This confirms our earlier conversations regarding trees which
were recently planted under the Drake Road transmission line
on the north side of Drake Road and West of the CSU veterinary
hospital.
I have confirmed that these trees will interfere with the operation
of the transmission line long before they reach maturity. Tom
McCormick of Platte River Power Authority is preparing a letter to
you regarding the extent of interference and the desired set back.
Tim Buchanan told me that this species of tree will grow to 60 feet
at maturity and will not look good if trimmed to provide the required
clearance from the line.
I have been unable to determine that approval for the location of
these trees was given by either the City or FRPA. The following
people were contacted regarding possible approval:

Referring back to the May 16th meeting, Mike Herzig from Planning was to
take the lead in working up a written agreement with the developer. In
talking with Mike, he has just received a proposed agreement for our review.
He will be routing that to departments for comments. Once the details are
identified in that agreement, Forestry would be responsible for carrying out
our responsibilities. I assume I would be the lead staff person after the
agreement is approved.

THERE ARE SEVERAL SITUATIONS IN WHICH THE CITY IS ASKING FOR RIGHT-OF-WAY
OR EASEMENTS THROUGH CSU PROPERTIES. THEY WOULD PREFER TO CONTRIBUTE THESE
FUNDS TO THE ESCROW ACCOUNT RATHER THAN BE PAID DIRECTLY. ENGINEERING HAS
ESTIMATED CSU'S COST FOR THE CONCRETE WORK ON DRAKE TO BE $25,000 IN
1788 COSTS.
I WOULD LIKE MATT TO WORK WITH ALAN KRCMARIK IN SETTING UP THE ESCROW ACCOUNT
AND TRACKING IT ANNUALLY FOR INTEREST INCOME AND PRINCIPLE BALANCE.

The City Staff Comments on the Centre For Advanced Technology
4th Filing (CSURF Project One) included several references to the
installation of landscaping along Drake Road and Research
Boulevard, This letter is intended to provide some clarification
about those landscaped areas.
in the fa11 of 1987, CSURF and the Everitt companies decided
that, in addition to the landscaping required along South Shields
as part of S.I.D. 90, streetscape improvements along Drake and
Research Boulevard were desirable. Subsequently, a set of
landscape construction documents were prepared, competitively
bid, and submitted to the City Forester to obtain a free permit
for plantings within the public rights -of -way. Construction was
begun after a permit was obtained for all trees placed in the
right-of-way. Although no permit is required for landscaping on
private property, all proposed landscaping - public and private -
was included in the "Centre for Advanced Technology 1987
Streetscape Plans" submitted to the City for review. It was
noted at the time of permit application that the ash and linden
trees along Drake Road were being placed near the major overhead
transmission line. The following conclusions were reached, and
confirmed with the City Forester:
- Trees have been planted directly under this transmission
Line along the entire length of Drake Road, and at other
locations around the city. Some examples of locations of
such tree installations include:
* The Drake Crossing Shopping Center
* Raintree Shopping Center
* The Light and Power Substations on Drake Road
* Pinewood Apartments
* Scotch Pines Condominiums

* other residential subdivisions along Drake Road
* City installed street trees on East Prospect
The linden trees are not likely grow to the height of the
power lines; and the ash trees may require some pruning in
about thirty years. However it was felt that the provision
of street trees was desirable enough to balance the need for
pruning in the year 2017 — especially given the common
practice of placing trees under transmission lines at other
locations in the city.
The installation of the trees and berms along Research
Boulevard and Drake Road was coordinated in detail with both
Public Service Company and Mountain Bell. I attended at least
three on —site meetings with the landscape contractor and
representatives of the two utilities.
We are aware that the City Parks and Recreation Department will
not be responsible for maintenance of landscaping in the Drake
Road right—of—way.
The note regarding landscape installation guarantees has been
added to the final PUD landscape plan.
I hope this letter will help to resolve the City"s concerns.

RE: Sanitary sewer stub at the Center for Advanced Technology 4th Filing
The intent of this letter is to notify the Everitt Companies of the City's
decision concerning the sanitary sewer main line problem at manhole 4 on
Research Blvd. which was been installed incorrectly. As I indicated to
you in our telephone conversation of August 29, 1988, when the contractor
for the Cat 4th filing tied into the manhole stub, there was a substantial
elevation difference between the two lines. At this time it was assumed
that the contractor had incorrectly installed the stub from the manhole to
its end. However, upon further investigation by the contractor he felt he
had installed the sewer stub as staked by the Engineer. With this
information I proceeded to try and piece together the conflicting
information I had received from the individuals involved. Needless to say,
this was fruitless and frustrating. At this point the City arranged a
meeting inviting the persons associated with this portion of the C.A.T.
S.I.D. project in hopes of arriving at a solution. At the conclusion of
this meeting, Mark Taylor arrived with a televised tape showing the
condition of the pipe. He also expressed the Sewer Department's concern
that this pipe would become a continual maintenance problem and stated the
only alternative was to remove the original installation and relay the pipe
from the manhole into the Cat 4th project. Additional discussion and other
options were explored but Mark was not willing to change the original
decision.

As you are aware, much discussion has taken place between the City, the
design engineer, and the contractor, as to what occurred at this location
and what can be done to correct it. However, the final decision has been
made and it is now time to get the situation corrected. It is the City's
contention that the problem is a result of the S.I.D. construction and
should be corrected by that project. I believe as project manager for the
S.I.D. it is your responsibility to contact the original contractor and
instruct him to make the necessary change to rectify this situation.
Furthermore, there has been a considerable delay in the completion of the
cutfall system for the CAT 4th filing's sewer line and I don't feel it is
unreasonable to request that the final repairs be completed within two
weeks from receipt of this letter.
I understand this does not leave much time to get your contractor lined up.
But, the building contractor is ready to begin construction and will need a
functional sewer system in the near future.

A meeting was held on May 16 to resolve the problem with trees
planted under the transmission line adjacent to West Drake Road
at the Center for Advanced Technology (CAT). The following

Tom Peterson suggested that Parks and Recreation replace the trees
with a shorter species which would not interfere with the transmission
line and that the present trees be moved to other locations on the
site. Replacement is to be completed within three years. Also, a
15 foot general utility easement would be granted along the north side
of the transmission line at this time. The cost of replacing the trees
will be barn by Parks and Recreation as all of the trees are in or will
be in City R.O.W. All parties were in agreement with the proposal..
Lucia will prepare an agreement..

The Planning and Zoning Board previously approved the Final Site Plan for this tract on March 28, 1988, for
construction of a 35,000 sq.R. 2-story office building, pending approval of the building design through the Administrative
Review Process (now known as a Minor Amendment) by the Planning Department. In accordance with the guidelines
and requirements set forth in said approval, we are herebv submitting to you copies of the Site Plan/Landscape Plan,
Utilitv Plans, and Exterior Elevations for the building, along with a filing fee of $168.00.
