arrows and lines are
missing).

15. Easements for utilities need to be shown adjacent to the driveways. A
replat is preferable to dedication deeds. There will be a charge for it. ,J

17. Parking stall widths and the walk around the cul de sac need to be
dimensioned.
18. Ramps need to be shown at the corner of Richmond and Cunningham, and at
the bike path.
19. Pedestrian access from Richmond to the east driveway needs to be shown

20. The bike path exceeds the easement by building T.
21. The treatment of the bike path at the drainage needs to be stated on

22. Drainage pipes must be in a 20' easement. This may affect the location
of Building Z. It is also an issue between buildings X anq Y, and S and T.

23. Each apartment building must be clearly addressed.
24. Staff would prefer that the street system be named Richmond Drive to
the east property line to minimize confusion during emergency response.
25. All dimensions of building envelopes and distances of envelopes from
property lines need to be shown.
26. Are there designated trash storage areas, or is it left to
individual unit owners where they prefer to store their trash?
27. All signs must comply with the sign code.
28. The wording for owner's and leinholder's certification needs to be

10. Staff would like to see increased landscape screening in the buffer
area between the proposed units and the existing single family homes.
I would recommend we meet as soon as possible to discuss the above
comments. Plan revisions should be submitted no later than Wednesday,
November 27th. PMT renderings and 10 full size copies are due no later
than Monday, December 9th. If you have any questions, feel free to contact
