Gentlemen:
Bartran domes, Inc. is presently developing certain lands described as the
Fn,st 1 of the SW4 of Section 15, Township 7 North, Range 69 West of the 6th P.M. These
lands are being developed as the Fairview "West" Subdivision. The master plan for the
development of these lands is enclosed with this letter as an Exhibit. You will note
that a portion of these lands abuts on the East side of the Avery Park and this area
has been shown on the master plan as a proposed park area.
As you know, a great deal of the land lying West of our lands has been
subdivided and taken into the City, however, there has been very little provision
made for storm drainage in these lands. Most of the storm drainage from this area
to the West goes through a natural slough which eventually forms the Northern boundary
of Avery Park. No provision has been made for carrying this storm drainage beyond
this point. It appears that it is to the best interests of the City to make provision
for this storm drainage before the lands which we are developing are fully. developed.
We have met with Mr. Joe Banner, your consulting engineer, and Mr. Coffey and other
officials of the City in an attempt to help to resolve this storm drainage problem.
As a result of these conferences and studies which have been made by our engineers we
desire to make the following proposal to the City which we feel will solve this problem
with the least possible expense to the City.
We would propose to donate to the City of Fort Collins the area shown on
our master plan as a proposed park. This area has not been surveyed, but consists
of approximately six to seven acres of land. We value this land at $3,500.00 per
acre. If such donation is made it would apply on any future requirements enacted by
the City of Fort Collins requiring land developers to donate land for park or similar
purposes. Such donation would apply to any lands we designate and we would have the
right to assign this credit to any other lard developer. In addition, any monies
spent by us in the development of these lands including the cost of construCtirg the
one-half of the street shown bordering these lands at one point would apply as a cash
credit on future land donation requirements. The credit could be applied by us either
as an acreage credit based on the actual acres donated or as a cash credit based on the
above price of $3,500.00 per acre. We would be entitled to take either credit at our
option, or to take the credit partly as a per acre of land credit and partly as a cash
credit in amounts we designate. Also if we donate these lands for park purposes it
would be necessary that the City agree to develop the same in grass within two growing
seasons after the date of the donation.
In recent years a small pond has been constructed on these lands which
could be used as a ponding area to hold the storm waters until they.can be released
in the New Mercer Canal and carried eventually to the Spring Creek Drainage area.
Eventually, probably this pond would have to be enlarged to provide more storage, but

at this time we are ire owed that this would probably not be necessary. In correction

At the time we take bids for the relocation of the canal we would take one bid on the
basis of relocating the canal for its present capacity and another bid for the cost
of relocating it with the increased capacity to carry the storm waters for the City.
We would expect the City to pay the increased cost caused by the additional size of
the canal.
We would appreciate your taking some action on this as soon as possible as
we are now at a point where we must know how the balance of our lands w:.11 be developed.
