Oak Fort Collins, Colorado 80524 RE: Fort Collins National Bank Dear Mr. Swain: Paragraph 2..D of the subdivision agreement for the referenced subdivision refers to City Code Section 99-6(F). For the construction of J.F.K. Park- way and Horsetooth Road. Section 99--6(F), requires the City to participate in the cost of constructing streets to arterial and/or collector street standards in lieu of residential street standards. This is further amplified by City Code Section 95-87 which states, in part that monies collected by the oversizing fund shall be used to "pay all cost associated with increasing the width of streets and side- walks to arterial or collector status". In the case of J.F.K. Parkway, the traffic island is interpreted as an associated oversizing cost and would, therefore, be a reimbursable cost to be paid by the City upon completion, acceptance and receipt, by the City Engineer, of copies of paid invoices showing the developer has paid for that portion of the work. The City approved the landscaping and irrigation plans during the P.U.D. review process. The irrigation plan shows water service being extended from the Bank site. Because the Bank will maintain the landscaping in the JFK median, their water tap will be sufficient for irrigating the median. The Bank, therefore, does not need a second water tap. As you are aware the City agreed to connect the water service to facilitate the building construction, prior to the acceptance of the sewer main which is contrary to normal City policy. As of this date Kehn Construction Company has not requested an acceptance for this sewer main. The inspector has contacted Ace P7ason of Jerald Construction on several occasions requesting his assistance in this matter. It is against City ordinances for waste to be discharged into an unapproved sewer system. The City has no other alternative but to have the water service disconnected until such time as the sewer system has been accepted, nor will a certificate of occupancy be issued for this building. You as the agent for the bank have until February 13, 1981 to resolve this problem. If at such time no attempt by the contractor to have his installation approved, the water will then be disconnected. Your letter of ',:arch 25, 1981, to the Bank regarding the above -referenced clatter has been referred to me for reply. Subsequent to your Letter,, representatives of the Bank met with engineers from your cop -'.pang and representatives of the City of Fort Collins. Based on discussions at that meeting and based on our previous investigation in the matter, we have determined the following: 1. The location of the sidewalk as it relates to the pedestal in question received final approval from the City of Fort Collins long before any construction of the sidewalk took place. At that time, the City made no require- r,,ients whatsoever that the pedestal be relocated. I might <-'dd that the location of the sidewalk was a requirement of the City of Fort Collins, not a decision made by Fort Collins National Bank. 2. The plans for the development, which is the way the sidewalk was built, were submitted to engineers from your company and approved by them before the development took place. Your statement that the telephone company was not notified when the final plans were formulated is simply incorrect. Both the architect designing the development and the engineer working on the same for the Bank had conversa- tions with engineers from your company regarding this situation. 3. It would appear that the matter should not be a problem because, according to our information, your company is in the process of placing a much larger cable in the area which would necessitate the relocation of each of the Mr. Wallace M. Therefore, it would appear that your company will be having to replace the pedestal in the very near future. Based on the above, it is the position of Fort Collins National Bank that they are not responsible in any way for any costs related to the location change for the pedestal in question. The pedestal was installed according to plans approved and required by the City of Fort Collins which plans were reviewed by representatives of your company. Thus, I cannot see any basis for Mountain Bell making a demand against the Bank for the cost of relocation. There- fore, this is to advise you that the Bank intends to actively resist any attempt to assess the cost of said relocation against the Bank. In addition, if the pedestal is relocated by mountain Bell, Fort Collins National Bank will require that the sidewalk be repaired to its present condition. They will not accept a cold patch of asphalt as the repairs. Finally, I would point out that the pedestal, as it presently exists, is a visual barrier to one of the Bank's signs. We are in the process of determining what can be done to rectify this problem and will undoubtedly be back in touch with your company regarding this. Box 2266 Fort Collins, Colorado Re: Cost reimbursanent - arterial streets Dear Ms. Burk: Thank you for your letter of April 15, 1981 enclosing your contractors breakdown of costs for constructing Horsetooth Road and J.F. Kennedy Parkway adjacent to your subdivision, to arterial street standards. Fort Collins Code #99-6(F) provides for the City's participation in the cost of oversizing to arterial standards from local street standards. Local streets are defined as being 36-feet wide from face -of -curb to face -of -curb (or from flowli.ne to flowline) . Since your property extends to the centerline of both streets, you are responsible for only one-half of a local street or 18-feet fran flowline. Local streets also require four (4) feet wide sidewalks. The City will reimburse for extra width. Your contractor has submitted a breakdown of his costs which are, frankly, difficult to decipher. However, we have used the utility drawings in conjunction with our construction inspectors' reports and arrived at what we perceive to be the City's responsibility for repayment. We perceive the contractor's Scope A to be from the western most portion of Horsetooth road to approximately halfway in the transition from 36-feet to 46-feet half width - a distance of 258 feet which nearly equals what the contractor .is calling 263-feet. In this area, the City's portion would be 1/3 the earthwork (12' existing, 8' City and 16' bank = 361); 0% of the curb and gutter (normal local street cost); 3/7 of the concrete walks (bank = 41, City = 3') and 1/3 of the paving (same rational as the earthwork). Scope A, City's portion = $3,663.64 We perceive the contractor's Scope B to be fran half the transition to Station 4 + 29.10 (utility drawing) which is approximately 197-feet (compared to his 182-feet). The City's responsibility in this area is 1/2 the earthwork, 0% of curb and gutter, 3/7 of the sidewalk, and 1/2 the paving.- (Total 36' width) Scope B, City's portion = $4,471.50 Ms. Betty L. Burk Page Two We perceive the contractor's Scope C to be from station 4+29:10 to the east end of the road construction. In this area, the City would be responsible for 6/10 of the earthwork only. The normal local street would require 4-inches of base whereas this requires 10-inches of base. Therefore, the City will pay for the extra 6-inches or 6/10 of the earthwork; 0% curb and gutter and 0% of the paving. Paving is 12-feet wide in this area which is within the 16-feet required for local street (half). Scope C, City's portion = $1,597.20 Scope D, E and F are all the bank's expense since no public right-of-way is included. Total City's portion of Horsetooth Road = $9,732.34 J.F.K. Parkway we perceive as the bank being responsible for the east 18-feet (1/2 of a local street) including a 4-foot walk and the curb and gutter on the east side. Your contractor has given us corrected quantities for sidewalk and curb and gutter items. We calculate the City's portion of the earthwork and paving as 40.880 of the total. Your contractor's revised quantities for sidewalk are 3-feet x 310-feet (City's) = 930 s.f. @ $1.35 = $1,255.50. Island curb and gutter = 665 L.f. @ $6.00 (City's) = 3,990.00 City's portion of earthwork and asphalt paving = 40.88% of $16,388.00 = 6,699.41 Total City's portion of J.F.K. = Grand total of City's portion to date = 11,944.91 $21,677.25 This total is slightly more than I first quoted you as I adjusted the J.F.K. earthwork and paving upward. We would prefer to hold repayment until after all paving is completed. However, we will make this partial payment if you request it. If you have any questions, please feel free to contact me. Boulevard) extended and west of the Wharf -Phase I. In addition to speaking to you, I also have spoken to City Traffic Engineer Bob Lee and Director of Planning and Development, Chuck Mabry on this subject of street dedications. For the purposes of site planning this property, I will be using the following city requirements given to me by Mr. Lee, Mr. Mabry and yourself: 1. Widening of Horsetooth Road --An additional 20 feet of dedication shall be required on the south side of Horsetooth Road. Along with the 20 foot dedication that will be required on the north side, this will increase the existing R.O.W. from 60 feet to 100 feet. 2. Dedication for J.F.K. Boulevard --A portion of the J.F.K. R.O.W. will be dedicated by the Fort Collins National Bank property. During our phone conversation you indicated that you would check with Bob Lee to determine the exact width of this dedication require- ment. 3. Curbcuts on Horsetooth Road --A minimum of one curbcut will be allowed on Horsetooth Road, probably at the property line dividing the Fort Collins National Bank property and the Horsetooth Commercial Properties property (see attached map). However, both you and Mr. Lee have agreed to consider a second curbcut, depending upon the site planning and user characteristics of the P.U.D. proposal. 4. Extension of Landing Drive --Mr. Lee, Mr. Mabry and your- self have stated that Landings Drive should definitely be shown as extending through the subject property to J.F.K. Boulevard. As I understand, the city intends to require this whether or not the extension of Stanford Street to Horsetooth Road is aligned with 528 S. Howes Fort Collins. Fort Collins National Bank owns the west 6.35 acres of the subject property, and Horsetooth Properties owns the east 4.82 acres. The Bank intends to develop its property in two phases. The First Phase will be twelve (12) retail drive-thru windows and an approximately 1000 square foot detached facility with three (3) commercial drive-thru windows; the Second Phase will be 40,000 to 60,000 square moot bank building. Horsetooth Properties is not an intended user of its site, but will be completing the site planning as a marketing tool for resale purposes. Presently, I am under instructions by the owners to design one site plan including both properties. However, depending upon the timing of each property owner, two unified yet independently submitted site plans may be petitioned. As you can well understand, street dedications and curbcuts are a major design determinant in this project. Please contact me immediately if I have mis-understood or you have changed your orig- inal, above stated information. Also, I am awaiting a figure on J.F.K. R.O.W. requirements. Gary Castle Fort Collins National Bank 3131 South College Fort Collins, Colorado 80525 v Dear Mr. Castle: We appreciate the opportunity to review the site plan for the proposed Fort Collins National Bank facility at the southeast corner of 11orsetooth Road and the proposed JFK Parkway. We completed preliminary drainage and detention calculations and provided A1r. Les Kaplan with that information in our meeting of September 19, 1979. It was noted at the meeting that a more refined and detailed analysis should be undertaken to further define and minimize the impact of storm drainage on the drive -through banking facility. The scope of work required to analyze the drainage impact is beyond what would normally be considered for preliminary review by the City of Fort Collins and nearly completes the final calculations for a site drainage and detention report. In the course of our analysis, we formulated a baseline drainage plan for comparison of the alternate improvement schemes. Splitting the land into north and south basins at a natural high point (or basin boundary) and putting one pond at each of the low points gives the normal detention pattern. Without further site use considerations, this would be the preferred plan. Eight alternative plans were devised as follows: 1. Use a natural high point location about the midpoint of the property to split the drainage basin and accommmodate two detention ponds in the northern half of the site and one pond in the southern portion. 2. %love the high point from the natural location approximately 150 feet north, accommodate two detention ponds in the northern portion of the site as well as one pond in the southern portion, and adjust release rates to permit the northern basin lower per acreage detention. 3. For each of the first two alternatives, relocate the main bank facility 60 feet south of the location shown on the site plan. For each of these four alternatives, we analyzed with the parking areas accommodating all of the detained storm water as well as with an underground vault to provide some storage capability. This vault may be constructed in the form of an oversized storm sewer, designed primarily to accommodate most or all of the 2-year frequency storm water runoff volume. Variables we have addressed include relative construction costs for the various alternatives, the effects of the 100-year frequency storm on all three detention ponds, as well as the effect of the 2-year frequency storm on the drive -through facility. All alternatives meet the City of Fort Collins storm detention and runoff requirements. Results of our analysis are presented in tabular form as part of this report. We feel the best alternative would be to move the high point on the site approximately 150 feet north of the natural high point location. Some amount of detention for the northern basin is accommodated in the area between the drive -through facility and the main bank- facility. The remaining detention requirements for the northern basin are met in an area in the northwest corner of the property. There is no real need to change the location of the main bank facility. Without a vault, the extent of the ponding for the 2-year frequency storm in the area of the drive -through facility would be about 62' x 62' with the 6-incli water depth line being 12-feet from the outside edge of the pond. A length of 480 feet of 36-inch diameter pipe (the underground vault) can be installed at a differential cost of about $17,000. This would eliminate all ponding for the 2-year event (see accompanying site plan). I hope the contents of this report adequately addresses your concerns regarding drainage and detention for the Fort Collins National Bank site. The conceptual drainage plan resulting from this study has been submitted with the preliminary plan to the Planning Department. Briefly, the bank site will be broken into two basins. The southern basin w i I I store extra water and release it more slowly than the northern basin causing less impact in the heavily used north end of the site. In cooperation with Horsetooth Properties, storm water from the bank site will be routed through two other detention ponds prior to entering Warren Reservoir. No discharge will be released onto City roads except as spillway -type flow over Landings Drive near Horsetooth Road. Even this will not exceed historic flooding at that intersection. In developing this drainage plan, coordination between our firm and Cox/Parker Associates and Warren Reservoir Company has been maintained. We are satisfied that the present site plan adequately addresses storm drainage at the preliminary level and allows some flexibility in the event that the developer's access or parking needs change. I, too, am informed that they will be part of the pay -backs from the City and that landscaping and maintenance will likewise be picked up by the City with the result that we may neither of us have any responsibility. Your letter satisfies me that you will pay, on proper billing, half of our carrying costs in the event that we have to advance such costs prior to receiving pay -back from the City. I further understand your letter to agree that in the event we are both wrong and the City doesn't for one reason or another pay these costs, that you will also pay your share, that is half of our costs connected with the designing and consturction of these islands. I would like further to have an understanding with you that if for any reason the City backs off from landscaping and maintaining the islands along the stretch of our common boundary, that we would get together and insure that this work is done so that the island medians in questions constitute an amenity for an addition of value to our property rather than a distraction.
