PZ94-4 OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS VACATING A UTILITY EASEMENT DEDICATED ON THE PLAT OF THE FOOTHILLS APARTMENTS ADDITION s; WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval of replats containing notation of such vacation; and s WHEREAS, the Owner of the Foothills Apartments Addition has h`t requested that the City vacate a utility easement on said property more particularly described on Exhibit "A"s attached hereto and incorporated herein by this reference; and WHEREAS, the easement proposed for vacation is no longer necessary to retain and the vacation request has been reviewed and approved by the pertinent City and private utilities, and they have r- no objections. r, NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort Collins that the utility easement dedicated on the plat of the Foothills Apartments Addition, more particularly described on Exhibit "A", attached hereto and incorporated herewith, be and is hereby vacated. �r Passed and adopted at a regular meeting of the Planning and Zoning Board of the City of Fort Collins held this 25th day of April, A.D. 1994. rn s ha rman x uz y ATT . as a x� ecretary CAfY0FFOiV DOLL IKS- EXHIBIT "A" Legal Description Utility Easement to be Vacated A tract of land situated in the northeast quarter of Section 22, Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, County of Latimer, State of Colorado, shown as a utility easement on the plat of Foothills Apartments, Addition recorded July 28, 1971 in Book 1470 at Page 235, and being more particularly described as follows: Commencing at the east quarter corner of Section 22; thence west along the south line of the northeast quarter a distance of 356.64 feet; thence on a deflection angle to the right of 90' 00' 00" a distance of 712.00 feet to the intersection of the northwesterly line of the 20 foot sanitary sewer easement, being as shown on the plat of Foothills Apartments, Addition, with a line running parallel with and 15.00 feet distant from the principal northeasterly wall of the building known as 1917-A South Shields Street, which building is shown on the plat of Foothills Apartments, Addition, as Lot 1; thence on a deflection angle to the left of 720 03' 00" and parallel with and 15.00 feet distant from the principal northeasterly wall of the building known as 1917-A South Shields Street, a distance of 58.79 feet to a point on the southeasterly line of a 10 foot utility easement shown on the plat of Foothills Apartments, Addition, and the Point of Beginning; thence continuing along the last described course a distance of 1.1.87 feet to a point on the northwesterly line of the 10 foot utility easement; thence on a deflection angle to the right of 122037'41" along the northwesterly line of the 10 foot utility easement a distance of 127.58 feet to a point on the northwesterly line of the 20 foot sanitary sewer easement described above; thence on a deflection angle to the right of 146' 22'19" along the northwesterly line of the 20 foot sanitary sewer easement a distance of 18.06 feet to a point on the southeasterly line of the 10 foot utility easement; thence on a deflection angle to the right of 33' 37' 41" along the southeasterly line of the 10 foot utility easement a distance of 106.14 feet to the Point of Beginning; containing 1,168 square feet more or less.
