Dear Roy:
Enclosed please find two (2) prints of the proposed utilities
layout for ;your review and comments. You will note that the
building, locations are quite difficult to service with sewer
and water. May we note that even with an exterior loop
system, the greenbelt area would still have to be entered at,
several points in order to provide service. This is largely
due to the fact that the buildings mechanical layout plan
shows these service connections coming out of the rear center
of the building.
Another problem to consider is, of course, the extra line
costs, and added potential maintenance if an exterior loop
system were employed. Analyzing the system, there would be
several locations in which lines would have to be "douhled-
ap", if this method were used.
'Ne have conferred with Dennis Miller, Landscape Architect, in
respect to potential landscaping problems. He has indicated
that in areas where sewer or water lines are located within
the greenbelt, he can see no overriding difficulties in respect
to line maintenance vs. landscaping.
Another point to bring up is the considerations brought into
view by phase construction. By completing the system as shown
on the prints, Phase I and Phase II are basically separate
project areas, except for the water line serving building //C
(which would. be necessary for Phase II continuation).
Additionally, we have contacted James Stewart in regard to
relocating manholes and providing tees while the Strachen
Subdivision construction is underway. Contracts have been
let on these streets and we should try to promptly provide
the needed information so that line construction in Slower
St. and Stanford Rd. can be coordinated.

We believe that all these points help to reflect justification
in proceeding in this manner. We would greatly appreciate
your comments regarding this matter as soon as possible.

At present there is no danger of root interference with
sewer and water lines, or any necessary manholes.
Please be assured that if in actual field installation a con-
flict does, or mimht occur, we will readily remedy the situation,
throu.-h the relocation of the violatin7 plant material.

Improvement of Stover Street from its intersection
with East Monroe Drive to its intersection with
Horsetooth Road
Gentlemen:
The undersigned HCI, Inc, is obliged to the City of Fort Collins under its Plan
of Development to improve the above referenced section of Stover Street and
the undersigned Bartran Homes, Inc. is contractually liable to HCI for the
payment of half of the cost of such improvement. It is for that reason and to
that extent that Bartran Homes, Inc. has joined in this Letter of Guaranty.
For an extended period of time now we and our engineers, James H. Stewart
& Associates, have been in consultation with the City concerning the desirability
of changing the grade of Stover Street in the area in question. It appears that
we are now near to agreement in this matter, but still before the work is
completed the owners of Foothills Meadows Apartments will need, and may be
denied, Certificates of Occupancy for their apartment units. The Foothills
Meadows Apartments are now adequately served by paved and improved streets
and the best interests of all, including the Fort Collins community, will be
served by re -engineering the section of Stover Street in question.
Therefore, so that Certificates of Occupancy for Foothills Meadows Apartments may
be granted to the extent that would be the case if Stover Street had been completed
at the time the Certificates are requested, the undersigned do hereby guaranty to
the City of Fort Collins that the above described section of Stover Street will be
completed in accordance with the requirements of the City of Fort Collins as soon
as weather permits and in any case on or before July 1, 1974.

Street. once plans for this proposal are finalized and a schedule for construc-

I have your letter of December 13, 1967, regarding paving of
Foothills Apartments.
Your Letter states, "no paving will be permitted on Stover Street,

I have lived in Fort Collins for twenty years and I have always thought
that Stover Street was six blocks East of College and Ran North and South.
I would appreciate very much if you would check the records of the City
and see if there has not been some mistake in this regard.
I was unaware that you had the authority which you prescribe in
your letter. We have no intention of not cooperating with the City in any
paving of public streets. However, I would appreciate it if you would cite
to me the ordinance which gives you the authority to require submission of
a plan and profile for ;)roposed streets.

Dear Mr. Greenberg:
Mr. Jim Pope of Pope Concrete Co., Fort Collins, asked for represent-
atives of the City Engineer's Office to meet him at the jobsite to deter-
mine the extent. of your obligation.
Mr. Greenberg, the City has a reimbursement policy for developers
constructing arterial streets. This is covered under City of Fort Collins
Ordinance Chapter 16, Article 16-20, which allows for the City to reim-
burse for that improvement which exceeds the normal for a residential
street. A residential street, in this case, would include concrete
curb, gutter and four (4) feet wide sidewalk, and twenty (20) feet of
two (2) inch thick asphalt concrete over four (4) inches of selected
base material for the half street. The intersection of Horsetooth and
Stover involves an arterial street (Horsetooth Road). Therefore, the
City would reimburse you for that portion of Horsetooth Road which exceeds
twenty (20) feet in width and four (4) inches base depth as well as three
(3) feet width of the seven (7) feet wide bike path and walkway. In
addition, it is apparent that the curb return on the northeast corner of
the intersection will have to be removed and replaced. The City will
assutre responsibility for this cost. The curb return at the northwest
corner and the concrete cross -pan across Stover would be a part of your
development and, therefore, a part of your expense.
When you have conpleted this work, Mr. Greenberg, please sulsnit a
copy of your invoices to this office for processing and we in turn,
will provide you with our estimate of prorata costs and, upon your final
approval, we will forward to the City's Accounting Office for approval.
If you have any questions concerning any of this, please advise.

Dear Mr. Bingman:
Your Letter sets forth my understanding concerning the require-
ments of the City Council in approving the unit development plan. That is
we were to submit a utility olan for approval prior to construction of sewer,
water and streets. As my notes would indicate there is nothing in the
provision which 1drovides that we get prior approval for construction of the
street.
I have told our contractor, Schmick & Vigor, to comply with your
request. However, I want you to know that I do not believe that we need
to and that if we chose to we could certainly construct our street without
your prior approval.
Approval of utility plan prior to construction of sewer, water and
streets can not be extended on to require that we then get approval of construction
of a street. Our only requirement was that we get the utility plan approved
which we did.
You should be hearing from the Vigor & Schmick Construction Co.

Since come time haw elapsad following the review of plans for your Unit
Development, known as Foothills Apartments, I feel it advisable to write
to you and jog your memorp regarding certain requirements and commitments
in connection therewith.
Because of some urgency on your part the project was constructed before
necessary street dedications and required site and utilit-r plans were filed
with and approved by City Council, the Planning Office, City Engineer and
City Clerk. You have made commitments both verbally and in writing before
public meetings of the Planning and Zoning Board and City Council. It seems
to me adequate time has elapsed and that appropriate measures would be in
order for completing these commritalents.
To be specific, the following requirements wars ircluded in approval of your
plans, both preliminary and final.
a) Dedication of a right-of-way, eighty feet in width for a
Collector Street running from Shields to the west line of your
Unit Development (the Larimer County Canal 02). You and Mr.
McGraw have both stated this was acceptable to you and Colorado
State University officials, providing you knew what width *was
involved. This width has surely been clarifia befara ,meetings
of the Planning and Zoning Board and City Council.
b) The Unit Development Plans were approved, subject to changing
the parking bay which opens directly from the above Collector
Street (known as Stuart Street). Alternative location or design
of the parking lot and curb cuts were to be done. Your company
was aware of these conditions long before an_f concrete work was
in place adjacent to the proposed street.
c) An easement for the Spring Creek Storm Drainage Channel is
another needed item which you agreed to provide. This involves

Dear Mr. Bingman,
This letter is sent to confirm certain terms which were agreed
upon at a joint meeting held earlier this month between Don Reynolds,
City Flanner, and yourself representing the City of Fort Collins, and
Kent Anderson, our engineer, and myself representing Foothills Apartments.
A question was brought up regarding the necessary street grade
profile on West Stuart Street which was required to premit a crossing
at the Larimer No. 2 Canal located immediately west of the Foothills
Apartments complex.
Mr. Anderson and you agreed that it would be necessary to remove
and replace approximately fifty lineal feet of the existing asphalt
along the northwest corner of the apartment site in order to make the
necessary grade revisions to faciliate the Canal crossing. Due to
these contemplated revisions, further curb and gutter improvements in
this area were halted until such time that Stuart Street was extended
across the Darimer No. 2 Canal.
This letter is to confirm the obligations of the Foothills Apartments
in this matter. The Foothills Apartments shall, at the time of further
improvements on Stuart Street at the Canal, or by order of the City of
Fort Collins, complete the street improvements within the dedicated right—
of—way of Stuart Street, as indicated on the Foothills Apartments Flat,
such curb and gutters, valley gutters, base and paving, to be installed
in accordance with City of Fort Collins Specifications and approved by
the City.

RE: Foothills Apartments seder and water charges.
As of this date., I have been unable to contact dlr. Fischer, but
have talked with Winfred Kurtz. He has advised me that they have
nothin- against the individualwater services and sewer services to
each building as presently required, in fact, they feel that this is
a very good rcqu ,-em�.nt. The only thing which Air. Fischer has against
the present sjS.cm is the fact that he is currently paying for water
at a chart,e o` $.44 per thoue_rd gellons 14 different times and will
soon be paying at the. $.44 rno 33 t. Les, wherean if he had a single
meter, he would pay at the prewium race only once.
The 14 buildings constituting Foothills Apartments First Filirg,,
have b^en on City sewer and water in excess of one year and a comparison
has been rude of the charges made by the City during this one-year
period. The total water bill for the 14 units during the 12-month
period of 196C :as $1,623.41 and the total seder bill was $1,055.24.

would hnv, been $944.77 for canter and $614.10 for sewer.
The above savings to Foothills Apartments on these 14 units, and
consequently the loss to the City of $1114 during tlAr one-year period
indicates initially that. probably the $.15 charge per thousand gallons
for bulk water is too low and should be adjusted. Based on the 34
motors, it payinj a minimum, the change for water under tba present
system avoragcs out to be. $1.29 per living unit per Death, had the
14 units boon served with a single meter, the charge would have been
$.75 per living unit per month.
I feel that Mr. Fischer has a justified complaintof theory and
feel maybe he is belna descriminated a_ainst, in that he has spread
his 105 living units out into 1.4 different builcdinIs. On this basis,
I would recowrcnd that his water'cousurption be totaled for the 14
unite. and eventually for the 33 units and that he be sent a single
bill each month for the foothills developments. I would further
recom-nood that the bulk water- rate of $.15 per thousand gallons be.
revised in the in:nediale future as this cheap rate not only affects
the water revenue of the City but: also the sewer revenue.
