Dear Gary,
In regard to Fairway 5 at Southridge Greens, we realize
that there is no final approval on the development plans
at this time and that there may be necessary removals possible
by going ahead with the curb and gutter.
We are proceeding on Bill Albrecht's approval with the
understanding that Albrecht Homes will take the responsibility
for any work that we perform there or any change that night
need to be made.

Gary,
I have talked with Bill Albretch about his Fairway Five Development and the
differences with the report prepared by Empire and Aguirre's reveiw of the same.
I told him that we as the City were discussing the possibility of having
a more in-depth study done to more accurately determine the situation.
Bill was somewhat concerned but, not entirely opposed. His concern is to get
out from under this development. Bill wants to futher discuss options other
than an extended warranty and also a time frame for completion. I have
scheduled a meeting for Wed. Jan. 4, 1989 in the Engineering conference
room at 10:00, between Bill, Ben Connell (the contractor) and myself.

Dear Mr. Albrecht:
The intent of this letter is to address some concerns I have regarding the
installation of public improvements in the Fairway Five Estates Planned
Unit Development. Recently, many areas of street settlement have begun to
appear. The major settlements seem to be around manholes, valve boxes and
sanitary service laterals with some settlement of water service trenches.
I am concerned with the amount of settlement which has already occurred.
It is quit extensive for a development less than one year old, and further
damage will occur in the future from additional settlement. It is my
opinion that what we are seeing today is just the beginning, and street
settlements will continue.
In reviewing our files I cannot find any record of density tests for the
underground utility work, street, curb, gutter, or sidewalks. The only
test results we have are for the density and gradations of the asphalt
pavement and concrete curb, gutter and sidewalk. Were tests taken on the
backfill of the water and sewer work? If so, were they sufficient to guard
against the possibility of major settlement?
As you recall, the City allowed construction of this project to begin prior
to the approval of the utility plans with the understanding that Albrecht
Companies would be responsible for the performance of its contractors as it
relates to the construction of the public improvements. Based upon what is
currently taking place in this development, the City will not accept any of
the public improvements in Fairway Five Estates development until such time
as it is brought up to an acceptable City standard. Based upon the present
condition of streets in this development, we can only assume the worst.
Therefore, we feel non-destructive testing is required to determine the
adequacy of the pavement and subgrade structure. Please call us to set up
a meeting so that we can discuss the City's requirements for this
non-destructive testing.

I understand some corrective work is beginning to take place, which
consists of cutting out the damaged areas and replacing the asphalt. This
method is fine, provided the trench backfill is re=TPacted prior to
replacing the asphalt. However, as I stated previously, the probability of
additional settlement is great and we need to be satisfied that there will
not be any further street damage due to utility trench failure. It is my
recommendation that the more severe areas be repaired, then hold off on any
further repairs until the total extent of the problem can be determined.
In addition, it is not in the City's best interest to allow a less then one
year old street to be cut and patched in several locations. This method
only increases our maintenance costs. Therefore, a minimum 3/4 inch plant
mix seal coat or what may be required through the non-destructive tests,
will be required on all streets that may need repair.
Please contact me as soon as possible on what decisions and actions you
intend to take which will address our concerns regarding the streets and
settlement problems in this development.

Dear Mr. Albrecht:
Please accept my apology for not responding sooner to your inquiries regarding
the City's position towards the street repairs in the Fairway Five Development.
After reviewing the report prepared by Empire Iaboratory and through much
discussion with our geotechnical consultant (Aguirre Engineering), we find this
situation to be more complex then what was originally anticipated.
It is our contention that several questions remain unanswered. Particularly,
(1) will there be additional settlement in the future?
(2) why are the laboratory density tests significantly higher than what is
normally encountered in the field, and
(3) there appears to be some inconsistencies in the swell test results.
However, without performing extensive destructive testing, the answers to
these questions will remain unanswered. In lieu of additional tests, the
City is willing to accept the recommendations as stated in Empire's report
with the following conditions:
A. In the areas which currently exhibit signs of settlement the limits for
removal, recompaction, and asphalt replacement, will be determined by the
City.
B. Empire Labs is to be retained to test the backfill material and the
depths of removal.

C. If a soil backfill is used, then moisture/density tests shall be taken at
maximum one foot intervals and shall meet the recommendations specified on
pages 4 through 6 of the report.
D. The street system is to be maintained for a period of five (5) years.
E. A performance bond is to be posted for the monitoring period.
We agree in part with the section of the report concerning the monitoring
Of future settlement. Except, we want the asphalt surface to be installed
at the time of the trench backfill restoration. Additionally, we are
requiring that the entire street system for this development, be monitored
for future settlement. It is our belief that without sufficient data (time
rate of consolidation test), the statement that future settlement will be
minimal is inaccurate. Therefore, I request that these streets be
monitored at your expense for a period of five (5) years, and to ensure
that future settlements will be corrected, we must ask for a performance
bond to be in full force and effect for the monitoring period.
Lastly, the report stated that some movement of manholes from soil
expansion was noted . But, it failed to address any reconmeridations for
correcting the situation and the swell tests do not indicate extensive
swell potential. In talking with Dean Hill of the water district, there
was no evidence of the manholes rising when he performed a visual
inspection of the system last week. However, to protect their interest, we
must request the extended warranty and performance bond also include the
underground utility system.
I appreciate the fact that you have been willing to work with the City in
correcting this situation and hopefully, the recommendations as outlined in
Empire's report will solve the problem without any additional expense.
Again, let me thank you for your time, patience and interest, in getting
these streets into an acceptable condition. If you have any questions,

Dear Mr. Albrecht:
After our telephone conversation on Monday, October 24, Gary Diede and I
visited the Fairway Five development to reassess the condition of the
street failures. Through our review of the area and evaluating the amount
of street settlement which has already occurred, additional settlement is
probable. Therefore, once the immediate repairs are made, we request that
an extended warranty period of five years with an escrow account be
established.
In order to address your concern of what an appropriate escrow amount would
be, I used 1700 feet of trench length including services. This is the
approximate length of sewer trench currently under the asphalt pavement.
Following is a breakdown of what was used to arrive at what we feel is an
acceptable escrow amount:
Remove existing asphalt and excavate 3 feet wide to a depth of 4 feet -
760 cubic yards.
Recompact trench backfill - 760 cubic yards (using in situ material).
Install and compact 9 inches of class 5 roadbase - 250 tons.
Install 3 inches of grading E asphalt pavement - 160 tons.

Based upon construction costs associated with our projects this year, I
estimate the cost for the work as outlined to be $25,000 provided 100% of
the trenches were to fail. However, this is unlikely, so for purposes of
establishing an escrow amount I've used a figure of 60% trench failure.
Using the 60% number as a figure for potential settlement, the amount to be
escrowed is $15,000.00.
These monies can be in the form of a bond, letter of credit, cash escrow or
some sort of monetary guarantee acceptable to the City which will coincide
with the extended warranty period.
