RE: REQUEST TO VACATE PORTIONS OF A UTILITY EASEMENT AND REQUEST
FOR VARYING DEDICATION OF ADDITIONAL UTILITY EASEMENT DUE TO
ADDITIONAL R.O.W. REQUIRED AND PROPOSED BUILDING PLACEMENT
Attached for your review and comments is a vacation request sketch by the Applicant
showing Riverside Avenue just to the east of the EPIC recreation center, more specifically
located south of Prospect on Riverside. Along Riverside, three small portions of the existing
easement are requested to be vacated; the northmost is 0.6 feet by 30.4 feet running north
and south along the west edge of the existing easement, the middle is 0.6 feet by 30.5 feet
running north and south along the west edge of the existing easement, and the southmost is
a triangle measuring 3.3 feet by 12.7 feet by 12.3 feet, also along the west edge of the
existing easement. In addition, a portion of the easement that is 6' wide running parallel to
the existing ROW on Riverside is also part of the request for vacation, since it is required of
this project that 6' of additional ROW be dedicated on each side of Riverside. These areas
are all shown on Exhibit "B" and are all proposed for vacation. The Applicant is requesting
the easement vacation because they wish to expand the building into certain areas and
must also dedicate 6' of ROW along Riverside.
The Applicant is also proposing the dedication of varied easement widths along the west
side of Riverside due to proposed placement of the building. In all other areas an additional
5' of utility easement will be dedicated to result in a 9' wide utility easement running parallel
to the new Riverside ROW. Please carefully examine what is being proposed by the
applicant.
Please sign and return any comments to Katie Moore in the Development Review
Department by June 24, 2002. If no correspondence has been returned by this date, it will
be assumed that you have no objections to the proposed vacation. Please feel free to

In early June, a request for portions of a utility easement to be vacated along Riverside adjacent to EPIC
was received. The drawings were routed to the appropriate utilities with comments due June 24t . Dennis
Greenwalt, with AT&T Broadband, has expressed concerns with the vacations. Until such time as his
concerns have been addressed, this easement cannot be vacated.
I have attached a copy of his letter for further information.
