Re: Fort Collins Spring Creek Company Planned Unit Development
Dear Mr. Liquin:
This letter shall serve as notice of our intent to develop the
Fort Collins Spring Creek Company Planned Unit Development in
conformance with the information and schedule contained in data
presented for approval. In conjunction with this development,
it is our intent to extend the 30" water line from the presert-
location in Shields Street south to the center line of Drake
Road.
It is understood that the City is to purchase the 30" pipe and
we are to pay for the engineering and installation of same, bill-
ing and City monthly for the difference in cost between the total
cost for a 6" line and the cost of installing the 30" line. It
is further understood that if additional customers tap onto the
water line, the City will collect from them their share of the
cost of a 6" line and reimburse this amount to the Fort Collins
Spring Creek Company.

Dear Mr. Rackstaff:
Your letter of March 22nd relative to the Fort Collins Springcreek
Company Planned Unit Development, has been reviewed with the Admiuistratioa,
and 1 feel some clarification should be made.
The Master Plan for water main installation calls for a 30 inch line
on Shields Street from the present location to Drake Road. The ditch
crossiapp have been made and most of the 30 inca pipe is on nand. The
balance of the required pipe and the necessary fittings will be ordered
in the near future, as soon as the participation is agreed upon.
This particular installation is somewhat unusual, in that the existing
36 inch pipe in the north end of the extension will have to be tapped, there
will be a crossing of Springcreek and two ditch crossings, and it is anti-
cipated that adjacent to your property, to serve the fire 'hydrants and
your development, it will be necessary to tap the pipe three times with
6 inch lines for proper service. Based on the unusual conditions of this
extension and 'based on figures available to us, it would appear that the
normal cost of a 6 inch line would be approximately 25 percent of the total
cost of the extension.
With this in mind, the City will provide the right-of-way, furnish
all materials, and as stated above, the City has already completed the
two ditch crossings. You, as a developer, would provide the engineering
and the installation of the line, and upon completion of the entire project,
the total cost: would be tabulated and split on a 25 percent-75 percent ratio.
At that time, the City will enter into an agreement with you, that as
properties benefited by this line are served, that the City will collect
from them and reimburse you for that amount.

Kindly advise us if the above participation is acceptable to your
firm, and if so, the City will proceed with the purchase of the additional
material.

Dear Mr. Hackstaff:
In February of 1970, based on the intentions of your company to
develop the property at Drake and Shields, the City proceeded with the
bidding of the necessary material. Upon receipt of the bids, the City
was unable to obtain a committment from you, in which case these bids
were rejected. In December, 1970 3,000 feet of the necessary pipe
was re -bid and purchased. During 1971 the balance of all the material
was purchased by the City and is presently stockpiled on Shields Street.
It was anticipated by the City that the entire 4,000 feet of 30
inch line, together with the necessary fittings, would be a single
project, in which case, the actual cost of the initial connection with
the 36 inch main, a copy of which is enclosed, would be spread over the
entire project, and the reimbursement to the contracting parties would be
on this basis.
I Have been advised this past week that a developer in Section 23
east of Shields Street plans to proceed with the first approximate
1/4 mile of this 30 inch line and the City has agreed that the costs,
between the red lines on the enclosed sketch, would be kept separate
from the main line installation and the excess cost of said section
would be pro -rated over the 4,000 feet of line.
In the event your plans have progressed sufficiently to proceed
with your construction in the near future,kindly advise this office.

RE: Participation on 30 Inch Water Main
Approximately two years ago, developers in the vicinity of Drake Road
and Shields Street requested water service. They were advised that according
to the master plan it would be necessary to extend a 30 inch water main
from its present location on Shields Street south to the centerline of
Orake Road. On March 22, 1971, a letter was received from Fort Collins
Springcr.eek Company advising that they intended to develop a unit develop-
ment and would the City purchase the necessary material, with the City
paying the difference between the total cost of a 6 inch line and the
cost of installing a 30 inch line. This was answered on March 29, 1971,
copies of both letters attached herewith, advising them that the City
would be willing to participate on a flat 75 - 25 percent ratio and would
enter into a repay agreement.
Bids have now been received for the furnishing of all labor, equipment,
and miscellaneous materials not furnished by the City. The bids are as
follows:
Jack Henry Excavating Company $47,419.00
C.P.L. Constructors, Inc. $61,668.00
Gurwell Construction Company $61,862.20
The developers are now anxious to proceed with the construction of
this line and I would recommend the Council's acceptance of Jack Henry
Excavating Company as the low bidder and the approval of the 75 - 25
percent ratio participation on this line.
