Further, this modular structure is to be used on a temporary basis until such time as a permanent structure would be built. At the time the property was brought before the City's conceptual review team, there was no mention of a modular structure. The purpose of this letter is to clarify the process for site development given the new development scenario. Please be aware that under the Zoning Code, the modular structure will trigger the normal development requirements as if it were a permanent structure. The Zoning Code does not recognize a temporary condition or time frame, but rather, considers all structures to be permanent and subject to full inspection for compliance with all pertinent codes, fees, and the conditions of a certificate of occupancy. It is our hope that you have a copy of the original conceptual review comments for the site. It is not our intent to duplicate these comments here but outline the major issues. One of the primary comments is that the placement of a modular structure will require the property to be platted. In addition, the modular structure must apply for a building permit that is processed by the City's Building Inspection Division. This process is described in the enclosed hand-out entitled "Use -By -Right - Review" which is excerpted from our Development Manual. This document contains detailed information and is an excellent resource if you are not familiar with land development in Fort Collins. The placement of a modular structure will require the submittal of a traffic impact analysis. This study will address the design of the deceleration lane for northbound College Avenue. This decel lane will be required to be built with the placement of the modular structure. 1 North College Avenue • P.O. This must be done in accordance with the Zoning Code and the Parking Lot Development Guide. The modular structure will trigger submittal of a utility plan, storm drainage report, drainage and grading plan, and erosion control plan. The obligations of the developer, as set forth in these documents, will be specified in a development agreement that must be executed by the City and the developer prior to beginning land development on the site. As applicants, you should allow eight to ten weeks from the date such plans and reports are submitted to the City for review. Finally, normal building permit fees will be due for the modular structure. These fees are specified in the Development Manual. It is our hope that your development plans for this property proceed smoothly with a full understanding of the submittal requirements for a modular structure. Water, Waste & Land 2629 Redwing Road Suite 200 Fort Collins, CO 80526 Dear Maurice: The following is a summary of my notes from our meeting on Tuesday, July 19, 1994 regarding the First Choice Bank site at the corner of South College and Horsetooth: • The property is in the HB, Highway Business zoning district. The proposed uses and office building is a use by right in this district. • The Code does not address the siting of a temporary facility therefore it is treated like a permanent structure for all development review. The temporary structure must follow all Code requirements such as setbacks and parking. Special care must be taken in siting the temporary structure to ensure it maintains the appropriate setbacks as the improvements associated with the permanent building are being constructed. • This parcel requires platting before a building permit can be issued. As we discussed, it will be possible to plat just for the area involved in the temporary bank operation then replat at a later date to include the entire property. This plat will be processed as a Minor Subdivision and will be processed through the Development Review Center. The typical review time is four to six weeks depending on the complexity of the project. • If you only plat for the area of the temporary structure, you will only need to prepare a site plan for the area the temporary structure sits on. • No access will be permitted from Horsetooth Road, even for the temporary facility. Access will need to be provided from Mitchell Drive. This will need to be shown on the site plan. You will also need to provide the design for the intersection of the temporary Mitchell Drive with Horsetooth to include measures that limit access to right in, right out, left in only. • Engineering is preparing to go to condemnation to take possession of the "Hiller" portion of the Mitchell Drive right-of-way at the intersection of Horsetooth and Mitchell. They intend to request immediate possession so it should not delay permanent construction of Mitchell. This still requires City Council approval. • All. review of detention and stormwater issues are being coordinated with Glenn Schlueter of the Stormwater Utility. • The dedication of the right-of-way for Mitchell Drive will be required at the time of the initial plat. All other required dedications will occur at the time of replat. o While the City will apply for the State Highway permit for the turn lane on College Avenue, the applicant will need to show it on the site plan and construct it. The City will reimburse in accordance with the City Code for its construction from the street oversizing fund. • The review of the utility plans by the Development Review Engineers will be critical to maintaining the desired timeline. The typical review period has been ten to twelve weeks depending on the number of revisions required. This time period includes the review of utility plans as well as the preparation of a development agreement. A development agreement will be required for the temporary structure as well as for the permanent building. Collateral will be required to guarantee the completion of Mitchell Drive, the ditch culvert, Horsetoach Road improvements and other improvements that may be identified during the review process. Corner SH 287/Horsetooth Fort Collins I have reviewed the First Choice Bank proposal and offer the following comments. I met with Tom Vosburg and Alex Ariniello regarding this development on August 11, 1994. We reviewed a site plan (which they provided) and the traffic impact this development and related street additions could have upon the state highway. I made some suggestions to Tom and Alex regarding the improvements to College Avenue which include a right deceleration lane. We discussed the additional investigations that the City should require in order to properly plan and permit improvements at the Horsetooth Road intersection. Tom provided me a portion of the Traffic Analysis which was completed by Leigh, Scott and Cleary. I am in basic agreement with the presentation of conclusions for this development presented in that study. Based upon the volume increase due to construction of the bank, improvements proposed to the Horsetooth/College intersection are not required by the State Highway Access Code, although improvements are desirable. Any changes require the issuance of a State Highway Access Permit which should be issued by the State to the City. The City or the developer may be the applicant. I had a phone message from Kerrie Ashbeck of the City on August 16, 1994 regarding the question of permit. I have not been able to contact her as I have been away from the office. I am providing her a copy of this correspondence in response to her question. Further review of the improvements is required with City personnel. Please discuss details of our August 11, 1994 review with Tom Vosburg of the City's Transportation Division. My comments are based upon the submittal as received August 2, 1994 and upon my August 11, 1994 meeting. I apologize for not meeting the August 12th deadline and hope that the timing of my comments has not posed a problem for the City planning process. December 5, 1994 Ms. Kerrie Ashbeck City of Fort Collins 281 North College Avenue Fort Collins, Colorado 80524 RE: 1 ST CHOICE BANK - MEDIAN DESIGN AT MITCHELL DRIVE AND HORSETOOTH ROAD Dear Ms. Ashbeck: As we understand it,, there is question regarding the proposed traffic flow between Mitchell Drive Extension south of Horsetooth Road, the existing portion of Mitchell Drive that provides a connection with The Square Shopping Mall and the traffic on Horsetooth Road at the resulting cross intersection. On our pre!iminary drawings we have shown a median design at the intersection of Mitchell Drive Extension, Horsetooth and existing Mitchell Drive that would allow west bound traffic on Horsetooth to turn south to Mitchell Drive Extension, continue west bound on Horsetooth or turn north into the Square. Under this median design, east bound traffic on Horsetooth could turn south into Mitchell Drive Extension, could continue east bound on Horsetooth but could not turn into the Square. All north bound traffic on Mitchell Drive Extension would be forced to turn east on Horsetooth. This is all in accordance with the thinking that evolved at the City when Little Caesar's Pizza was considering developing the property at the southeast corner of Horsetooth and Mitchell Drive Extension. Now we are told that this design could cause problems with the owners and tenants of the Square. Please provide us with direction at your earliest possible convenience as we can not complete Utility Drawings for the referenced project until this has been resolved. Thank vo,.; for your help.
