Enclosed is a set of plans for a subdivision called. Falcon Ridge P.U_D. located at the
southeast corner of Colorado Highway 1 (Terry Lake Road) and Gregory Road. The
subdivision takes access off Gregory Road and Spaulding Lane (see plans and vicinity
map) The project was originally submitted to the City over 1 1/2 years ago and has
been inactive due to the owner's financing and negotiations related to the drainage
outfall. The owner is now ready to pursue finalizing the civil engineering plans and
development agreement in order to begin construction this spring.
I have reviewed your previous comments to Steve Olt dated July 29, 1994. In that
letter, you stated that the City should obtain whatever right-of-way dedication we could
request within our regulations. The current right-of-way adjacent to the site is 50 feet
from centerline (85 feet total) and already exceeds the right-of-way necessary for the
City's designation of Highway 1 as a minor arterial (68 feet of r.o.w. total required).
Therefore, the City cannot require dedication of additional right-of-way with this
development. Similarly, we cannot require additional dedication of right-of-way for
Gregory Road for future intersection improvements which are not a direct impact of this
development by itself at this time. Your letter also stated that no improvements are
warranted at the intersection with this development proposal. Since no changes to the
intersection or Highway access are proposed nor required, no Access Permit is being
prepared by the City. However, there are a few items related to the final development
plans which I think are important to bring to C.D.O.T.'s attention.
The traffic study (copy enclosed for your reference) notes the need for a northbound
right -turn lane and a south -bound left turn lane on Highway 1. The study also notes
that those lanes are warranted with or without the development of this P.U.D. and that it
may be possible to utilize the current shoulders and restripe the roadway to
accommodate the lanes. I know C.D.O.T. has had various plans underway to improve
Highway 1, however, I am not sure of the scope or status of those projects. Also, the

project's detention pond and outfall storm sewer are adjacent to Highway 1 and include
some grading within the highway right-of-way (see sheets 13 and 16).
I would appreciate any comments you or anyone else who may need to review the
project for C.D.O.T. may have related to this proposed development. In particular,
would like to knovv: 1) does the City need to have Highway 1 be restriped for the
auxiliary lanes or should that work be delayed until C.D.O.T. does a larger roadway
improvement project ?; 2) Are there any comments on the proposed grading and
construction of the outfall system within the highway r.o.w. ?, 3) What permits, if any,
are necessary for the drainage and storm sewer work in the r.o.w. ? The project is
widening Gregory Road to City standards on the south side of the road adjacent to the
development. There will be room to stripe a left turn lane on Gregory Road for left
turns onto Highway 1. The plans submitted do not currently show a striping plan,
however we will require one as part of our comments back to the project engineer.
The City is scheduled to return written comments to the developer and his consultant
by Friday February 23. Please let me know if you have any questions or, if you would

Dear Kerrie:
Thank you for your February 1, 1996, letter and additional submittals about Falcon Ridge. The
Traffic Impact Study dated March of 1994, anticipates traffic to Spaulding Lane, which I had not
recognized in my initial review of this project. Your letter correctly states that it appears turn
lanes should be constructed for Spaulding Lane.
ACCESS The CDOT construction project to re -align State Highway (SH) 1 is anticipated to
begin in the Spring of 1997. That project will shift SH 1 to the west in the area where Spaulding
Lane connects. A southbound left turn lane along SH 1 to Spaulding Lane will be constructed
with that project. No northbound auxiliary lanes are planned by CDOT. A northbound right
dcccl lane is warranted by this development and should be constructed by the property owner.
The City must support the request by the Department since Spaulding Lane is not their private
access and the City's regulations must support those public intersection improvements. An
Access Permit must be obtained for that work. It the City chooses to assign the property owner
as permittee, that permit can be issued by the City. However, if the City is the permitlee for
Spaulding Lane improvements, CDOT must issue the permit.
The CDOT project does not extend as far as Country Club Road. The traffic study for this site
indicates less than a 20% increase to that public street for this development; therefore, the State
is not in a position to require auxiliary lanes at that intersection.
DRAINAGE Development shall, in no way, increase surface run-off to the State Highway right-
of=way. Appropriate revisions must be made.
Sheet 16 of the utility plans shows existing culverts at and near Spaulding Lane. The CDOT
project will not eliminate those culverts and, in fact, will extend the 18" culvert under Spaulding
Lane to the north and add an end section.

I apologize for not recognizing the impact to Spaulding Lane in my initial review of 1994. This
is the first time the Traffic Impact Study has been provided for the Department's review. That
analysis clarifies traffic increase for this development.
When the City determines who will be issuing authority for the Access Permit, please contact
me. If CDOT is the issuing authority, I would then like to provide my plans checklist to the

This is regarding the proposed Falcon Ridge P.U.D. located in the Southwest'/4 of
Section 36. Township 8 North, Range 69 West of the 6th P.M., Fort Collins, Colorado. It is
adjacent to Colorado Highway 1 but does not have access onto the highway. The low area
adjacent to the highway is being made into a storm water detention pond. A part of the site has
historically drained thru the low area and along the Southerly borrow ditch to the Eaton Ditch.
The detention pond will detain the storm water and reduce the rate of discharge into the borrow
ditch.
There are five existing culverts in the borrow ditch. Four need silt removed and the
Northeast one needs to be replaced because it slopes the wrong way. A small area of the borrow
ditch needs regraded due to poor slope.
The City of Fort Collins Engineering Department has requested a brief letter from you
stating that you will issue a permit to perform the above work in the right-of-way. I spoke to
Tom in your office a couple of weeks ago and he explained the permit is requested by the
contractor at least 48 hours before beginning the maintenance work and a traffic control plan be
included with the request. I then gave this information to the City but they still want your
statement before they will sign the final utility plans for the project.
I am enclosing a copy of the plan for the borrow ditch for your information. Tess Jones
has reviewed the total utility plan. We are not asking you to approve the plan, just tell the City
),on will grant a permit to do the maintenance.

Our office does not have a permit, per se, to issue regarding the work Richard Rutherford is
required to do along Hwy. 1. However, this letter will give him authorization to accomplish the
work necessary in our ROW with the following stipulations:
1) 48 hours advance notice needs to be given to Glen Gibson, Sr. Hwy, Mtce.
Worker from Wellington, before any work commences. His office phone #
is 568-7268.
2) A final inspection is also required after work is completed. Contact
Glen Gibson for this also.
3) No work on weekends or holidays, daylight hours only.
4) Follow the MUTCD guidelines for traffic control.
5) All disturbed areas of ROW will be reseeded.

Poudre Fire Authority is currently holding $30,000 in escrow, as per the land purchase
contract, to be paid to Sandcreek Development upon completion of the improvements.
In the event Sandcreek Development does not complete the storm drainage
improvements, as specified in the development agreement, by April 15, 1999, Poudre
Fire Authority will use the escrowed funds to complete the improvements located within
Lot 2 and Tract "B" of the first replat of the Falcon Ridge PUD.
